How would you setup a will or trust to not allow your wife to pass anything to her child from previous marriage but I want to make sure she is provided for till her death but it ends with her and give my assests to future child if I have any later with her or if not pass it to my other family members at her death .I just dont want my stepchildren to get anything from me at all mainly my home I own before I married my wife.
I'm trying to learn the ins and outs I have at least 10 niece and nephews in total one in particular I see as my child he's basically considered my son he has been around us since he was 2 months of age he's now almost a preteen and I'm getting very serious about making sure he is well taken care of if something was to happened to me unexpected or with old age things happen and it's bound to happen so I want to make sure he's okay he's been through a rough existence of all his nine years of living and I don't want to leave none of the money to his mother nor his father and the only relative I could possibly trust is my sister but that's nither hear or there so I'm trying to figure out how can he possibly directly obtain the funds by 18 or if needed before hand?
Can you set up a Trust for a minor beneficiary in the Last Will and still avoid the application of the Transfer to Minor Act? Will the probate judge (who will appoint the guardian pursuant to the Last Will) keep his hands off the Trust created for the minor?
