There is brand name and logo, they are two different things and you can trademark either or both. To keep things simple, it's normally best to trademark just the brand name. This is all you need to sell that brand on Amazon.
I'm not looking to set up a trademark name just but need some guidance about searching , my question is if I put in, say, a football team e.g. Liverpool in the government search engine and it comes up registered, then you put in Liverpool Legends or similar and it is not registered is this then ok to use and also band names if they are not registered can you use them . Hi , thank you so much for doing this video say for example you want to protect the name but in the near future you want it under a limited company could you later change it only because the brand does not make enough money but you would like to protect the name. Hope that makes sense 🥺.
Yep, you can change ownership in the future! Or even easier, just keep the ownership under your name and make your LTD company the "trademark representative".
Hi Luca. The process seems to be very easy. However... I can register a business name and logo. his will give me protection within chosen category. However what if I will have also a slogan, which I would like to protect? Will this be included or I have to by copyrigths protection from third party companies just for this purpose?
where it says " apply to register a trade mark" 7.15. could you put Techlabs, teclabscompany, teclabsltd, teclabs clothing ect... in the same box to cover diffrent branches
Nope! Just one single trademark word / phrase per application. If you want multiple trademarks as you have described, each one will need it's own application
Hi Luca, this a very informative video. However, there is just one thing that concerns me which you maybe able to clarify for me. Under Owner Type, I intend to use my trademark for my limited company which I have not registered yet since I do not want any issues with HMRC and taxes, therefore would it be advisable if I register under my personal name if so would I then be able to transfer is to my limited company when it has been registered ?

Great video. I'm looking to trademark my company name but i would need the funds (Royalties) to go into a new and different bank account. Do i register the trademark on the new company that I'm looking to open up and effectively send royalties to that new company, or Trademark my active company now and still open a new company account and send royalties to that new company called the same, and trademark that new company? I have a couple of questions: a) If you registered brand as ‘Text’ only, and later you added image or logo, would Amazon allow you to use this on your products as you only register text version. b) If you registered your Brand as Image / logo, can you change the font colours of it on your product and on Amazon - would Amazon allow you this. Glad you found it helpful! A) Yes that's fine and what most people do. You register a text / wordmark trademark and then use that word in logo form on your product. Just make sure the font/design is easily readable by Amazon. B) No you can't, that's why I always recommend registered a text / wordmark trademark
Thank you, it helps a great deal as I was unsure about designing the logo colours now at the registration stage as I don’t know what product box colours would look like & if I designed the logo colours now, these may not go with the future box design. Therefore the answer in (a) would work perfect as I can get the text registered now & later design logo with image etc reflecting the exact registered text.
Thanks Luca! Great video and helpful! If your class are: 6,9,14 and other Brand is 9,20,30,40. You check and discover that the class 9 is same to that Brand. You cannot register you brand because 1 single class is similar?
So basically, if the earlier mark is in the same Class as yours, and is registered under similar goods (Class 9 is quite expansive so it's not always the case), then yes if the examiner feels that your mark is similar enough then they would be contacted. Now if you have multiple classes, you can remove the Class or the certain good/service inside the Class that is clashing if you do not want the other side to be contacted of your mark. Different Classes can also clash with each other so it's also useful to have a look at the IPO's similar Class list (www.gov.uk/government/publications/searching-for-similar-trade-mark-goodsservices-in-other-classes/trade-mark-cross-search-list#class-9). For example, if you have 'digital books' which is in Class 9 and someone with a similar trade mark to yours has 'books' which is in Class 16, they may also be notified depending on how similar the marks are. Now one thing to keep in mind is that you can always remove whatever is clashing to avoid opposition from the other side unless your mark does not have any non-clashing goods/services.

If I do a trademark search and I find a company with the same name who is also registered under the same class, ie. Class 9, but don't list the same things within that class that I would be looking to sell or work with, example: They list "Blowtorches, equipment for securing trussing in construction", where I would be selling "musical sound recordings"? ; 2. If I find that the other company who shares the same name not only are registered in the same class, but also sell the same things, however the businesses are completely different, example: Class 25, where they are also selling clothing but have a different logo and are in a completely different field of business ie; Home Renovations vs Music? Great vid! I’ve noticed on a search I’ve just done that some same name entries (in categories I don’t want) are “registered” or “dead” (case sensitive varies). This brings me a question, if trademark lasts 10 years and shows as registered in 2007 - if it was renewed surely it would show “dead”. There are dead and registered ones for 2007. That would suggest to me that one was renewed I.e now showing registered, and one is showing dead both for 2007. But if it lasts for 10 years and it’s valid - is it the initial registration that occurred in 2007 and still valid now? If you can do a video on examples of registered and dead with date examples that would be good! My trademark name is available in the categories I want but thought I’d bag the others if they’re free. Very helpful but I am still struggling about choosing multiple classes which I can't find any RU-vidrs talked about. I found some in different languages and countries but none for British. It so frustrating!
Thank you for your explanation which is really useful. If the applicant wants to file trademark application directly in UK do they have to digitally sign the applicant. Like in India we need to digitally sign and submit the application.
So basically if my brand is named "Mike" and there is a brand with the same name and catrgory can I just rename it and register it under it "Mike sports" for example?
That should be fine but the other brand can always contest it and say its too similar to theirs. It's down to the discretion of the IPO and not always black and white.

Amazon says that you can't but many of my students have managed to, so it's definitely worth trying. Worst case, they reject the application and you just try again once the TM is fully registered

Could choosing too many products within a class, such as the case with jewelry under class 14 (like choker necklaces, beaded necklaces, etc.), potentially result in a rejection? Thanks for the video! If I sell gift hampers including candles, chocolate, face masks etc. (not made by me but wholesale products) will I have to include all of these different classes (which gets more expensive) or can I just choose "Hampers" as one class?
Hi Luca - great video 👌 what if the name you have is almost the same except for very slight punctuation? For example if I wanted to register 'bakers corner' but 'baker's corner' is TM'd? And the 2 logos are completely different?
If you’re planning on filing a trademark in the same class, then it will likely be rejected unfortunately. You can always speak to a trademark agency / lawyer though as they may be able to advise better
Great video mate, if I wanted to register a trademark but theres already one similar for example theirs is Blissful Clothing but I wanted just Blissful. There will be one class that will be the same but I will have additional ones. What will be the likelihood of mine being accepted?
