The IRS has to follow the law and the Constitution, just like any other Collection Agency. The IRS doesn't make law. Congress writes the laws of the United States, and in this instance, tax laws. The gentleman in this video is mistaken. Every American is protected under the 5th Amendment to the United States Constitution, which says that no person shall be deprived of life, liberty, without due process of law. If you are owed money by an employer, or have your money in a bank, the bank does not have legal authority to give your money to a 3rd party WITHOUT a Court Order. In order for that to happen, you would have to be sued. The IRS is no different. Neither banks nor employers have to comply with IRS demands. Now if a Court makes an order, that is a different story. But what happens in practice is that the IRS sends 6331 Notice of Levy to an employer or bank, and the employer or bank assumes that they have to do what the IRS is demanding. However, the IRS is "banking" on the Employer or bank to not read the law of 26 USC 6331 on the back of the Notice of Levy document. The IRS INTENTIONALLY omits paragraph (a) of 6331. Let's look at what it says. Then we will know why the IRS omits it from it's form. 26 USC 6331- Levy and Destraint (a)Authority of Secretary If any person liable to pay any tax neglects or refuses to pay the same within 10 days after notice and demand, it shall be lawful for the Secretary to collect such tax (and such further sum as shall be sufficient to cover the expenses of the levy) by levy upon all property and rights to property (except such property as is exempt under section 6334) belonging to such person or on which there is a lien provided in this chapter for the payment of such tax. Levy may be made upon the accrued salary or wages of any officer, employee, or elected official, of the United States, the District of Columbia, or any agency or instrumentality of the United States or the District of Columbia, by serving a notice of levy on the EMPLOYER (as defined in section 3401(d)) of such officer, employee, or elected official. If the Secretary makes a finding that the collection of such tax is in jeopardy, notice and demand for immediate payment of such tax may be made by the Secretary and, upon failure or refusal to pay such tax, collection thereof by levy shall be lawful without regard to the 10-day period provided in this section. The part of this section regarding levying salaries or wages is critical to understand. The key word in this section is Employee, as defined in section 3401 (d). You must know what the definition of Employer is to determine if you fit the definition of Employer. Let's look at that definition. 26 USC 3401(d)Employer For purposes of this chapter, the term “employer” means the person for whom an individual performs or performed any service, of whatever nature, as the EMPLOYEE of such person... Well, clearly the definition of Employer in that section is contingent on the definition of "EMPLOYEE." So what is the definition of "employee" in 26 USC 3401? Here it is: 26 USC 3401 (c)Employee For purposes of this chapter, the term “employee” includes an officer, employee, or elected official of the United States, a State, or any political subdivision thereof, or the District of Columbia, or any agency or instrumentality of any one or more of the foregoing. The term “employee” also includes an officer of a corporation. So there you go! In order for one to be the EMPLOYER as defined in the above section, the person performing any service for the employer must be an EMPLOYEE. An Employee is defined as an officer, employee, or elected official of the United States, a State, or the District of Columbia. 99% of Americans do not fit the description of Employee in this definition! That means that when the IRS sends these Notices of Levy's to businesses demanding money, these businesses do not fit the definition of Employer! Now you can see why the IRS OMITS section 6331 a from the Notice of Levy! They don't want businesses to realize that the Notice of Levy does NOT apply to their employees earnings! They don't want the businesses to read and realize that they are NOT the Employer that is defined in that code section! So yes, that means that 99% of Notice of Levy's sent to Employers all through the United States are fraudulent and bogus. The businesses that receive these have no obligation to do what the IRS demands. The IRS is NOT the law. They are an administrative agency. The IRS has to go to court just like everyone else and prove to a court of law that someone owes money. The IRS will not do that. But because American businesses are ignorant of the law, the IRS doesn't have to. The IRS depends on ignorance of the American people to violate our rights and money.

Local allowance For transportation is $629… but I spend $386.. operating cost 225, the standard national allowance for rent is $1,672 but I pay $642 , I also make below minimum wage, I've did the numbers and all of this equates to over 20,000 a year, that's the cost of living! I don't even make that in two years my net gross is always under $10,000 aside from last year. In your expert opinion how likely am I to get an OIC approval, if I offer $500? And it's clear I can't afford anything is , because it will cause financial hardship, and this else my first time! Will they wipe debt and settle? also will the IRS garnish my wages? It's no way I can survive if they do that I would literally die!
