I wish I new about this info that I could go inside the building and talk to the agent , I applied for it in October because my mother was in very bad health problems , unfortunately she passed away last December, and I'm still waiting for the letter so I can go for the interview 😔

Thank for the video! It seams there is hope for me. I’m in that process of ten years without leave the Country. Please, can I apply for advance parole? My Loyer said that advance parole is not for us, because we still having our courts and they are for us to prove that we did not leave the Country in ten years.

Hello, In our experience, the doctor’s letter should simply include the patient’s diagnoses and prognosis - in other words, what conditions/illnesses do they have and how serious are they? In many cases, a doctor’s letter may also state that a patient would benefit from a visit by the applicant for emergency AP. I hope that helps!

Thanks so much for this information! My grandmother passed a few days ago while visiting here in the US. However her body will be sent home for the burial process. I have contacted the coroner's office to obtain a death certificate as proof to be able to ask for an advance parole to be able to attend her funeral in Mexico, without any luck. I spoke with someone at the public record office who said the document would not be available until 5-7weeks from now. Is there a way to receive advance parole without this document or how do I go about this?

Hello, I’m so sorry to hear you lost your grandmother. I am wondering whether there may be an alternative official in the USA or an official in Mexico who could provide a document that could serve as proof of death. Perhaps a document from the funeral administrators? I think it would likely be worth a try with an alternate form of proof, though I’m not exactly sure what is available in this situation. I wish you the best and, again, am sorry for your loss.

Hello, I am in need to file for an advance parole, my grandma is in the hospital in Sever illness as I’m writing this. I asked for paperwork to use as proof but my question is, can it be faxed or emailed? Will they take those documents or do I need to have the original? I’m not sure how long it would take if they direct mail to me.

Hi, Marilu, In our experience, faxed or emailed copies of documents should work. If they’re not written in English, they will need to have certified English translations.

Hello, I have Daca I entered the us illegally my wife is a citizen and my I-130 has been approved. My grandmother is very ill and I got an advance parole approved. Should I go even if I have not file my -601a waiver? Should I take the risk?

Hello, In our experience, it is a good idea to travel in these circumstances. Doing so may allow you to see your grandmother and also “cure” the prior unlawful entry, which will enable you to adjust status in the USA upon your return, without a waiver. @@viola3868 Hey, so I went into the USCIS office for an in-person appointment and I was about to get it approved but they requested more information about my grandmother's condition. I was almost done with all the requirements to file my 601-a waiver so I just waited to avoid paying more money. My lawyer told me beforehand that if I get approved for advance parole to go for it, but on the way back I could get denied the entry. Honestly if you have DACA, have kids, are married to a US Citizen and you get approved go for it. Best of luck!

so I-131 Refugee travel documents as an approved asylum I do need to apply in person and not mail in as if applying for a green card? but to be in you need an appointment to enter the building?

Hello, While I have never worked on an emergency refugee travel document, I would guess that the process is generally the same as that for emergency advance parole. Generally USCIS does require appointments to visit their offices, but in true emergency situations, many field offices make exceptions to assist applicants in obtaining what they need to be able to travel quickly.

Hi there, Puerto Rico is considered US terrirtory, all you need is some kind of legal ID. I’m DACA and had been there few times. Is like flying to any other state. Good luck

Speedy, Puerto Rico is part of the United States so no you don’t need advanced parole. Same with US Virgin Islands. You DONT need any special permit.

Hello my wife is a daca recipient and she had a few people in her family pass away last year due to covid, including her grandmother and uncle she was very close with. would she be able to apply for advance parole so she could visit their Graves and possibly visit family she's not seen since childhood?

Hi, Jesse, I think this sounds like a strong humanitarian case for advance parole for your wife. I definitely think it is worth a try. It may not be possible to get an emergency-based advance parole under these circumstances, since the big events are already several months in the past. But I think it is worth applying for advance parole in this case. Best of luck to her!

Hello. The letter from the doctor, does it have really state that i need to be present for a surgery they have coming? Can it just say they need someone to be there? Does it really need to say i need to be there? Sounds confusing

Hi, Jorge, It is not an explicit requirement that a particular individual be requested for assistance - but it is helpful for the documentation in support of your request to indicate as clearly as possible the reason for the need to travel on an emergency basis.

The emergency advance parole is different from the advance parole that you request when you apply for adjustment of status.

I understand Vanessa! In our experience, if you have documentation of your emergency, they will see you. However, policies may vary from office to office. Where are you located?

I was able to call and speak to a tier 2 agent and I’m awaiting a call back for an appointment for emergency advance parole, should I still try to go in person or wait for USCIS to call me back with appointment. My emergency is my grandfather passed away

@@vanessacuevas7659, I think it is worth a try to go ahead and go. The appointments can take weeks to get and you have nothing to lose by trying! If you can get a copy of your grandfather's death certificate, that would be best. I'm so sorry for your loss, also. :(

Hello, We are not aware of any differences between points of entry. As long as your advance parole is valid and you don’t have complexities in your case pertaining to criminal or immigration court matters, any point of entry should be ok. Any traveler who has an arrest history would be well-served to speak directly with an attorney prior to travelling.

Hi Jennifer, First of all thanks a lot for this very useful video. I want to know if is possible or what can happen if you ask for advanced parole to your home country and from there you fly to another country (without listing it in your AP) you get back to the motherland and then fly back to US. Can you get into very serious troubles?

@@franciscosanchez8229 Hello, Francisco, That is a great question. I would likely advise against third country travel while on advance parole, though I do not believe it’s technically illegal from the USA’s perspective. For example, if a Mexican citizen travelled to Cuba, that would not be illegal as Mexico does not prohibit travel to Cuba for its citizens. However, the USA does prohibit most citizens’ travel to Cuba, so it would likely be frowned upon at best for an AP recipient to go there. I suppose the answer to this question would vary by individual and depend on the circumstances involved, but in general I would recommend against trying it unless there were extremely compelling reasons to do it. I hope that helps!

Hello, Madhav, Unfortunately, TPS is only available to individuals who are inside the United States. In order to re-enter the country, you would need to apply for and be granted a visa.

Hello, Gilberto, This is an important question to discuss directly with an attorney familiar with the case. We have often seen DACA recipients with removal orders travel successfully using advance parole. However, this must be managed carefully to avoid problems upon return.

Hello, In our experience, individuals who receive DACA and DACA Advance Parole can travel even if they have past immigration violations or complications in their case. However, it is always a good idea to have an attorney review your case carefully to assess risks if you have any complications in your immigration history.

Hello, Susana, Technically, that should not be a problem since Alaska is part of the USA. Getting a direct flight (one that doesn’t need to stop/change planes in Canada) would reduce the chance of complications. Best of luck!

Hello, we cannot guarantee that any application would be approved, but in general, it is permissible to apply for and receive advance parole more than one time.

Hi My husband is on L1 visa and I am on L2 visa which is valid for more 2 years . -We have applied for adjustment of status i-485 in November 2022. -we have also applied for i-131 in November 2022 which I am still waiting for . -Biometric was done in Jan 2023. - now due to medical emergency i need to travel to India so should I apply for urgent advance parole or can I travel on my valid L2 visa ?? I do not want my GC application to be abundant 🙏

Hello, In this situation, our recommendation would be to travel to the nearest USCIS field office with the receipts for your filed I-485 and completed biometrics, as well as documentation of the emergency, and ask them to help you with an emergency advance parole document. In our experience, many USCIS offices will accommodate this kind of request for true emergencies. We would not recommend traveling on the L2 while the I-131 remains pending. Hello, Yarin, Yes, a 30-day permit for travel is fairly common. Advance parole is limited in that way, unfortunately.

That is common for people going through the adjustment of status process. You should not have a problem re-entering so long as you don't have pending criminal issues inside the USA and don't commit any crimes while outside the USA.

Hi Jennifer; thank you for this info! My maternal grandma passed in December 2020, but I couldn’t travel due to high risk pregnancy. My grandpa just passed August 2021, very close together. It happened so quick, that my family out there didn’t get a chance to request a doctors letter. They buried him the same day, 😔 so no time for me to even make it. Plus my baby was 2 months, I didn’t want to risk traveling with him so small. Can I still request advance parole to go visit my aunts, cousins, godmother and father? What do I need? It’s been a month since my grandpas passing..not sure if this is still can be possible. Thank you!

Hi, Fabiola, First, I’m so sorry to hear about the loss of your grandparents. You can definitely still request advance parole, though you may not be able to get a same-day document if there’s not a really urgent need to travel right away. What we would do for a client in your situation is send Form I-131 to USCIS with the filing fee, and include a letter of explanation from the client as well as a copy of grandparents’ death certificates. We might also include letters of invitation from remaining relatives in Mexico, and if possible, some kind of documentation showing where your grandparents are buried (this would not be mandatory, but would not be a bad idea to include). I hope that helps!

Now, my job is requiring me to travel to visit one of my customers abroad, they are located in Mexico, one of the first meetings is in early December, that is very soon, my job is now approving visitations to customers again. What proof do I need to provide to USCIS? Can I take advantage of this to also try to visit my family and my grandparents graves? Should I provide paperwork for both or should I focus only on my job approval for now?

@@Its_Fabi_G Hi, Fabiola, The processing times for DACA advance parole can be several months long, and our local USCIS office does not process emergency requests for business-related advance parole applications. If you have a family-based request that could form the basis of visiting the same country, there is no harm in providing both reasons for needing to travel. In fact, if there is a reasonable basis for requesting an emergency advance parole to visit family, you can do that - even if you also use the permission to travel to visit business associates during your trip. So long as the information you provide to USCIS is true and correct, there is no problem.
