sadly it is only a creative glitch, unless you know someone with one of these skins, then you cannot copy the skin in game. unless you eliminate someone w the skin in game

No its not bannable. And you do not lose the skin if you deal or take any amount of damage. As long as you stay alive then you keep the skin .
