Lets go over how you can register your beats through the US government and use that copyright to then setup a BMI account and register that "works" to collect royalty payments.

Create a BMI or ASCAP account:

Steps:
1. Copyright your beats
2. Create a works number for the beats
3. Give this works number to your clients for each track
4. BMI / ASCAP will handle payouts to you and your client

BMI and ASCAP only collect royalties on performances of the song copyright. There is also a sound recording copyright which needs to be protected.

Correct, may I also add, both companies also collect royalties in terms if your track is also played through radio/airplay and or streaming/digital press which then means you would need to have an ISRC code when registering the track so that BMI and ASCAP can follow up each time the so g gets played, that code will trigger and your royalties will be collected

how would someone get the ISRC code? searched online and saw one needs to be affiliated with an IFPI company, is that accurate? I already have tunecore, so i would need BMI/ASCAP plus this IFPI company?

BMI and ASCAP don’t collect digital royalties though so I think you also need to sign up for the Harry fox agency to collect steaming royalties. Sound recording copyright I don’t k ow about that so hopefully someone will inform me.

@@4Paczjkor BMI and ASCAP do collect streaming royalties (Spotify etc). Harry Fox agency collects mechanical and sync royalties (film, TV shows). SoundExchange collects digital radio royalties (Pandora, Sirius FM etc). Sound recording copyright protects you in a possible future legal case but does not collect royalties on its own.

It's not that easy unfortunately because in order to file a lawsuit for copyright infringement you have to have copyright your work. You automatically are guaranteed rights under the copyright law the minute you decide your composition is finished, but it's hard to prove in court it belongs to you when it isn't registered properly.

Registering your copyrights is not required. Registering your beats with the PROs is also not required if they are not publicly performed on their own. But you are right, the only way I know of is to tell your customers to add your info to their songs registration with their own PROs

I remember doing this by paper and mail back in the day. It took years for the copyright office to catch up. Glad to see it’s gotten more commission. I used to be with BMI. But I didn’t like the idea of them getting a cut. How can writers get. Their own publishing and monitor the use of their music?

88Beats I really appreciate the reply. I appreciate the content you’re sharing altogether. Turns out I’m still with BMI. I was still able to log in last night lol. The contract has a perpetuity clause. I’ve been under contract since 2011. Ok I realize it’s to my benefit to be established with a PRO. But my catalogue has sat there for 7 years. No royalties. How can I get with a publisher that will really push my music? Can I work with different publishers? -Some who have connections in tv -another with connections in film -another who has influence in the hip hop industry -a publisher who specializes in overseas markets... Being on BMI isn’t doing anything. I don’t have the connections. How do I link with publishers who will put in the work to get us paid? I have an archive of music.

Keith Harris II A Pro's job is to collect money on your behalf and pay it to you. Not the other stuff you mentioned. That is the job of the music publisher. Like another comment said: "U need to promote your music." Otherwise no one will hear it.

Thanks for the helpful information! I haven't started any process making my music available to be "used" yet. I have a catalog of recorded material over quite a few years now. I have wondered just how hard it would be to put it out there for any potential recognition or profit. Thanks for making it easy to understand the process.

Great video. I won't even work with an artist if they're not BMI registered. Another avenue I use to sell beats is releasing my kits as a cpmpilation, then release it through a third-party distributor so the tracks go through moderation. I use Routenote, they're great with the overall process as far as legally protecting your rights...and getting your money.

For a situation like designer and menace,....in the contract u can negotiate it to where if it breaks the top billboard , the artist has to re negotiate the deal or sease use of that beat. Once it hits the top billboard the label will be more than willing to go back and pay a little more. I think menace talked about it in a couple interviews

Thanks man! btw if anyone is an Australian producer, the cheapest way I've found to get a work id number for your beats is to upload them through distrokid, register with APRA AMCOS (might take a while to get verified but don't let up), copy the generated ISRC code from your beats and add them into your list of APRA registered songs. The system should then give you a work Id.

When the writer copywiters the lyrics, the producer name doesn't get listed as an author. The producer has to copywrite the beat separate from the lyrics. Royalty splits are discussed after the beat and lyrics are copywritten. Pa forms for the song. SR forms for the actual mastered CD that's being reproduced for sale. Hope that helps✌🏻✌🏻

Get your beats coded. Get isrc and upc codes embedded in your beats Then once you register your beat with bmi,ascap whomever you're a member with this secures tracking of beats. Theses days artist feel they don't have to pay the producer and can run off with the beat and become rich and don't pay the producer, composer of beats.

When you say 3-4% for the producer about royalties, what is the part for the rapper? It seems unbalanced..

If it is an indie rapper he gets the remaining. Hed pay you based off the contract, easier when a label works the deal. Usually a signed artist gets 10% cut, 4% to producer/ composer, label and other people involved get remaining etc.

Lowkey if your a beat maker you should make your own songs. On top of just selling the beats. Sell some but def keep some to yourself and record your own tracks. I see more and more why Pierre did that

I don’t do the 20 beats for 25$ because it’s a matter of quality vs. quantity!! Lots of those so called producers who do that are selling filler beats with no value!

No because you sold your rights exclusively. If it's leased or u don't get paid up front then u can't get royalties on the back end

You can sell exclusive and still remain copyright owner of your music. Alot of ways of righting that contract. Exclusive just means you are not going to use that beat for other works, the royalty can be negotiated. A work for hire beat is a different horse.

People try not to use Publishing Companies, because then that's half your money gone right there. When you write and self-publish, it's all you. HOWEVER, one must consider... if you Self-Publish but then you aren't with BMI, you didn't Sound Exchange, you didn't Song Trust, and maybe you even Distributed yourself... well, who is getting those Royalties for you? You. And if you aren't collecting, then you're getting 0% of what ever you should be making. You're just lost in the sauce. I STILL strongly suggest Self Publishing (through a Distributor)... but you got to get educated and find out who you need to ally with, who you need to pay even in some cases, to go get your money for you. Because the fact is, we really can't just go around ourselves tracking and collecting these. And if you can, then you need to upscale that and be the next BMI/Sound Exchange/Song Trust and make that real money. LMAO! Self Publishing opens up the opportunity to fully realizing your potential profits... but if your Publishing Company handles EVERYTHING and collects every cent out there, it may well be worth that split. Got to think deep on it, make your own decisions.

I've been getting ready to do exactly this. I havent leased anything. I havent sold anything. I'm in the process of trying to get an artist I'm working with to release his music with me. This particular song is over a existing beat. From a hit song that I got the instrumental for. What's that process look like through BMI? Do I gotta reach out to Jayden smith to release a song over a beat from him or... that seems crazy.

Ryan Nielsen not with BMI, unless its being performed and spun on radio. If you are using a existing instrumental you need to buy synchronization rights to that beat.

What if a label is reaching out to you for your beats what do I do ? The problem is my beat is not copyrighted and don't want them stealing so it's best to protect my work at all cost.

This is a great vid but the only thing I’m confused on is I am a producer so when trying to collect royalties from your publishing company are u registering the BEAT or the SONG with the artist to the beat u produced.. and also if so the song is moving doing good etc and the composer has a publishing company but the artist doesn’t have can the producer still get paid (these questions ppl wanna know & me personally)

ThisisLoudbeats so you upload your beats while artist upload their finished song, and they can search your name etc. Royalties from publishing companies are usually paid quarterly when you sign a contract / deal for a song they will request your W9 and all other payment info. Same with TV and performing etc. BMI cuts you a check quarterly.

If you copyright beats in a bundle, how does BMI track them in the market when they're registered individually? By copyrighting in a bundle, does each track maintain its own identity, or is copyright just protecting the intellectual property itself, and BMI handles the individual use business?

Yo dude your website doesn't have SSL cert which is gonna make google re-direct people away and say your site isnt secure. Most people buy them on Go-Daddy or w/e but there are plugins that will get you an SSL cert in like 5 minutes for free. i had an experience with a Battle Rap website, they owned a site for producers to sell beats,.. what they would do is, allow their artists,.. to use the beats for free that you're selling,.. for freestyles and battles.. on the other site.. the Parent company,..which i felt was..stealing what could be profit, it's bootlegging.. now, they're not making any money off of it.. but whats the point of uploading there if they are working around in a loophole type of fashion..?.. i can sue right?

Who should own the copyrights to the song (master audio recording) though? The producer, the artist, the recording studio or record label. Would this be stated in the contract for who owns the masters?

Relativ Beats producer owns the production, the artist owns the master. So don’t worry, if an artist steals your beat and raps over it you can sue if they have no proof of purchasing the track. When you Register on Ascap it pretty much locks it down and you can register 0 royalties if the beat is being leased and sold for exclusive rights so if issues arise you have proof that’s your song.

@@Therealsamso youtube is a performance. audio streaming isnt. spotify etc is a machanical royalty (audiam etc) Pros cover just admin side. to find ur music on utube or others copying music. i think. its fkn confusing
