Next time you get a patent for something. You bring a video camera and 2 witnesses. Lawyers can't be trusted they will screw you over for everything you got. And make up a price in their head after you sign something.

I am now corresponding w/ 2 companies to manufacture..for one part of the invention to be constructed it is $1900 for 1-100 parts...the part that has be made through injection molding... the guy said it would cost $10,000 for a production part..the invention is a special hair brush, its looking like i have to get the handle done in one place and bristle insertion in another..

GET AN ATTORNEY THAT WILL WORK ON A contingency FEE. You only pay if they win. They will fight hard for you because if they don't win they get NOTHING in fee's. Get a large well known attorney that has the funds to fight this. Even if you pay them 1/3 that is better than nothing and this bad attorney get NOTHING, OR MAYBE SOME JAIL TIME.
YOU ARE WRONG. I just hired an Attorney that worked on a contingency fee and I was very disappointed. Most of those Contingency Attorneys are looking for a quick and easy payout. They don't give a damn about getting a person 'justice'. The first settlement amount that is thrown out there by the other side they want you to take it. My case was an employment law case. The company hired a big time law firm to represent them. My lawyer worked for himself as a solo practitioner. When the company low balled us I knew he would try to jump ship. Even his agreement stipulated he was only hired to 'negotiate' a settlement and not 'litigate'. My suspicions were true. He called me and suddenly my 'very strong case' lacked strength and he was pushing me to settle with the companies first offer. He simply wanted his slice of the pie and to move on. A good friend of mine had the same thing happen to him. His Contingency lawyer was on hard times financially and even though he had a strong case the lawyer didn't want to fight it. He wanted a quick payout and pushed him to take the first offer. The contracts are even written that if you turn down an offer the Attorney could still put you on the hook to pay him for what 'WAS' offered. So you cannot win technically.

This is so sad and sick. To sign a power of attorney without having knowledge of it's potential can be truly a "game ender". For the elder McCluskey to render the case meritless is more than "conflicting interest". The saddest part to all this skulduggery is the fact that the small time hobby inventor is at a bigger disadvantage with the change in patent laws regarding first to invent...12 months to file...etc. There is no "best" way to protect your work if someone you trust commits fraud and deceptive practice. I believe you have a case against the attorney but it will be difficult because of the involved expense and a commission based attorney likes the easy cut-and-dry type. A familiar case of the inventor of the intermittent wiper for cars was won by a man who sued ,I believe,Chrysler Motors. He was awarded millions. Don't give up and please, keep inventing...don't let this consume you. You're better than that.
Thommy Two Toes Times Three I pd a company to file my provisional. They ask me to sign power of attorney. I told them not w/o the application enclosed. That was my audit trail. All well. The expense of doin non-provisional w a company was too high so I taught myself to finish it. It's a tough business and a lonely place till the idea goes big.
I was involved at the "tail-end" in a patent lawsuit that went on for 17 years!!!! (the life of the patent). The company I was with sued the infringing company for $17 billion +/-. We finally were awarded about $50 million. As a result, I'm a firm believer in "trade secrets" They don't have a "shelf life". And, there is no filing with the patent office. So, its not available for any and everyone to see.

The guy still has a lot of remedies. He could simply make his invention and sell it in stores and dire the other people on the patent to sue him. But, he has to do a better job explaining what happened. He's all over the place.
a little after the fact now but have you considered contacting the state bar association and reporting both your former attorney and his father who should have, theoretically, recused himself from any decisions regarding family. We've sent out cease and desist letters to the eleven airlines who the invention has been leased out to and one to the main culprit. I had this happen to me in Virginia. Inventhelp who stole my invention and sold it to a lady. My attorney worked with the inventhelp company. Does anybody know a legit attorney? .I have other inventions that I have held on tight because I am afraid of sharing.

I really don't know how to help you, but I think if you could prove that the power of attorney was signed under fraudulent and deceitful circumstances (which, if you've brought suit against him and his license prior I would imagine most judges would see the conflict of interests), you could then sue for patent infringement and hopefully get that SOB locked up! If that fails, the courts might convict, but I don't think a man alive would fault you for collecting that debt in blood. Stay strong brother

I'm curious about my idea now. I had INVENTHELP disassociate themselves with me after I paid all my fees. I have never trusted the government because I've always seen corruption in small companies alone. This is why I will never have full faith in government... NEVER!
is it true people copy patent ideas, they just change it in some way that is not exactly the same thing, ex= two bottle openers one with a different design to the other can be copied?
Best bet is join local Inventors Club or Association and meet people that have gone through hoops. Your avg joeshmo does not have the know how to go from idea-prototype-product-manufacturing-to market or let alone have the enormous funding to start their own company to produce their idea into reality. If you don't file a patent what recourse do you have if wrong doing does occur, then system labels you as a fool that didn't protect his/her idea. I think if you patent and then quickly license your idea you have some chance of earning royalties, but be aware of companies that blow smoke up your ass who claim they will help you license for large fees but no results in the end.
When I saw no product on the market for my idea, I've been prototyping with 3D printers and paranoid as all hell to take the next steps because of intellectual theft. Sorry you're dealing with that, man.

What kills me, a person goes in a gas station steals a candy bar can be put in handcuffs and carry to jail but an attorney or one of these people steals a million dollar idea and it gets proven in court they just get popped on the hand and have to pay a fine. In the mean time, try doing a "POOR MAN'S COPY". Create an 3D Print Image of it, take a picture & or video with it and its Logo, then email the image/video to yourself or mail a packaged copy to yourself, or perhaps put it in a safe storage unit or all of thee above. :-D And by the way, in a case like this, you can always prove the real ownership of your products by its dates.
