HOW COME ?? This woman can be married without being married.
In fact, milkul yamin is a contract or ownership relationship between a master and a slave or servant, whether the slave is obtained from war, from a purchase, or because of other ownership that is justified by the Shari'a.
So with this contract or relationship, a female slave owner is allowed to have intimate relations with her female slave with several conditions.
With milk al-yamin, a master can have intimate relations with his female slave, who is then called a sariyah, without holding a marriage contract. In fact, if he carries out a marriage contract, then the marriage contract is invalid.
This does not mean that the master is having sex without a contract or a loose bond of mutual consent. In fact, what permits the relationship itself is the property contract, which fiqh scholars say has a stronger status than the marriage contract. Because the milkul yamin contract, apart from giving birth to benefits rights, also gives birth to rights to intimate relations.
