Ask for proof of the law as to his request. If they try to take your recording device you can perform a citizens arrest on that officer for attempted theft

The only evidence captured on the lad's phone was evidence of a Section 26 Improper Exercise of Police Powers because the copper knows FULL WELL that the lad has only just rocked up and so was not there to capture ANYTHING of significance in relation to whatever has already transpired. He MIGHT be able to legitimately seize the phone if something relevant happens from THIS POINT forwards like a another car blasting through the cordon or a crashed car bursting into flames or suchlike but he has NO REASON TO BELIEVE that the lad has recorded anything that could be deemed " evidence ". They just love to FLEX !
