In case of Minor (like your daughter) what are the steps of acquiring Indian passport & Citizenship if she moves or intends to move to India as a minor. Say at 5-6 years age if an OCI card holder wants to surrender Canadian passport and acquire Indian passport, what are the steps and eligibility criteria?
Hii ! I’m a South African citizen by birth, moved back permanently to India in 1997 when I was 11 months old. My parents are Indian, also I’m not registered as an overseas citizen. I’m 27 years old and I do have my updated South African ID and passport. How can I get Indian citizenship? And how much time it will take? Also never went back to Africa in past 26years.
Hi first step for Indian citizenship is to get OCI. Once you are registered as an OCI for 5 years and is residing in India for 1 year out of the above 5 years, you become eligible to apply for Indian Citizenship which can take another 3 years approx if all goes well. Hope this helps
So in your case if you apply now and get OCI you need to wait for 5 years even if you are residing permanently in India and you can initiate after 5 years and then another 3 year’s turnaround.
Excellent. You have provided details of regaining Indian citizenship in brief.. can you just let know how long time it takes after registration of application.?
Thank Raj, since renouncing citizenship is s involved it varies country to country. From India stand point the entire process is approx 1 year excludes the delay of other country
My mother is British Protected person passport holder. I applied for her British Citizenship but they want a letter from Indian authorities that she is not and never was a citizen of india nor an oci holder and has never applied for it. I applied for it at high commission of India fro Tanzania but they said they are not allowed to issue such a letter according to citizenship act 1955. What should I do now ?
Indian HC will do as per guidelines. If you have anything in writing from HC you may give letter of explanation with notary and copy of comments from HC.. In Canada it is accepted
@@canadatriedandtestedoriginal They are asking me to tell them under which section they can issue the letter I told them under section 13 of the Indian citizenship act 1955 but they are refusing. They are under diplomatic immunity so I can't take them to court in Tanzania.
Hi there Thanks for ur videos they r very informative So I got a query regarding this I am an Irish citizen with an oci card since 6years and the last 5 years I have been in India , now I want to become an Indian citizen , can u please tell me the time frame for this and the processing time for Ireland thanks you
Hi Bhargav, in your case based on the input you can initiate the process anytime now. The India documentation process you can expect (it’s my guess work atleast between 2-3 years, it can even be shorter) and then renouncing Irish citizenship timeframe will depend on Ireland processing time. Like in Canada it could take up to 1 year and in US individual have to physically meet before renouncing. There after you can expect 2-3 months to get with India passport etc. Hope this helps. Congratulations and happy to see you take this decision. All the best
Not sure if you got chance to see the description, please check the timestamp. The timeline is country specific, Indian cycle takes about 1 year time however the country where renouncing citizenship might have different timeline which will impact the overall timeline. I have given specific details in video which might help you. Thank you for asking the question
Hi Gopi, First of all, many thanks for such an informative video. we are going to have a baby soon and most probably next year we will be permanently going back to India (I am currently having canadian closed work permit). Now I have 4 questions-- 1. how to register the baby as Indian citizen by descendant? I heard within 12 months of birth we need to register the same. 2. I don't want that after going back to India he/she will be facing so many restrictions as discussed in your video. How to solve that? 3. If I register the child as Indian citizen by descendant then can he/she get Indian passport from canada only? 4. Suppose I am travelling to India post his/her birth and then coming back again to Canada so I need to raise any canadian visa for him/her or canadian birth certificate will suffice. Really sorry in advance if I ask any silly question here.. I am totally confused regarding this. Please also guide me the suitable path based on my situation. Thanks a lot....Eagerly waiting for your reply..
Now India does not recognize dual citizenship however Canada does so when you apply for India citizenship for your baby you will have to give declaration to GOI that the baby will not hold any other passport. You can do your due diligence to find more info. Since baby is born in Canada, Canada will still consider as Canadian citizen only thing you won’t have is Canadian passport. When the baby turns 18 years old he/she will have choice to take up Canadian passport and in this case go through the India citizenship surrender process as I have made the video. Congratulations for good times ahead
sir, in your case you will have to continuously stay in India for one year before you can initiate citizenship process however it might take 3-4 years as a process to get everything done Including surrendering your Australia passport and getting India passport if everything sails through.
Can you please let us know what is the timeline from application to getting the indian passport ? An avg timeline even though it will differ slightly case by cases
Hi Girish I am yet to know exact timeline. Once you complete the formalities and have documents in hand I guess it should be normal timeline i.e. 2-3 week
Sir, can a minor child 16yrs of age will be able to apply for indian passport. The child born in india and acquired Canadian passport after birth. Will she be eligible to apply before 18yrs.please reply. Thank you
Hi here is the clause, Where a person ceases to be a citizen of India under sub- section (1) every minor child of that person shall thereupon cease to be a citizen of India. Any such child may, within one year after attaining full age, make a declaration (in the prescribed form and manner) that he wishes to resume Indian citizenship and shall thereupon again become a citizen of India. The best would be to write to MEA asking for details. Please keep me posted as others will be following on this
hi, its a nice informative video. thank you. i am from Bangladesh and have fullfilled the requiremet for the application criteria. my question is 1. how much time will it take from the application process to get the naturalization certificate? 2. after submitting my application will be i able to travel back to my home country (Bangladesh) untill my application is accepted?
Hi Simon, do you already have OCI card? If yes my estimate is that if you fulfill the criteria it will be about 8-10 years from the time earlier till getting India passport. It could take longer if agencies feel they need more details. Regarding the point 2, by logic taking short business trip shouldn’t be a problem but long absence will. As when you are taking citizenship you have intention to stay(by logic)
Just to reconfirm. My baby is born in Canada in 2023 so if I want to renounce Canadian citizenship and get Indian citizenship for the baby keep in view that both the parents are still Indian citizen but are in Canada on a PR is it possible. I had also visited the Indian embassy in Toronto and they are saying that you can renounce the Canadian citizenship for the baby and first apply for Indian DOB certificate and once its approved by MHA then you can apply for Indian passport. However, on the other hand IRCC official website and customer service says that you cannot renounce the citizenship for a minor in Canada. If you apply your application will be rejected. Then on what ground Indian consulate is saying that you can get Indian citizenship for a baby born in Canada.
Hi please check the government website. I am not sure but Bangladesh and Pakistan has some restrictions when it comes to OCI. Link is in the description
Namaskara sir, I am from Bangalore and staying in Canada. As everyone is forcing me towards getting a Canadian passport, I am totally confused. I am eligible to get Canadian citizenship and have plans to go back to India soon after getting citizenship. Is there any advantage or disadvantage of having Canadian passport but staying in India? Dhanyavadagalu 🙏
Hi it’s a difficult question to answer. I will share what I have researched. 1. With OCI card you will be just like Indian citizen except voting rights and government offices and buying agricultural land. When buying property if there are any tax subsidies given to Indian you might be at disadvantage(not a big factor though) 2. With Canadian passport you will have travel flexibility to many countries and you can come to Canada anytime you wish. 3. With regards to taxation as a resident I suggest having conversations with a good consultant to know about the impact especially when selling properties 4. When you go visit any touristy locations you might end up paying more on entry fee if asked for ID 5. Health insurance in India is something you will have to check. How the premiums impact If you ask me there is no advantage or disadvantage. It’s what you want and what you don’t want. Many who are accustomed to newer things of life coming out of India find difficult to adjust and that has been one of the reason people say not to leave the option you have. If you want to become Indian citizen again, in my research it’s a 10 year turnaround time approx. I have shared the video too Hope this helps
Hi the minimum requirement is to have OCI for 5 years and also a period of stay of 2 years before you can initiate and thereafter it’s at-least another 3-5 years process till you get India passport in your hand provided everything is correct
Hello sir, i have one question can children age 17 who had oci card and whos mother is indian citizenship can apply for indian passport? And that child has born in india but went to germany after birth. Can you please guide me sir
Hi there India does not allow dual citizenship even if Germany allows. For minor when they turn 18 years they should have option to choose the country of citizenship citizenship. The child will still go through the requirements. I have shared all details in the description. The India passport is issued only after surrender of foreign nationality and passport. Hope this helps
@canadatriedandtestedoriginal thank you for your response. But child is already german citizens but they want to live in india permanently. So can they apply for Indian citizenship as there mother is Indian citizen. Sorry to disturb you sir. But can you please guide
@deepahmedabadi1560 Hi in this case best is to apply for OCI ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-pxX0AqlTiHY.htmlsi=ot9Zq7hshELlpWbP. The child can forever stay in India without any additional requirements and after meeting eligibility can apply for citizenship
@canadatriedandtestedoriginal oh thank so much for your support sir. Just to inform you the child already has OCI. once gain thank you for your support and guidance sir . God bless you
@deepahmedabadi1560 with OCI the child has all the freedom including getting Aadhar once the stay is more than 6 months. When it comes to schooling too fees remains same
Hi Im from iran …was student in india more than 11 years So I wana know is there any chance for me to get Indian citizenship …? Please can you advise me …?
Hi Vishwas, first step will be to get OCI ru-vid.com/video/%D0%B2%D0%B8%D0%B4%D0%B5%D0%BE-K78GTnxG7R0.html and then complete the first requirement of stay in India. Once you have prerequisite as per straight line it should take 7 years however I anticipate at least 10 years
Hi did your parents have Indian citizenship? India does not give citizenship by birth for foreign nationals (parents who are foreign nationals and were in India)
@@canadatriedandtestedoriginal no sir my mom is a sri lankan and my dad is US immigrant citizen (before he was a Sri lankan citizen) but I was born and lived for 18 years in India, and had my schooling life in India ,but now I'm in sri lanka for 2 years ,I badly miss India 🥲🗿. So,I know the basic laws to acquire citizenship but I guess I can get the citizenship by naturalization, right?
@virtuosowolf4560 Hi I have limited knowledge here so would suggest write to Consulate of India in your place. They might be able to give some idea. I too will probe and share if I have anything to share
I m having a problem as I had received a British passport which they issued to us in error, n took back an made us stateless as I was a minor at that time in 2008, till date I m not getting clear pictures of my letters from home department as practical we have been applying right from 2014 till date but no letters have been send to us, as I m been deprived of my futher studies which incorrect, so I applied for my indian passport back again an still they say the I have to get a letter from home department in which the delay is from their end
Hi I am not fully getting what happened. Did you not get India citizenship as your parents by mistake applied for British citizenship and you got UK passport?
Hi Im from iran …was student in india more than 11 years So I wana know is there any chance for me to get oci and Indian citizenship …? Please can you advise me …?
Hi, there are multiple criteria on government website. Getting OCI is in my opinion the smoothest process as everything is clear from start like how once you have PR of Australia you have clarity that just following steps will ensure citizenship. Thank you for asking the question
Hi. I am not an expert however the shortest possible time I could see is being OCI for 5 years and the remaining process dependancy guess is anywhere between 8-10 years at least. Adnan Sami has gone through the process and so is Akshay Kumar so it will be interesting to know their timelines
Thanks for the video, very useful information. I've applied for citizenship as an OCI card holder on the website and submitted the documents to the District Collector's office as well and the status on the citizenship website was updated to "Application received" a few days after submitting the documents. It's been 2 weeks since then, can you please provide information on the next steps after that? Thanks.
Hi it’s a holiday season now, expect delays. Government system now a days is working like well oiled machine. You will hear from them on start of process soon. Is there a way I can stay connected with you.
