The people living in Sabah have two options to choose from; 1. They can relocate to Sarawak or return to peninsular Malaysia and retain their Malaysian citizenship, 2. They can remain in Sabah and be affiliated with the Sultanate of Sulu and choose Philippine citizenship.

Sultan of Brunei gave Sabah to Sultan of Sulu as a gift. British Co. leased Sabah and mistakenly hand it over to Malaysia. So check all the documents and facts! Sabah belongs to the Philippine!

Yet you're willing to forget that and praise him as a victim. You forgot about those filippinos that became his victims that he kidnapped and sold as slaves and never every seen they're family after being kidnapped by the pirate that you call Sultanate of Sulu.

To make specific... Sabah belongs to the Sultanate of Sulu and not the Philippines or Malaysia after the Philippines successfully claimed Sabah, for sure the Sultanates of Sulu and Other Claimants will then ask the Philippine government to get back again Sabah as it owned by them and declared as an independent state.

For what ever reason Sabah joined Malaya and became Malaysia. That already happened Sabah joined Malaya . Sabah was not given to Malaya. Malaysian Government did not neglect Sabahan. Malaysian Government built University, Schools, Government Hospitals, government clinics, roads, Mosque, several airports In Sabah, libraries and several Government offices. All these are for the Sabahan. Malaysian Government lend textbook for the Primary and Secondary pupils and the pupils no need to buy textbook every year. The Malaysian Government gave money to the Primary and Secondary pupils when they started schooling in the beginning of the year. It's to help the parents to buy school uniform, bags, exercise books, stationery etc . The Malaysian Government also help the people with some money to ease their burden every year. The government clinics and hospitals only take RM1 from the patient who come for checkup and take their medicine. The school pupils don't pay their school fee . The fee is free. That's Malaysia

SABAH(North Borneo) is not included in Malaysia it is part of Sultanate of Sulu (Philippines) ever since before they become independent from British. Like SINGAPORE is part of Malaysia and separated from Malaysia on 1965 while Sabah has distance of 1,011 miles from Kuala Lumpur but still they are claiming this part own by Sultanate of Sulu (Philippines). Meanwhile the distance of Sabah from Manila is only 683 miles.

The distance between a territory to the capital city of a country has nothing to do with it's sovereignty. There is an Indonesian island called Miangas which is 2,552 km from Jakarta and 1,177 km from Manila. That island is still part of Indonesia, not part of the Philippines.

How Malaysia (Malaya) formed without the knowledge of the Philippines & Indonesia: On 31 August 1963, North Borneo attained self-government. The idea for the formation of a union of the former British colonies, namely, Malaya, Singapore, Sarawak (Indonesia) and North Borneo (Philippines) was mooted as early as the late 19th century, but it was Tunku Abdul Rahman who officially announced the proposal of wider federation in May 1961. It also seemed that this idea was supported by the British.[40] There was a call for complete independence on that date by it was denied by the British Governor who remained in power until Malaysia Day.[41] In 1962, the Cobbold Commission was set up to determine whether the people of Sabah and Sarawak favoured the proposed union. The commission had found that the union was generally favoured by the people but wanted certain terms and conditions incorporated to safeguard the interest of the people. The commission had also noted some opposition from the people but decided that such opposition was minor (especially without knowledge of the Philippines & Indonesia) what was going on). The Commission published its report on 1 August 1962 and had made several recommendations. Unlike in Singapore, however, no referendum was ever conducted in Sabah.[42] Most ethnic community leaders of Sabah, namely, Mustapha representing the Muslims, Donald Stephens representing the non-Muslim natives, and Khoo Siak Chew representing the Chinese, would eventually support the formation. An agreement was signed by Tunku Abdul Rahman, Harold Macmillan, the British Prime Minister, and William Goode, the last Governor of North Borneo, signed on behalf of the territory on 1 August 1962 putting to paper the agreement to form the union. The intention had been to form Malaysia on 31 August 1963 but due to objections from the Philippines and Indonesia, the formation had to be postponed to 16 September 1963. At that point North Borneo, as Sabah, was united with Malaya, Sarawak and Singapore, to form Malaysia.[43][44] To safeguard the interest of North Borneo in the new federation, a 20-point agreement was entered into between the federal and the state government. Philippines claim on North Borneo based solely on historical and legal rights is very dubious without any evidence. First, Sultan Sulu claimed Sultan Brunei gave North Borneo to Sulu as a gift in assisting Brunei’s civil war is without any proof. Earliest historian like Sir Stamford Raffles (History of Java) in 1830 said it is only a claim. The agreement between Sultan Brunei and British North Borneo Company (BNBC) on 29 December 1877 which is 3 weeks earlier than the agreement between Sultan Sulu (22 January 1878) and BNBC show that North Borneo was still belongs to Brunei. The onus is on Philippines to proof it otherwise. Second, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement). On the same day, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the agreement (22 January 1878 agreement) between Sulu Sultanate and BNBC. The agreement between Sultan Sulu and BNBC on 22nd January 1878 is null and void. Thus, issues whether it is a rent or cession and translation either in English or Tausug is no more valid. On 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. The issue was later raised by Spain with the British Government. Finally, the issue on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. Again, on the 25th November 1957, the latter Sultanate of Sulu declared termination of the lease between Sulu and BNBC effective on 22 January 1958. Thus, the agreement is null and void twice. Third, there is no such agreement between Malaysia with the Sultan Sulu nor Philippines on renting and payment on North Borneo. The 22nd January 1878 agreement is only between Sultan Sulu and BNBC. Any dispute between parties need to refer to the Majesty’s Consul General in Brunei as stated in the agreement but there is nothing in the record. Earlier the British (before formation of Malaysia) also do not have such an agreement. You pay when there is an agreement. It was only a gift from Malaysia after the Manila Accord meeting 1963 as requested by Philippines Government to cool down the situation. That is why the amount is ridiculously small in Malaysian dollar and not Mexican Gold Dollar used during that era (1878). Surprisingly, on 12 February 1989, Sultan Mohammad Jamalul Kiram III revoked the resolution of 1962 regarding the transfer of title and sovereignty to the Republic of the Philippines. Thus Philippines is no more a legit claimant to Sabah. There is a court case in ICJ record pertaining to the Philippines claims to North Borneo. A special 37 page report by ICJ was published in 2001 and easily accessible from the ICJ official website. It was a trial within a trial in the court case between Malaysia and Indonesia on the ownership of the islands of Sipadan and Ligitan. During the trial, Philippines which is not a party to the trial requested permission to intervene. To comply to Article 62 of the Statute of Court, Philippines stated 3 objects for the intervention namely to safeguard and preserve Philippines historical and legal rights over North Borneo, to inform the court the affect or effect of the court outcomes on its claim to the territories and on the procedural issues in the court. After deliberation, the court found the first 2 objectives are appropriate. Later Philippines lawyers explained their case and provide documentation especially the Sulu-Ovenbeck 1878 agreement and related information to the court. On 23 October 2001, by 14 to 1 vote, the court rejected the Philippines request on the ground that there is no interest of legal nature. Notwithstanding the recognition by UN on the formation of Malaysia in 1963 and this ICJ decision, Philippines still continue pursuing the claim. It is of no issue and need not be entertained.

British North Borneo Company (BNBC) signed 2 agreements with the Sultan of Brunei and Sultan of Sulu on 29 December 1877 and 22 January 1878 over the territory of North Borneo respectively. Thus, Sulu claims on North Borneo was given by Brunei as a gift is unfounded. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC and Spanish government in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885. Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars has a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full. The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation.

The Philippines claims Sabah on the basis that Sabah was once under Sulu. Sulu only claimed that Sabah was under Sulu because Brunei gave Sabah to Sulu as a gift for purportedly helping Brunei fight rebels. But Brunei refuted this claim and denied ever having given Sabah to Sulu. There was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. You can claim and put any island around Philippines like Guam and even Hawaii in your constitution. But you cannot enforce it to other countries.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate. But what they will not revealed are those that can refute their claim. The followings are few of the information that had been kept secret: Firstly, the agreement between Sultan Brunei and BNBC on 29 December 1877 over North Borneo which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei. Secondly, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement). Thirdly, on the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void. Fourthly, on 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement. Fifthly, Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid. Sixthly, Finally, the issues on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol. The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation. In addition, during the US colonization of PH, 2 agreements (Carter 1899 and Carpenter 1915) were signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies. Later, the 1930 Anglo-US border agreement acknowledge the boundary delimitation between PH and North Borneo that belongs to the British.

The one who is stupid is YOU. The agreement between Sulu and NBCC was written in classical Malay (Malay is my mother tongue), in jawi script (Arabic alphabet). In the agreement the term "pajak" was used. The word " pajak" could mean "rent, tax, lease or cede" depending on the contact in the sentence. The word "pajak" was used together with the phrase "selama-lamanya" which meant "forever" and the phrase "selagi ada bulan dan bintang" which meant "as long as there are a moon and stars". So in this contact the term "pajak" meant "cede" or "cession". To clarify this further there was a supplementary agreement to the first agreement known as "confirmation of cession of certain islands" regarding the status of certain islands between Sabah and Sulu to be included in the "cession" agreement. In this supplementary agreement the term "pajak" was no longer used because it might lead to misunderstanding by later generation. Instead the term "menyerahkan" which meant "surrender" was used. And the annual payment was increased from 5000 dollars to 5300 dollars because of the additional islands were included.

The 1964 UN-sponsored Referendum favored the Federation of Malaysia as Sabahan voted for inclusion into the new state. Pres. Sukarno denounced the UN Referendum and declared Ganjang Malaysia! (Crush Malaysia!) The war was short-lived. The borders between Kalimantan and North Borneo were settled. Did the Philippines go to war? No. It went on the diplomatic offensive through Maphilindo, SEATO, and the UN, despite losing two islands in Davao Gulf to the Indonesians, and Sipadan island to the Malaysians. In the event, the Malaysians and the United Kingdom were unfazed. They stood their ground. Aside from the popular vote of Sabahans rejecting Philippine sovereignty through Referendum, it referred to an article in the Philippine Constitution banning the Sultanates of Mindanao and Sulu, aside from multiple claimants to the throne.. The Philipines never made an effort to abrogate the 1935 article on Royal titles. (Art 6. Sec 31) The only solution is for the Philippines to go to war. But on what grounds?

Moving forward : 1)Phillipines and Malaysia should respond in a peaceful way. Philippines and Malaysia will not be like a war torn Ukraine or Syria...We don't want war in this pandemic...we don't want fatherless homes... Answers to "Moving forward": 1. "... respond in a peaceful way". Yes, but in 2013 an armed group of Sulu people, the so called "Royal Sulu Security Force" made an incursion into Sabah and killed our policemen, was that called "a peaceful way". 2. "Sabah people need to choose...". They had already made their choice in 1963. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says: "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia". ".... dramatically changed because of this arbitration award...". Nothing will change because of the award because the latest about the award was: Latest as in June 2023: 1) June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate. 2) Dutch Court of Appeal had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling and dismissed an attempt to seize Malaysian Petronas assets following the Paris Court of Appeal decision. 3) Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost. 4) Mean while in Luxembourg a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision. 3. "... undocumented Filipinos in Sabah.... recognized as citizens of the Philippines". Yes, they should be given identification as citizens of the Philippines and should be deported back to the Philippines. 4. Officially it was called "cession money" not "lease". And Sabah will always be a component state of Malaysia as recognized by the UN. 5. "Malaysia needs to obey the laws....". Yes and everybody not only Malaysia needs to obey the laws including Sulu. Following the judgment above Sulu need to pay €100,000.00 to Malaysia as legal cost. It will increase all the more if keep on delaying.

BNBC agreed to enter a "pajak" agreement with Sulu after they were advised by their fellow businessmen in Hong Kong who advised that Sulu would attack them if they didn't have a deal with Sulu. This "pajak'' agreement was signed on 22 January 1878. BNBC understood that this "pajak" was a "cession", so did early generation of Sulu Sultan accepted it as "cession". Only later generation of descendants of former Sultan of Sulu claimed that the "pajak" agreement was meant to be "rent" or "lease''. Still there was NO DOCUMENT regarding the transfer of ownership of Sabah from Brunei to Sulu signed by both Sultans. The two above events led to an overlapping issue on Sabah. What ever it was, the above agreement and overlapping issue were superceded by later event. On 22 July 1878, the then Sultan of Sulu had relinquished all his possession and sovereignty of Sulu and it's territories including Sabah to Spain. The Sultanate of Sulu only remained as hereditary cultural and traditional entity without any sovereign territory. In 1885, to resolve overlapping issue on Sabah and other issues involving other islands, Britain, Spain and Germany arrived to an agreement known as Madrid Protocol in which Spain surrendered Sabah to Britain. As new owner of Sabah Britain had full control and sovereignty over Sabah and they could do what ever they wanted. Sulu could not claim anything because they had already relinquished the sovereignty of Sabah to Spain and Spain surrendered Sabah to Britain. What ever happened to Sabah after that was under British jurisdiction. Even though British had full control and sovereignty of Sabah, they still honoured the annual "cession money" payment stipulated in the "pajak'' agreement as consolation for the Sulu Sultan. So did Malaysia when formed in 1963, still honoured the annual "cession money" payment as consolation for the Sulu Sultan. The term "cession money" was used because to use the term "consolation" was felt to be too degrading. Thus the term "cession money" was continually used as used before by the British. Even the argument about the word "pajak" and it's meaning in the "pajak" agreement still favoured the British. The "pajak" agreement was written in classical Malay, in jawi script (Arabic alphabet). Malay is the national language of Malaysia and Brunei, and mother tongue of majority Malaysians and Brunei. In those days, Malay was also used by people of Sulu because Malay was the "lingua franca" of this region including the present Philippines. That was why the agreement was written in Malay. But over the years Sulu people had lost their Malay language (standard Malay) because of several reasons like colonisation by different European. This made Sulu relied on translation of the agreement. Things got worse when they translated it to Sulu's local language, be it Tagalog or Tausug, which was rather translation of another translation, that they translated it to their favour. The word "pajak" carried several meanings depending on the contact used in the sentence or passage. It could mean "tax, rent, pawn, lease, or cession". In the agreement between BNBC/ British and Sulu, the word "pajak" was used together with the phrase "selama-lamanya" which meant "forever". When "pajak" was used together with the phrase"selama-lamanya", in this contact the word "pajak" meant "cession". Cession means "the formal giving up of rights, property or territory by a state". When Sulu "pajak" Sabah to BNBC it meant Sulu ceded Sabah and it meant Sabah no longer belonged to Sulu. This was further clarified. There was a second agreement which was a supplementary to the first agreement known as "Confirmation of Cession of Certain Islands Agreement". It was regarding certain islands between Sabah and Sulu which they were not sure whether they were included in the first agreement or not. In this second agreement, the word "pajak" was no longer used because they thought it might lead to misunderstanding by later generation. Instead the word "menyerahkan" which meant "surrender" was used, and the annual payment was increased from 5,000 dollars to 5,300 dollars due to certain islands included. Another example where the Philippines generally or Sulu in particular misunderstood due to wrong translation or translation to their favour, was about the clause that the territory could not be transfered to another party. Yes, there was a clause that Sabah could not be transfered to another party "... without the consent of 'Duli Queen'...". The British translated "Duli Queen" as "Her Britannic Majesty", even though it was not correct literally but it was correct in the meaning. The "... Queen" was referring to Queen Victoria, the ruler of England / Britain at that time. But Sulu translated "Duli Queen" (or rather translated from a translation) as "Their Majesties' Government". This led to an understanding that "Duli Queen" was the ruler of Sulu. The question was since when Sulu as a Muslim state had a female as their ruler (Sultanah or Queen)? The above showed that North Borneo (Sabah) had indeed been ceded to Britain, that was why it could not be transfered to another party without the consent of 'Duli Queen' (Queen Victoria), the ruler of England/ Britain at that time. And further it was stated that any dispute about the agreement had to be referred to the "Consul General" being the Queen's representative in Borneo to be resolved. It meant that outside Arbitrator had no jurisdiction over the agreement. This fact became the main reason of judgement by Paris Court of Appeal in setting aside and annulling the Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate. On 31 August 1963 Britain gave independence to Sabah and before that on 22 July 1963 Sarawak was given independence. The people of Sabah and Sarawak had exercised self determination to form Malaysia together with Malaya and Singapore. The sovereignty of Sabah and Sarawak as component states of Malaysia is intact and recognized internationally and recognized by the UN. This was confirmed and clearly stated in the United Nations Malaysia Mission Report "Final Conclusion of the Secretary-General", 14 September 1963. The last sentence of the report says: "I fervently hope that the people of these territories will achieve progress and prosperity, and find their fulfillment as component states of Malaysia". Full text of the report can even be accessed from the Philippines Government Gazette website. About the arbitration award by Paris Court to Sulu of US$14.92B, it had since been set aside and annulled by Paris Court of Appeal. Here is the latest situation. Latest as in June 2023: 1. June 6th - Paris Court of Appeal had set aside and annulled the previous Paris Court (lower court) ruling awarding the heirs of the defunct Sulu Sultanate. 2. June 27th - Dutch Court of Appeal in The Haque had dismissed a bid by eight descendants of former Sultan of Sulu to enforce the arbitration award by Paris Court (lower court) ruling, and dismissed an attempt to seize Malaysian assets following the Paris Court of Appeal decision. 3. Paris Court of Appeal also imposed on Sulu €100,000.00 (Euro currency) to be paid to Malaysia as legal cost. 4. Mean while in Luxembourg, a second attempt to seize Malaysian Petronas assets had been filed in Luxembourg Court due for hearing in September 2023 after the first attempt was dismissed. This will likely be dismissed too following the Paris Court of Appeal decision. Now is already December 2023, no news about Sulu's claim proceeding in Luxembourg Court. It looked like they withdrew their case when they acknowledged the Paris Court of Appeal decision. Malaysia had spent around RM32m, equivalent to about US$6.6m to deal with these Sulu claim cases in various European courts, in Madrid, Paris, Luxembourg and Netherlands. Apart from the €100,000.00 Sulu has to pay to Malaysia as legal cost, Malaysia is planning to sue Sulu for compensation for the loss of RM32m (USD6.6m) spent.

Whatever your government tried to shift your views about how bad their manage other province inside Philippines by tried to claim Sabah and make you guys believe about they will get Sabah for you guys. But the truth they will never get Sabah. Why Sulu lied to you about he owned all Sabah actually only a couple of place. Sultan Brunei also said Philippines didn't have a right to claim all Sabah as their. And please push them to develop other province in Philippines instead claiming but got nothing. 😁

British North Borneo Company (BNBC) signed 2 agreements with the Sultan of Brunei and Sultan of Sulu on 29 December 1877 and 22 January 1878 over the territory of North Borneo respectively. Thus, Sulu claims on North Borneo was given by Brunei as a gift is unfounded. On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters also dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC (24/7/1878) and Spanish government (20/8/1878) in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885 that North Borneo belongs to the British. Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars have a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full. The above documents are kept either in Public Record Office in London or General Archives in Madrid. Sabah was only a PIECE OF REAL ESTATE not a TERRRITORY owned by the Sultan of Sulu/an or his Heirs. When Sabah was turned over by the Sultan of Sulu to the Philippines, the Philippines just owned a REAL ESTATE property not a TERRITORY.

I pitied the Sultanate of Sulu they were never supported nor recognized by the Philippine Government. Pres Quezon openly dropped recognition to the descendants of the Sultanate. Now that the Sultanate of Sulu won the Arbitral ruling in France where the Petronas assets was freeze, the Sulranate of Sulu should think if they should remain with the Philippines or join the Federation of Malaysia, maybe because of cultural and religious ties with the Federation they may finally receive the respect and recognition which their royal family deserves! 🙏
