Yes, its harder to prove in court if you didn't walk out of the store but if you had the intent to steal and it is obvious, then youre still going to face charges. I know because I worked at a convience store before and whenever someone tried stealing beer, our security guards would tackle them before they left the store and cops would arrest them. Ofcoursr a good lawyer can always weasal their way out of anything these days. The court system is all about having money. If you have money, you'll be okay

I think it's to hold out longer until trial or until she gets offered a plea deal (if she does). They might ask her to plead guilty & in exchange they'll lessen her charges. That's usually why most obviously guilty people plea not guilty, not because they think they have a chance to beat the case.
