if you still have your stolen device under your iCloud they have no way to get in. SO if you want them to have a new phone then you take the device off your iCloud. If you don't, they have no way in getting in without your iCloud.

Doesn’t work if the previous user linked the phone and tried to locate it. It requires the original user set up account to activate it.
