So, I tuned in to this so I could find out how to write a provisional patent. I was sold a book and a software program. I'm fine with that, but that is not what it is listed as in the title. You did not explain HOW to write a provisional patent... Am I wrong?

I know what you mean. His information is very good though, it takes the fear out of it and does provide excellent conceptual guidance. Yes you are wrong for he did explain, but maybe not in detail as you expected. I mean he told you to write out a description in such a way where as all the variations of it are included. So companies can't work around it.

This video is a sales pitch.The thing is, you really do have helpful products. Started on my first PPA, and yes, I'm feeling daunted. I want to do it on my own, but I've read, and watched videos, and have found a lot of confusing information. Smart IP might be the thing that breaks through it all, so that I can feel confident about the result.

I am glad I came across your videos about PPA, Mr Stephen. Great videos that honest and forthright. Should I submit a provisional patent even though what I am building is made from parts of other tools and various stock appliances bought from hardware stores? Do I need to do a prior art search before even filing a provisional patent application or should I get in touch with a patent attorney or agent, before I do any of these? Should I pay legalzoom to submit a PPA for me?

I’d like to know how to patent when finding new uses for previously patented products? While I have at least two improvements ( points of difference) , it is still very close to another patented product, but the application would be in a completely different category.

After applying for a PPA through USPTO, how long do you have to wait til you can go out and talk about it, try to sell it? In Romania it's 4 - 6 months, by our PTO's rules.

As a product design engineer and I can confirm that companies pay their hired guns to design around patents. Good companies in competitive markets understand the patent mine field in their market space and work toward innovating in the space between the mines (patents).

I bought the 4 hour work week then quickly learned that you were the actual mentor lol....so then I stopped reading 4 hour work week and bought your book Stephen asap and I finished it quickly!!!…now I’m in the process of wanting to join the class you offer because I really want this to work. Single mom... Trying too stay afloat....my ideas has come from the needs of being a mother that would life easier & less time more efficient way of doing things when needed done. I have done my research there is nothing that has came up like what I wish was around... A few ideas has come up through experience with ways to stop Drs from loosing their licenses at the same time protecting the patient from abusing what they ate prescribed...another idea came from being pregnant... & a way I wanted to lay but was impossible because there wasn't anything like it... I did manage to improvise that helped. With the things I have came up with. I talked to others see what they thought / they agreed it was something they would get or do..... But they were friends & family that I pitched it too.... So they could have just been polite. STAY-SAFE & Thankyou I really want to get my idea out there they can help / even benifit others. Any advice is APPRECIATED....

@ inventRightTV ... I've heard it said that to be patentable, an invention cannot be disclosed prior to patent submission. But the USA switched from First to invent to First to patent back in 2012 (ish) ... which presumably means that things already in the public domain CAN be patented ? And I think that at the time of switching, that the US was the last remaining country with FTI patent laws ?

Hi expert Stephen Is there a rule covering how reference numbers need to be narrated in the detailed description? I mean, is there a rule to follow where when describing the invention, reference numbers being mentioned must be mentioned in ascending order only? For eg. Can we describe in this way : Car 100 comprises an engine 120 and a carriage 110. Or is it that we must write it this way : Car 100 comprises a carriage 110 and an engine 120? Must the numbers be mentioned in ascending order only?

Here is an idea to increase viewership to your channel: I like to share a common problem faced by newbies drafting the descriptions. It is about the Interpretation of a rule related to patent drawings : 37 C.F.R. 1.84 : (4) The same part of an invention appearing in more than one view of the drawing must always be designated by the same reference character, and the same reference character must never be used to designate different parts. Question : 1. Is the View and Drawing mentioned referring to one angle of looking at one particular embodiment drawing or does it mean any and every view for all drawings , views of all embodiments within the detailed description? 1. Some have interpreted the rule to mean that exactly the same part of a particular embodiment must be referenced using exactly the same reference number within the description for that particular embodiment. So, different numbers can be used to reference the same part with some differences in form in different embodiments. For example, one number range per embodiment. And I can find such granted patents. 2. Others , which appears to be the majority, interpreted it to mean the same part must be referred to using exactly the same reference number and by View it means views across all embodiments. There are also such granted patents . Where the rule is creating confusion: 1. It uses the word drawing. What is drawing ? One drawing ? If one drawing, it can mean just one embodiment. Or does it mean every drawing? If the word DrawingS is used, it could mean views of all embodiments. 2. What is meant by a View? A view of one embodiment or views across all embodiments? 3. I see the problem originates from the fact that English allows for different interpretations no matter how clearly it is written. And the Best Practices supersede possible alternative literally valid interpretations. So it depends ultimately on the judge and then the federal judge. Why is there no clarity? What is the best practice?

But how do you go about trying to figure out WHY a filed application never got to market. In other words, if you see your idea has been already invented, how can you figure out WHY it didn't get to market?

Since PPAs expire after 12 months, and the USPTO does not look into it, can we reapply? I imagine we can if there was a minor 'tweek'? Is there any fine print we ought to be aware of? Please advise. Love your channel! Can an LLC file for the PPA and are there any disadvantages to doing this? I plan to approach the different companies using the LLC since when I get the royalties, I want the royalties to be paid to the LLC.

I have a question- First off great videos guys ive watched them all! If the company has an online idea submission form but states they will only review an idea if it has a utility patent, does that mean you are out of luck with no patent? Would you bother still sending in your idea (with a PPA) in that case? Thanks!

Can i publish my idea after filing provisional patent without infringing any of qualifying criteria to file final patent?

Hi, there seems to be a lack of or no video teaching about the patenting of a Process. Specifically, I am interested in processes excluding programming. I am not sure what are all the processes that are considered as patentable Pocesses

This is very helpful. I have two questions! 1. A provisional can be cheaper if you're a small entity or micro entity, but I've read in the requirements, in order to qualify as those smaller entities, you have income and employees less than a certain number AND cannot license or sell it to a larger entity. If you can't sell or license it to a larger entity, that takes a way a TON of purpose in planning. IS this true and how do I be a small business and still license to a big business? 2. Suppose it costs me $65.00 to apply for the provisional, but I want to add multiple drawings to cover planned variations of the invention... does it cost money PER image when filing the provisional? Or can I add 10 images at once and just pay the $65.00? PLEASE let me know, these two questions are important and I can't find an answer to these specific questions. Thanks for the great videos.

@Breakerbox Studios... I know this is 3 years later, but nobody answered your question. Also, I'm not a lawyer and this isn't legal advice, but I'd never heard what you mentioned so I looked into it. I think you're misunderstanding a part of the wording. See www.uspto.gov/patents/laws/micro-entity-status the last bullet under (1) Gross Income Basis heading. I think what they're saying is that if you are already under an obligation to license to a large company, you'd need to pay the large company fees. This won't happen to you, as a small inventor, you'll be filing your PPA before you shop around your sell sheet. So at that time, you didn't assign anyone the patent rights nor are you under obligation to assign or license it to them. IF you get a company interested in your idea, at InventRight they teach you to try to get the first licensor to pay for the full non-provisional patent (but you're still always assigned the rights!), then it would no longer be micro-entity fees when you file the NPPA, but it doesn't really matter since they are picking up the tab anyway. In other words, you'd categorize into micro-entity status when filing the PPA, but into some other status when filing the NPPA, but not paying the bill and having a signed licensing deal at that point.

I am only interested in how to license a patent. I would rather license it to a manfacturer already in the industry to develop the product. How can I get help with the documentation?

My question is: I want my idea protected BEFORE I go to the engineer/artist who can figure out how to make my idea reality. If I have to include the design IN the provisional patent, what keeps the designer from stealing my idea?

so i looked up the website to get the patent however its not the same logo you showed on your screen here on this video and then when i clicked on it to pay it took me to watchdog and i no longer see your company name? am i missing somerthing

Lets say for instance I want to patent something in the USA and the examiner does an search, do they only search in USA or world wide. If someone already has a patent in lets say France but has no PCT or they haven't filed in USA does this mean my patent will or won't be granted in the USA. If for some reason I'm not granted the patent then it will be possible to still manufacture and sell the product in all the other countries where the original patent inventor didn't register in without having any legal ramifications.

No you have with in one year to file a non provisional patent.
