The plaintiff paid the defendant for a door for a construction project but told him to hold off until he was approved for a permit. Sure enough, the permit was denied, but the defendant had already ordered the door, so the plaintiff is suing for his money back. The defendant insists the plaintiff didn't call him about the refund until three years later.

When a litigant says, to be honest with you, I'm automatically suspicious. Also, when a litigant makes no eye contact with the judge, they aren't believable. As a side note, I love the conversations between Mr. Judge and Mrs. Judge at the end. HOWEVER, Mrs. Judge needs to be a bit more mindful of letting Judge John speak. Poor man can't even finish a sentence.

The plaintiff ordered the door and never picked it up. It was his fault and that’s why he lost. Case closed !

As soon as it was known that this deposit was more than 3 years old, the Plaintiff lost. The Plaintiff knows full well he ordered the door but wanted it to be held until it could be installed. He was notified the door arrived but couldn't get it installed. The Defendant should have countersued for storage.

This case primarily relies on the plaintiff's claim that he gave $1,670 with the condition that the door not be ordered. A poorly handwritten receipt without a purchase date contributed to the plaintiff's loss. It is perplexing why people give large sums of money and later claim they had no intention to pay or receive anything in return. If the door was not expected to be ordered, why give the money unless there was a condition to do so? The plaintiff prematurely expected zoning approval. Additionally, no one usually hands over money for something uncertain; poor decision-making and presumptions cost the plaintiff this case. On a side note, these shorter cases, lasting 15 minutes or less, often miss details. Judge Milian presided over three or four cases daily, and they are much longer than what is aired. We only see the edited versions. Judge Milian researches each case beforehand, so she is fully aware of the details before hearing them. My intention is not to justify her attitude or behavior towards the litigants but to highlight that she is well-informed. Her courtroom behavior might not be favored in a formal court of law, but it suits the show's entertainment purposes. I sometimes wish she allowed the litigants to elaborate, but it is what it is for the show's format. Judge Milian does not tolerate inconsistencies among litigants and calls them out on it. She was a prosecutor before presiding over The People's Court, and her approach is consistent with everyone, not just selective individuals.

I think what the plaintiff was trying to say is that yes he wanted the door but he didn't want it because he wasn't sure he'd get a permit but otherwise he didn't want it but gave a deposit for the door that he didn't want to buy yet.

Because Plaintiff has the burden of proof, it is correct that he lost the case. However, Defendant lied and got a windfall because he never ordered the door.

If the Plaintiff had properly applied for the permits (and were up to code) to begin with, they would have been approved within a few months, at most. Even by the Plaintiff's own admission, he didn't contact the Defendant for 1.5 of those 3 years, it SUPPOSEDLY took to get approved. He clearly abandoned his deposit/the door.

simple solution to this from the beginning. Don't give him any money until you've gotten the permit. Then you don't have to worry about getting it back if you don't get it

​@linsylinsy1573, he only has the door and the special hardware, he sold part or all of the frame.He said he sold parts of the frame but there aren't that many parts to a door frame. I've installed many of them, and they usually come in 3 pieces, 2 side and 1 top piece, or if they truly are special ordered for a special door, they come put together with the door. Either way, if he sold parts of the order then the planttiff would not have been able to pick up the door and pay the amount remaining on it. If the planttiff truly put down a deposit and told them not to order it, he's not a very smart business man, he didn't even bother getting a receipt. However, if he had never discussed a specific door with the defendant than how did he know how much of a deposit he needed. I think they are both lying to some extent and the planttiff was the one who had the burden of proof and couldn't prove his case. The defendant got lucky.

Why does the judge get so upset and yell? People make mistakes for all kinds of reasons. The man most likely had a heavy load.My gosh if she worked with sick people and all that people in the medical field deal with, she would never make it in a large field of stress.

If the plaintiff doesn't get his $1,670 back, shouldn't he receive the door? Also, since the door was cannibalized, by the defendant, for use on other projects, shouldn't the plaintiff receive a potion of the price of the door back?

The plaintiff says he gave a deposit of $1670 without knowing the final total amount it was going to be, yet apparently asking them not to order the door. None of that makes sense! But the defendant provided a none dated receipt, which he could have made up at any date, since when does the judge accept that sort of thing as proof? If the defendant still has the door, then shouldn't he have been ordered to hand it over to the plaintiff?...

Not necessarily disagreeing with the judge on the verdict, but she says “prove you paid mone”. If he didn’t pay, why did the other guy order the door? Also, zoning can take a few years, especially if there’s a few waivers required or there’s any kind of opposition.

Yeah, she’s asked for proof many times in cases like this. I’m not so sure she fully understood what was going on, and just attacked the plaintiff without proof the door was ever ordered in the first place.

One thing I don’t understand is JM comes from a contracting family. She doesn’t seem to grasp things take time. Especially during Covid. Last year, you couldn’t even get an inground pool installed in the New England area. They were incredibly backed up. Window installations took a long time for the same reason. The plaintiff here should not have put down a deposit - but I also get why he did it - because of reasons I mentioned.

The frame was the least of the issue, the door size was what was custom. The door/hardware is probably way in the back out of the way because it was custom.

This situation could've been resolved if there was better communication between these two in my opinion. But People come into Milian's courtroom and allow the disrespect! I'll never understand why people put up with this. She did that throughout this case to both litigants. She'd never talk to me like this. I don't care if she dismissed it or not. She'd get an earful!
