Estelle Griswold and Dr. C. Lee Buxton open a clinic where they give advice and resources to married couples in order to help them avoid getting pregnant. They also prescribed contraceptives, or birth control, for married women. Well this got them in trouble. Local authorities arrested them for breaking a law that prohibited anyone from using “any drug, medicinal article, or instrument for the purpose of preventing conception.” Yep, Connecticut straight up banned using birth control. With the help of P.T. Barnum apparently, the state passed the law way back in 1879.
Well Griswold and Buxton, as well as many others, thought the law banning birth control was wrong. After they were found guilty for breaking it and fined $100 each, they appealed to the Appellate Division of the Circuit Court. Griswold and Buxton argued that banning birth control went against the 14th Amendment of the U.S. Constitution.
Well the Appellate Division of the Circuit Court disagreed, and upheld their conviction, so Griswold and Buxton appealed again, this time to the Connecticut Supreme Court, who...uh...yeah...also upheld it. So Griswold and Buxton appealed again, this time to the U.S. Supreme Court.
The Supreme Court agreed to hear arguments on March 29 and 30, 1965. The lawyer representing Griswold and Buxton was Catherine Roraback, who claimed that the birth control ban violated the right to marital privacy guaranteed by the Bill of Rights. Now, the word “privacy” does not appear anywhere in the Constitution. However, there was that sneaky Ninth Amendment, which essentially said that there were other rights we all had not specifically listed in the Constitution.
On June 7, 1965, the Court announced they had sided with Griswold. It was 7-2. And guess what? They brought up the Ninth Amendment. They also brought up that the right to privacy was inherent in the First, Third, Fourth, and Fifth Amendments, and said the Due Process Clause of the 14th Amendment should be applied to incorporate Bill of Rights protections to the states.

Here man, but remember this, opposition to the SCOTUS is strong and mounting. Every pro-choice ballot initiative has won since the decision, even in conservative states. Great video! Potter Stewart had a classic line in his dissent saying the law was "uncommonly silly", which has been cited by future justices to explain how the constitution doesn't always protect from silly laws.

Being an international student (India -> Iowa) in the US and not knowing in detail about its history (short but interesting due to the democratic roots which is helping the world). I agree with the verdict, as an outsider the American court system seems so sporadic and politically charged but then again there is no way to remove political bias from judges. Honestly it's so much more entertaining to see American supereme court cases because of the amount of arguments and discussions that go on among the judges and among the lawyer.

Yeah it has always been a political branch of government. However, I tend to respect the Supreme Court more due to their generally deep knowledge of the law and the fact that they don't ever have to worry about getting elected.

@@OpinionesDeJACCsOpinions I think American labor law has very little influence Brazilian labour law, so we don't end up hearing a lot about those cases here. But our Supreme Court very often applies the American doctrines on civil rights and criminal law.

However, I do know other federations took notes and based many of their constitutions at least partially from the U.S. Constitution. Basically all the parts that just make sense!

@@iammrbeat For those times that it has been used with respect to social movements, it's caused massive divide amongst the American people (I'm looking right at Roe v Wade) even to this day. I'm not so sure that making every right implicitly a constitutional right is a good thing.

@@Romulus1001 Well, the concept of there being rights not explicitly mentioned is sound. The real issue is widespread disagreement over some of which rights should and shouldn't be implicitly allowed by the 9th Amendment. However, the only way to fix that is to spell out every single right and how they should interact with other rights, but that's a fool's errand and why we need the 9th Amendment in the first place. Also, don't forget that the 9th Amendment can also be used in favor of the Federal Government. For example, the Constitution doesn't explicitly allow the Government to buy land, but here we are with the Louisiana Purchase, Florida, the Gadsden Purchase, Alaska, etc.

@Compucles yes and the purpose of stating that via the 9th amendment isn't so that it gives license to anyone to claim it as an implied constitutional right thereby circumventing and nullifying the amendment provision built into the constitution, though that is how it's been used in the last 80 years. Rights can be passed via statute at the state level and federal level if it compels the people to make them via convincing debate. If it can't get passed as a law, then it's evident that there isn't enough support for it politically. And if it gets passed and it turns out to be bad law, then they can just as easily repeal it.

@@Romulus1001 Like I said, it would be a fool's errand to try and brute force every single needed right in every situation into Constitutional or Federal Law. It just isn't possible to do things that way, especially when some rights conflict with other rights in certain situations.

I actually wrote a concurring argument in one of my law classes. I hated the reasoning in the case. I don't think the word "woman" is mentioned a single time. In the reasoning you can definitely spot signs of the time.
