It is very important that people read their CP 575G when completing their W-9. For example, some may have wording as such: "This EIN will identify you, your business accounts, tax returns, and documents, even if you have no employees. Please keep this notice in your permanent records. When filing tax documents, payments, and related correspondence, it is very important that you use your EIN and complete name and address exactly as shown above. Any variation may cause a delay in processing, result in incorrect information in your account, or even cause you to be assigned more than one EIN." And this: "IMPORTANT REMINDERS: * Keep a copy of this notice in your permanent records. This notice is issued only one time and the IRS will not be able to generate a duplicate copy for you. You may give a copy of this document to anyone asking for proof of your EIN. * Use this EIN and your name exactly as they appear at the top of this notice on all your federal tax forms. * Refer to this EIN on your tax-related correspondence and documents."

Hello. Thank you for the video. I was under the impression that you use your EIN when you are setting up a W9 for 1099 purposes for LLC, even if it's a single member. I set my business acct. up with the EIN (as required) as well. Is there never a time that I would use the EIN as single member LLC? Essentially, the EIN could only be used if I have employees or am a multi-member LLC or S-Corp? I am bit confused on that. A couple other videos mentioned to use the EIN. The EIN is used to file employee forms... as a single member LLC, the business' identification number is the members SS... honestly, it's not the biggest deal either way, it's not going to have any impact but the instructions do specify to use SS as explained in the video

I understand the instructions say put your ss# b ut i'd prefer to not be sending it random one off clients. What's the worst thing that would happen if I just use my LLC EIN# on my W9? Putting your SSN on 1099s for contractors that you have hired is not very smart. This does not make sense that the IRS would tell a SMLLC they must use their personal SSN on all 1099s and essentially give out their personal SSN to multiple people. I don’t know about this🧐🤔
Nice job - but what about an LLC, taxed as an S Corp that is "single member". I submit a corp tax return and the k-1 flows to my personal return. The w-9 is confusing because you could check "S Corp" or you could check single member LLC and then add "S" for taxed as an S Corp. Please update your video to include this!
This was a very well put together video. I am wondering though about another situation: I have an LLC that is electing to be an S corp which owns an LLC. The LLC which is owned by the S corp is the one I am filling out the W9 for. I cannot find any information online on how to fill out this W9.

So from what I can understand from the IRS's expanded instructions, you could apply for a EIN as an individual and enter that in the Part 1 EIN box if you are filling as "Scenario #1" a single member LLC. That would allow you to avoid sending your personal SSN to everyone who asks for a W9. Don't think that was covered in the video but would you say that is correct?

I'm confused because the form says, "If you are a single-member LLC that is disregarded as an entity separate from its owner, enter the owner’s SSN (or EIN, if the owner has one). Do not enter the disregarded entity’s EIN." It sounds like you can apply for an EIN as an individual and use that number but not your LLC's EIN.

Hi, I am a single member LLC, but I elected to be taxed as an S- Corp. I received the confirmation letter from the IRS where my choice was accepted. I am looking at your video but I am not sure how to fill out the W-9 when they request it from me. Everyone tells me different. I have a social and an EIN, but sometimes I hire contractors as well, so should I use my EIN or my SSN. Nope. They might ask for it but what they are asking for is your business number - as a LLC without employees your business number is your social security number. They usually will request your state business number, which is rarely used but every state gives you one with your LLC. Often they will look it up for you because it's public knowledge. A bank account is not a reason to get an EIN from the IRS standpoint either.

I wouldn't do anything different until you are actually ready to hire someone. The only thing you really need to do is apply for an EIN, which you can do online and it gives you your number instantly. I recommend using GUSTO! to pay your employees. Check out my videos by searching "employee" ....

But what about when you go to open up a bank account as a single member LLC? They usually require an EIN. So if you open up the bank account with the EIN but you do the W-9 with your SSN, wouldn't that be an issue?
They can't require an EIN... but the person your talking to might not know that - ask for a manager and say you talked to a lawyer, your business ID is SS..... they'll do it.
i am being asked to fill out a w-9 form by lawyers who are handling my wealthy aunts estate - she didnt have a will. i dont really understand why i'm being asked to fill one out, i dont have a business. is it because i'm essentially hiring them to handle the estate?
W-9 is a request for taxpayer information - so that you can't say, "hay you used my incorrect address or name." They are going to issue you payments (I would presume), so they are going to file you a 1099-misc. This form reports a lot more than just self-employment. I wouldn't worry about it. Probably a good thing!

You just fill out the W-9. If you have an LLC, list your LLC. If not, just list your personal name and any business name that you've filed with the state (any name you operate under should be filed with the state). What are the other forms? You should only really be filling out a W-9, unless you are required to have insurance or state requirements

I dont feel comfortable giving people my SSN due to fraud. Plus most small businesses don't have the best controls in place. I am a single memeber LLC. Would it cause any issues if I used my EIN instead of my SSN?
No, but keep in mind (and hopefully to calm your fears!) you are never held responsible for fraud!!! Use common sense, but I don't worry about this type of thing at all. Anyone could access our SS numbers online, but 99.9% of people aren't online financial fraudsters...

Yes, you would need an EIN for a partnership because there has to be 2+ people in a partnership and so there's no unique Social Security number to use. Instead, you must use an EIN
Employees? Doesn't matter how much an employee gets paid, they are treated like an employee. You only need to file a 1099-misc for a contractor who you paid at least $600 during the year.
