First of all, this the best video that I've seen so far with regards to purchasing a property as a foreigner in Kenya. Its so detailed, you explain things more like a property attorney. Here are my questions, 1. If I own a flat in one of those high-rise apartments, does that mean I will have to pay a monthly taxe on the land? 2. Let's say I buy a flat as a foreigner, I don't get a citizenship, how can I legally stay in my house in Kenya? In order words, do I get some sort of residency as long as I own and live in my flat?

You won't pay monthly tax on the apartment unless you are earning rent from it. In that case, it becomes rental income so you pay rental income tax. The only thing you have to pay to the residence management is monthly service charge for maintenance of common areas. To stay in your house, get a visitor's visa (6 Months) or certain permits and keep renewing them once they approach expiry date.

As a foreigner, how can your kids inherit your property if you can only own it for 99 years?

Your children will inherit the property and have to apply for the lease renewal or extension once they get the expiry notice. The notice comes from NLC 5 years before the expiry.

So as a foreigner, you cant on property lease hold land is different than free hold land that they sale to their citizens, but you're paying the same money

Thanks good the good videos. I would really like an explanation of what is the precise definition of "rural land". I will be taking a short trip to Kenya next year to look at land and a place to rent while building, but the truth is the prices of land and property in major cities such as Nairobi are too high. I have my mind set on looking for land in Kiambu county. Thanks again sister, really good videos.

I'd like to see a video on foreigners buying flats from the big developers in order to sell them for profit. For example, buy a 3 bedroom apartment in a completed high rise building, hold for a few months, then sell it. I guess this will depend on how much the value of such properties appreciates in Kenya

That's a business that investors do, normally you book a unit when the project starts normally at discounted prices. The prices keep increasing and by the time the project is over, you'll have made extra millions. You wait until the developer's units are sold out and when there's scarcity and demand, you sell off your unit.

@@jackysellshomes Paying in advance makes sense if the building will be completed within the stated period, usually a year is a reasonable time frame. In Nigeria, they'll lie to you that it's going to be completed in a few months. Come back 2 years later and they're still on the project. And we're talking about a 3 story building with just 6 apartments. Exactly why I'm eyeing properties in Kenya

So many stupid rules. No way Kenya is number one country for foreigners with so many dumb rules. I've been to Rwanda, it's much better than Kenya. I'm sure Siuth Africa is as well.

Annual land rent and lease differs from one county government to another. One had to check with the land office in the county where you buy the property.

So I buy a property on lease, I have to pay rent as well?? So who actually owns it? The person I'm buying from? Can they decide to sell since they own it? So many dumb rules. What about apartments? How does that work?

Yes, annual rent is paid to the government as a revenue. Note that land in towns and cities is issued to both Kenyan Citizens and Foreigners on a leasehold basis! Meaning you are leasing it from the government. Anyone who buys such land has to pay rent during the lease period. It doesn't matter if you are a Kenyan or Foreigner, the rent has to be paid.

@@jackysellshomes It sounds more like property tax which you find in most Western nations. I guess the yearly leasehold fee will have to be no more than 1% or a little more, because it's a property tax

If a Black American relocates to Kenya, buys a home, marries a Kenyan, and dies some years later, does the surviving Kenyan spouse and perhaps children get the home or lose it when the lease expires??

The Kenyan wife has to transfer and register the land ownership in their name. If the land is leasehold she'll have to apply for renewal or extension of the lease after getting a notice from National Land Control about the expiration of the lease term. The notice is given 5 years before expiration hence she should take action immediately as the renewal of lease is a process! If the expiry date passes, the land ownership is reverted to the government of Kenya.
