Yes. The IRA owner can be the Manager!! Just not too much work and certainly can't be compensated!

Is it standard practice that the custodian mandates what bank the IRA funds are held in?

Well....tricky question. Yes, in the sense that the IRA Custodian has a relationship with a bank for ALL of it's deposits. HOWEVER, once you set up your IRA/LLC (of which you are the manager), you can set up the LLC bank account (holding your IRA funds) anywhere you want. They cannot dictate that. 90% of my clients set up an IRA/LLC to better control, lower their costs, and have quicker access to funds for deals.

Shamus, yes you can. Section 408 of the Internal Revenue Code allows for the purchase of property with funds held in many common forms of IRAs, including a Traditional IRA, a Roth IRA, and a simplified employee pension (SEP) IRA.

if the REI is owned by your IRA, is the IRA open to lawsuits? Do you recommend opening up a second LLC for the property that is owned by the IRA LLC?

You can have as many IRAs as you want, but you're still bound to the $6,000 per year limit. That's not $6,000 in each IRA, that's $6,000 TOTAL, spread across all of your IRAs.

Right, you can annually contribute to either a Standard or Roth IRA or to both, but, the total contribution is currently $6,000. Also, if you have a an employer where you can contribute to a 401k, you can contribute $19,500 a year into the 401k. If you leave an employer, the 401k typically will be converted to a Traditional IRA.

Yes....but NOTHING like a stock broker. Most have a $200 - $400 flat fee, or a fee based on the number of assets, or account value. Shop around. Our favorite is www.directedira.com. Thanks!

Not a fan of the IRA for real estate. Your tax losses are an issue. I disagree with you on that part. Real estate is a great investment but not necessarily in your IRA you have tax deferral in the IRA so if you have a loss, you miss out on it. You also miss out on capital gains favored rates.

If you buy a vacation rental condo in Hawaii thru your Self Directed IRA can you stay in it a week or a month out of the year? I'm trying to decide on a condo in Hawaii or a Colorado long term rental (so we are close enough to manage - no physical work ourselves understood). I am also a realtor, your video says use another agent but in reviewing the comments here I get the idea this might be a "gray area"? Thank you !!!

The regulations for putting real estate in a retirement account are oppressive, ensuring that only people who have lots of extra money can do it. If you own rental property in a retirement account and your tenant doesn't pay the rent, or if your property is vacant then you have to pay the equivalent rent to your own retirement account. Here's something that would make a lot of sense and would benefit millions of people even if they didn't want rental property. If you have a retirement fund with enough money, use it to pay off your mortgage. Then you could pay the equivalent of your mortgage payment into your retirement fund. The only problem is, it's illegal to do this.

I have a sd401k w/cc and have been doing private money lending to "house flippers", making 12% annually. I've been crunching numbers on "fancy" excel spread sheets trying to determine if the best method to grow my wealth is to: 1. continue doing PML making 12%, or 2. purchase rentals w/ NR loans and enjoy monthly cash flow, plus appreciation, plus depreciation, plus having tax deductions for repair & mntc. Have you any opinions or insight on what you have witnessed with regards to this? Which scenario, generally speaking, would most likely have the best outcome?

Beyond IRA contribution to LLC, is it okay to have investors to invest money into my LLC? I assume it would come down to the % of equity as long as taxes are concerned. But can I have foreign investors to invest in the LLC? Would they be able to use that as a vehicle to get investor visas? Sounds pretty complicated but from your explanation, it seems like a possible route to grow LLC at a much faster rate. What do you suggest?

Yes... you can have non IRA partners in the LLC...even foreign investors. Now there are sometimes some tax treaties involved. But we have been doing this for years...AND affordably. My associate attorney that is excellent on structuring the LLC with the IRA/401k options...and...with foreign investors is Kristie Parker. You can call and schedule a 1 hour consult with her and the cost is applied to setting up the LLC (under $1500 or even less). We're really affordable. You can even do a free 15min with her to just see what were about (but the advice comes with the consult). :) Please call 435-586-9366 and make an appointment. No....but kinda...we have a work around. What you do is roll out each of your 401ks to your individual IRAs....THEN we set-up an LLC (which is typical anyway when you self-direct). The LLC is owned by the two IRAs proportionally and you and your husband are the managers of the LLC. It's pretty slick. Been doing it for years. Sounds like you would benefit from an IRA/LLC AKA a "Checkbook IRA". My firm, KKOS Lawyers, can set it up for you. Directed IRA has a whole page dedicated to them, and you can get started right there, by opening a new account online, and then you will be sent to KKOS to set up the LLC. Mark, if I live in Ca, but I want to buy multifamily in Texas, does it complicate management of an LLC if 50% of down payment comes from me as an individual and the other 50% comes from my self directed Roth? I don’t have enough in my Roth for a down payment to buy multifamily property solely in my Roth. Oh, and the other question, why would I have to register (in Calif.) my Texas LLC holding property in Texas?

hey mark this might be a dumb question but are you able to buy commercial real estate, let's say an apartment complex with the funds in your roth IRA, is the rental income earned from the property tax free? To my understanding profits from investments contained in a roth IRA are able to be kept and not taxed? any information on this is greatly appreciated.

Only thing I don’t like is you can’t work on the properties yourself. That’s how I save the most money doing my own work on rentals. So, it’s best for me to not do this route
