@@Sparks00psn at first I was locked up for a week while the detectives were conducting their investigation. Then I was released. 8 months went by. Then my brother called and said I was on the news charged with 2 degree murder. All because this guy's family would NOT stop harassing the DA. This guy just got out of prison. I had NEVER BEEN IN TROUBLE. He broke in my home and attacked me. And it did not end well for him.

I know of an off duty cop who was killed because his girlfriend did the same thing. The robbery suspects didn't know he was armed, but she blurts out, "Don't pull your gun". They immediately shot him dead... he didnt have a chance.

@@wmpx34Key elements are that the statements were FALSE, and the party acted with negligence in determining if the statement were true or false. If they knowing made the false statement, that’s malice, not mere negligence, which is much worse for the news of course. So if the news made statements of objectively FALSE facts, and they didn’t bother checking the veracity of those purported facts, they potentially “stepped in it”. Look up the Nicholas Sandman defamation cases. He had some cases thrown out, but CNN settled as did a number of other defendants. The news outlets merely claimed that Sandman was a “racist” and that he “blocked” a Native American from moving through a crowd. While the settlements are confidential, Sandman initially sued CNN for $275 million.

​@@wmpx34 this is more or less correct, basically for a defamation conviction you need to prove that they intentionally or ought to have known better. The problem with defamation cases is that probably 50-80% are just Strategic lawsuit against public participation(SLAPP) so the bar is quite high.

These testimonies are wild. I was involved in a self defense shooting once. My state backed me 100%. I never once felt like a suspect. Thank god for real DAs, judges, and cops that stand up for your rights.

@@spectre6682 Good questions. The only evidence they had was my statement, my wife’s statement, a pedestrians statement, and the aggressors statement. It was an insane road rage situation and I was on a motorcycle so when I discharged, I raced to safety, called PD, spoke with them and detectives over the phone. I never had an officer show up to my home and the only question he asked me regarding my firearm was if I was legal to carry I.E. no felonies as I live in a constitutional carry state. Case was shut very quickly and the aggressor who lived was further punished under that law.

@@1800Kalashnikovshooter I think the contrast between your case and his, is that you actually spoke and gave a statement because you knew you were innocent, its not necesarilly doing any bad against you if you seriously just tell the truth right then and there knowing you are innocent. Unfortunately for the person who was involved in the situation within this video, he chose to stay silent. I almost hate to say it, this indicated some sort of guilt EVEN THOUGH he was not guilty. Exercising your right to remain silent is a very subjective situation that in my utmost opinion does not necessarily help you out 100% in every situation. Sure there are cases of amnesia or some sort of traumatic response that can occur to alter your intial statement, but not everyone can keep themselves composed. Given the understanding the creator of the video was able to land all of his shots on target and was able to make rational decisions in the spur of the moment, tells me that he was fully capable of telling the officers at the scene what had occured in the best possible way. My best argument for this understanding is a paper written called, Bibas, Stephanos, "The Right to Remain Silent Helps Only the Guilty" (2003).

@@spectre6682 Every now and then, I find myself stuck on a one-lane road with a clueless, slow/sloppy driver (usually very old) ahead of me, and an aggro behind me. I don't want to be stuck in that situation, so I simply pull onto a shoulder, into a parking lot, or down a quiet side street, and let that whole situation just get past me.

I basically did the thing at the start where I pulled out to another lane to get around a stopped car ahead of me, and accidentally side swiped another car that was already in that lane. My fault and all that, but thankfully no one got angry enough to cause a shooting.

I got into a shootout in Kent Washington in 2017. Just walking to the store. Couple of black teens start bugging me. Asking me a lot of questions. One of them reached for my pockets and tried to rob me. I pull a gun. They pull a gun. But they only had 1. I start firing. They all ran, the one with the gun fired 5 shots at me as he was running missed every shot. . I fired 4 shots I hit him twice. Once in his chest once his neck. He survived. Was arrested. They never got the other guys. But the one I shot got a 5 year sentence. I was cleared due to camera footage. Similar to you I was taken to the station immediately. Questioned etc. they took my gun and held it for nearly 3 months. I did get it back eventually. The corner store thankfully had great footage of the shooting which showed everything happen as I said.

I’m a trucker, have been for almost 14 years. It’s astonishing the amount of people who do not realize how dangerous driving is. Particularly road rage. I’ve seen it happen countless times, fights over ridiculous nonsense. Leave your ego at home and just drive safely, if you make the wrong person angry, you may very well die. As a concealed carrier, I’m glad you made it out of that situation alive. God is on your side no matter what some state prosecutor says. Thank you for your service.

I used to have a late night driving job and it made me buy first pistol. 2 people randomly tried to Mad Max me out in the country for no reason at 3am. So i started having that gun on the center console at night but otherwise put away. Then a guy at like 9am drunk from the night before got out of his car and fight me at a stop light because I beeped at him for drunk driving across 4 lanes. So I started keeping the gun always in reach. Then I walked into a bathroom at a property for work at 3am and there was a crackhead in there. So I started carrying at work at night. A lot of shit goes down if you drive enough and a lot of shit goes on at midnight to 4am. Most people are asleep or don't drive enough to know this.

@@PickupsAreNotTrucks Also a driver, or was until I sold my last two trucks earlier this year. Always carried, but did keep in mind which states had which silly rules and restrictions. Fun fact about Illinois: Despite their really crummy laws and no "official" reciprocity with most out of state CCLs, there is a small provision that if you have a CCL (doesn't matter which state), then you may open carry within your vehicle, but NOWHERE else.

@@rondodson5736 That’s true even as an owner op beings most sites/customers do not allow firearms. Tell your son to keep the gun put away where nobody can see it and be on his best behavior. What they don’t know won’t hurt them. Safety always comes first over company policy. There’s lots of court cases in favor of the 2nd amendment the past few years and more and more and being pushed up to the Supreme Court and they are in gun owners favor. It might get you fired but, at least you’ll be alive. Nobody knows I have a gun, it’s always under my shirt. I carried as a company driver as well. Only place I did not carry was when I was delivering to prisons. They search everything when entering and leaving a prison. But, if your license is legal in that state, you can call ahead to some prisons and they’ll allow you to use a lock box as you enter the prison to keep your firearm safe. Every company has a “no firearms” policy but it’s just some jackass lawyer idea. The companies, the sites, and the police all know we have firearms with us. Just keep your mouth shut about it and you’re good. Sorry I rambled there. I don’t wanna see someone hurt over a silly company policy. I would ignore it. Always have and always will.

I'm getting my conceal carry permit this month, and this is a good reminder to tell my wife to never mention that I'm carrying or say anything about a gun during any sort of altercation. That escalated things from bad to horrible so fast.

Absolutely. But when you get your carry permit do yourself a favor and get some kind of carry insurance that protects you if you have a self defense situation. The United States conceal and carry Association for starters but look into Attorneys on retainer or something but do get something especially if you dont have the 100k for a bond and another 100k plus for your defense. I wish I had that coverage as if I did. I am sure I would never have been convicted of anything.

I am a disabled veteran and was attacked by four men in a dark parking lot in 2015 in a failed robbery attempt after the four had stalked me being a military man. Once I left and in the parking lot they attacked me. One guy the lead guy was killed. It was unprovoked and without warning. No alcohol for me but the four were drinking and had drugs in them. The guy that died was twice the legal limit to drive. I had four attackers and a 380 with only 7 rounds to spread out if you will. At the end of the day, I was charged with assaulting my attackers as the state argued that I committed an assault and as a result of the assault the guy dies. Just never mind about the attack and attempted robbery. Fun fact. The first guy to initiate the attack knocked my glasses off my face making me legally blind and like I said, in a dark parking lot and in shock and disbelief that this was happening . After firing two shots and getting the initial guy off me, I swept my gun in such a way to address the three remaining attackers to which one was running up to me but told an investigator that he stopped and was asked why he stopped? He said because there was a gun pointed at him…my gun, a gun that had just been fired twice and was pointed right at him as he looked down the barrel of my gun with my finger on the trigger wanting to pull it but because I could not see him to shoot him I could not fire per my own training. He was literally like an eighth inch away from being killed himself. At the end of the day the state argued that I had no right to defend myself because they were unarmed yet there were four of them and argued that as a result of the assault a fear assault that the guy died and with grossly incompetent public defenders not arguing at all second amendment grounds to self defense even though I got a self defense jury instruction and a self defense presumption I was found guilty of second degree felony murder but the kicker here is that with second degree felony murder there must be a predicate felony to go along with the actual death itself and the only thing that the state could come up with was a fear assault to which the state also argued that if I had only brandished my gun that I could have avoided the whole thing but that is EXACTLY what a second degree fear assault is ie brandishing a firearm and making some threat or demand at gunpoint which the state admits a second degree fear assault never happened so there should be not conviction for second degree felony murder either…as I continue to fight my case after being in prison for 8 years at least now being on supervised release, I can at least approach my case to try and get exonerated. Holy shit that’s awful. My dad had to kill an armed burglar back in the early 2000s. This was in California which everyone thinks is against self defense but my dad wasn’t arrested or detained in cuffs. Cops took a statement and we left to get a hotel room for the night. Retired cop,Firearms instructor,and hunter. Your recollection of the shooting is a classic reaction. You described it perfectly. I was involved in two shootings in my 26 year career and several other encounters both on and off duty where the decision to use deadly force was on the table. I tell all folks who want to carry that they should be prepared to be treated as a criminal by responding police officers after a shooting situation and to not appear as a threat, cooperate but say and write nothing until you speak with an attorney. You know you did the right thing and want to tell your side but don’t. Great video. It should be shown in CCW courses and police academies.

I was in a non-critical self defense incident where the county DA filed charges despite the detective saying that he witnessed video evidence from the suspect saying he was going to assault me. Since this was during covid I was subject to over two years of proceedings and the DA refiled 3 times. Once in state court and twice in federal court. Eventually the charges were dismissed with prejudice because the guy who attacked me was a felon for meth distribution, was on probation, and if he was forced to show up to court and that video was played of him assaulting me he would have gone back to prison. Ironically, the state never was able to serve him papers despite him having to regularly check in with his parole officer so he was either skipping his parole checkins or the state was purposefully avoiding serving him papers. The judge that dismissed the charges wrote the DA and prosecutors a scathing judgement essentially saying they deprived my rights at every step and that they were unlikely to be able to even show that a crime was likely committed let alone beyond a reasonable doubt. The Chief of Police of the department where the incident took place tried to pressure the detective to charge me with a felony. The detective said that he would only file charges if forced to do so and would include in his report that he was ordered to file charges and that he did not see probable cause for the charges. The Chief of Police backed off at that point and referred the case to the DA. My attorney said that he was actually very excited for my case. He said it's not every day he gets to go to court where the police are on his side. The state would have had to discredit their own officer which would have been a huge deal. In the end I never saw trial. But I still to this day have PTSD from the stress from the process of being criminally prosecuted.

I had evidence of my innocence but I was still worried because of the color of my attackers skin. Where I was charged is very liberal and they would have likely found me guilty regardless of the facts.

I am also in Jacksonville, and I spent 6 years in pretrial detention in a self-defense case. I won the trial in June 2023 for a variety reasons, there was no alleged victim, the police and prosecutors had never met or even seen one and no one accused me of a crime against them, and this person they claimed was a victim was someone who wasn't even alive (he was a felon who was murdered by a rival gang member from prison), and the medical history and reports flat out said the alleged victim didn't even have the injuries the police and prosecutors claimed. The JSO, Florida State Attorneys, and the judges in Jacksonville are pure evil. They all worked together for 6 years to prevent me from going to trial and they all together kept destroying the evidence of my innocence and the illegal arrest.

… by the way, I wonder how many people in this comment section consistently get upset at people charged with gun crimes that are released on bail bond for a low amount. The same people would be upset if the guy in this video stayed in jail on a high bail bond them out, but would be upset if someone else got out of jail on a low amount. Our perception and 20/20 hindsight is an extreme bias. Since we don’t have A crystal ball we just have to have a system that works the best possible way for the most amount of people. But that won’t stop the majority of people sing any story on the news from emotionally being upset based on what they know after the fact or based on what they think at the time, regardless of whether the evidence is there or not.g

This happened 5 years ago. It was getting dark and we live in a good neighborhood,anyway,we did until after hurricane katrina,undesirables moved in a couple miles away in my parish. I heard our dog barking,glanced out the window and saw a guy creeping in my back yard. I grabbed the wrong rifle which was a .22 Rossi. I meant to grab the mossberg590 A-1,but anyway,I crept around my shed/apartment,where my brother-in-law lives in and crouched down. As soon as I turned the corner the dam motion light came on and we were within 5 feet of each other. He saw my rifle,took off running to the back gate,turned around and fired 3 shots. I fired twice and he cleared the gate. The cops came,I told them what happened,they saw blood on the fence and ground leading to the back street then stopped. I shot crouching down. I saw where his rounds hit. Two would have missed me,but one would have hit me in the chest,the police said. I was lucky. They never caught the guy and I went on with my life. This was march 22,2019 7:50pm.

Absolutely. I truly felt bad for my son-in-law sometimes, because my daughter would run her mouth knowing that his physical stature would intimidate most men into backing down. She doesn't realize sometimes people are crazy and she is endangering him unnecessarily. My wife was the same way when we were young. Even the most intelligent women can be idiotic children at times.

Thanks for sharing. Five years ago I was involved in a road rage incident where a man boxed in my car, exited his vehicle, and approached me while screaming obscenities. I had my wife and daughter in the car and did not have a firearm. Thankfully he retreated and drove off. Now I carry every day, train regularly, have a license, and insurance. It is a different world now.

Even cities South and Central America, don't have the level of gun violence, cities like Chicago, Detroit, Philadelphia, Baltimore and Atlanta do. Also the murd3r rate in places like Canada, Europe, and Japan are a fraction of those in the US. It's almost like a war zone in the US cities I mentioned.

They have to show up to a chaotic scene and try to piece together what happened based on the physical evidence present, as well as the stories told to them by either side, which most times they're going to tell their side of the story with some details that may be modified to make themselves sound good. That's why nowadays if there isn't video, nobody believes anyone and it's understandable.

Very true. Also keep in mind that you are the shooter and presumptively the bad guy. If they arrest you there is nothing that you can say to them that will make them think, yup, we need to let this guy go. In my case my attorney advised me “make no statements and admit to nothing”. The only thing I did say was that I was attacked by four men but wasn’t sure if it was three or four and at the time wondered if there was anything that I had done to provoke this situation in any way or did I do something wrong? Even not saying anything about a shooting in any way shape or form, and admitting to nothing, the state made up a story via a law enforcement witness that claimed I admitted to everything so its scary to me about what the state did when I made no statement as what they would have made up or twisted around if I did say anything. I was told basically “first do not harm” and anything you say can be used against you and if you say nothing you at least do no harm irregardless of anything the state does or does not do.

I will say that the detectives ruled it a self defense shooting. The DA is who was crooked and this has happened MULTIPLE times just recently ESPECIALLY when race or something that ties into it was involved. Kyle Rittenhouse should have been easy AF to figure out with all the video but Leftist DA wanted his high profile case even though he knows the law and should be ashamed. Same thing with that guy in Houston. Detectives said it was self defense but the DA made it political. These fucking DA's are politicians and they don't care what the law is and they certainly don't care what really happened.

He was approached by a wanna be cop. He felt threatened and started to run. My son 150 lbs. the attacker 325. They attacker was on top of him beating him. Thinking he was being looked for by the police dept. he wasn’t. The attacker had all the police bells and whistles on his car and a lap top tuned to our vill police dept. They both had conceal carry . The 325 cop wanna be said he thought he hit him with his car and wanted to see if he was all right. My son ran. He told police he had chased the suspect.The 325 lb guy went to shoot my son and accidentally discharged his magazine on the ground. My son shot him 6 times point black range and the guy finally stopped beating him. My son was charged with 6 counts attempted murder. The punk got his gun back two weeks later. My son finally after 7 years waiting for a trail. Losing everything in his life his teaching career, teaching license, his home, his friends,church, . The papers reported lies. The judge and state’s attorney wasn’t going to let it go to trial because I believe my sons name is Rodriguez.To make matters worse my sons homeowners insurance paid the attacker 300,000$ .No attorney will take this case . My son can’t get back his gun that saved his life.yes after 25 minutes my son not guilty it was clear self defense.

Almost got in a road rage incident too, hooted at a guy for ignoring the yield at a circle, he didn’t find that amusing, turned around and chased me down throwing brights and hooting, i slowed down pulled a bit to the side to let him pass but he just stood beside me and I then opened my window, cause he wanted to talk, his ego was fragile and wanted me to stop so we can sort it out, saying that he wants to assault me, i told him he doesn’t want to do that, then he started yanking his steering wheel to intimidate me, i accelerated away but stuck to the speed limit, he drove like half an inch behind me and i just chilled, then we came to the next traffic circle and he shot over it while i was in it and slammed on the brakes to block me in, luckily i could go right to escape. Thought me a valuable lesson to not get involved with anyone on the street because you have some unstable people willing to risk lives over insignificant things.

A lady I know was killed in a head on collision on the interstate. The driver of the other vehicle was a Houston firefighter. The news stories lamented his death, saying what a loss he was, all these great things about him, and barely mentioned her. Couple days later everyone learned that Jason Hamilton (the 2017 version) was trying to commit suicide when he lost control of his truck and struck oncoming traffic.

It's shitty. Had a meth head who probably hadn't slept in a week lose his shit on me and ram my truck with his twice, then boxed me in and got out. I had my three year old and wife in my truck. I was worried by how he was acting out that he would come out blazing bullets. My pistol was in my hand out of sight and I stepped out and stood behind my door. I have had a life time of training, so the best thing I knew to do was calm him down and not escalate. He luckily appeared unarmed, I was gonna run away from my truck if he was armed as for my family to not be in the line of fire. I was thinking quickly and trying not to make a bad decision.. I told him to please relax, I have a kid in the car. Luckily, he did and jumped back in his truck. I had called 911 and gave the license plate already. Sheriff showed up to meet me and was super cool, but it wasn't his jurisdiction and I got two young city police officers who didn't care at all, they made it sound like he only committed a minor misdemeanor hit n run. I said he used a deadly weapon with force, they didn't want to do anything.. Never heard anything of it to this day. Stay safe out there folks, and always remain calm so u get to sleep in your own bed again.

I spent two months in jail this past year for having brandished my legal firearm after an SUV tried 3 times to run me off the road then chased me down over a mile into a parking lot. I was stopped at this point and he comes in hot looking like he was going to run into me. At this point i pull firearm drom my hip holster and make it very clear to leave me the fuck alone. He rips a u turn and peels out screaming. I park and am trying to collect myself when LE comes flying in. I had zero doubt my actions weren't justified and was grateful i was carrying. I explained what happened to cops that i legitimately fearing for my life facing an SUV that attempted multiple times to make me fall, which I had on gopro and showed them. 10 minutes later I'm at the station getting booked. Next morning in court given $150,000 cash only bail released only infront of judge. By 11 am I'm in browns getting to know my new room mates at county jail. Had thanksgiving and Christmas there, got covid for the first time rescheduling court date by 10 days. Cost $30k in court and lawyer fees, and am on probation for two years with 3 felonies if I get in any kind legal trouble. I had never been arrested before... Craziest shit ever.

I was involved in a shooting. I was a bounty hunter and suspect pulled a gun and i shot him. Police showed up, asked me what happened. I had my partner as a witness. Police said he was going to place me under arrest (rookie of four months). I told him to call his LT as he was about to make a big mistake. Lt showed up, reviewed situation with officer and told him he had no pc to arrest me. End of story.

My attorney said to me that a shooting, no matter how justified is part legal and part political. He said the politics of it will land you doing hard time. Basically, keep my mouth shut and let him talk. I had a self defense situation in 2009. Wife and 4 kids were with me. Arrested, held for 3 days, released O.R. Took 9 month for prosecutor to say they weren’t charging me. The whole situation was so challenging and beyond stressful. If you have no choice then do what you have to do…if you can get out of the situation, do it before being forced to shoot someone. Our attacker got one shot to the chest, nicked his aorta but he luckily survived. I thought he died, found out he survived before I saw the judge. I wept. He thought I shot him three times because he had a hole in his chest, round exited out his side then lodged into his arm. Those rounds a funky things.

Geez man, it sounds like you handled that terrible situation about as good as anybody could’ve handled it. I’ve been CCing for a while and thankfully haven’t had any issues. I’m always conscious of road issues and try to stay out of them. I used to have some road rage but it’s amazing what getting a CC permit will do for your patience and the intention never to instigate anything is always with me. It’s good that you defended yourself and your girlfriend from what was obviously an attack on you with intent to inflict death or serious bodily harm.

It’s called “neutral stimuli” in which “time stands still during stress”. The only thing your brain does is focus on the events at hand… no noise, no outside distractions… your mind literally goes into a muscle memory/autopilot mode. Amazing story, and thank you for your service. One takeaway lesson from this is that an ignorant girlfriend will jam you up 10 out of 10 times. Some understand the violent situations better than others.

Am I wrong to say this was caused almost entirely because he chose to instigate a clearly enraged, mentally unstable person with insults? People talking about how the girlfriend put them in danger is like complaining about a dog trying to chase a squirrel. Not saying all women would react like that, but if you’re surprised by it, you aren’t a very smart person. Insulting someone while you have a woman in the car tells me you don’t value her life at all. Maybe I’m just an asshole, but I love the women in my life and they know I can handle myself in any realm of physical confrontation. A simple “my bad” is all it takes.

People that can’t be reasoned with and only see binary choices for violence? If you understood that, truly, you wouldn’t be saying the things you are. When you choose to engage in antisocial behavior (yelling, cursing someone out) you have made a choice to escalate. How hard is it to say “my bad” and go on about your day? How much do you value the lives of the people around you?

@@vitoratio2718 I'm always armed when I'm out in public. I always drive the speed limit and in a very courteous manner. When someone is road ragging around me I back off and let them go. It's always best to de-escalate. It's not worth the potential problems a self defense encounter would cause.

​@@vitoratio2718 Words are just words and can't hurt anyone. The only reason you would criticize a victim is because you don't understand the mind of a criminal. There are road raging people that will get set off if you merely look at them, others may be enraged if you don't. It's not up to you to live in fear and walk on eggshells, it's on everyone to be an adult and control their emotions. You know what else would have changed the outcome of the situation? If the guy didn't aggressively get out of his car, and if he didn't brandish a weapon at the driver. Would you hold a rape victim responsible if they were wearing a skirt or a tight shirt? Probably not, but that's the level of reasoning you're using and it's a dangerous one. There's no point in living in a civil society if nobody is willing to be civil.

FL is famous for political self-defense prosecutions. Folks if you're the type person who likes to cause problems, threaten others, and play stupid games like road rage then take this warning. There are people like me, Spectre, and many others I know who absolutely will not tolerate it. People who've been trained, armed, and practiced for decades are no joke when deadly threats begin. Anyone picking fights with others rarely knows which flavor they're gonna get. You will win stupid prizes if you play enough stupid games in places like FL, TX, TN, and the South in general. You're safer in NYC or Chiraq if you act this way.

By far, this is one of the very best videos of what actually happens in a self defense shooting. I teach firearms self defense and am adding this to my curriculum. Stupid people being stupid and lawyers being lawyers. Thank you for sharing your story.

I had an incident in May of 2023 with 3 individuals breaking into my home as I drove into my driveway. Two were armed. The only reason I was not injured was that I had my pistol in my hand, and they did not . Sorry you had to go through all the leagal stress and expense. That type of DA has DESTROYED our country.

… by the way, I wonder how many people in this comment section consistently get upset at people charged with gun crimes that are released on bail bond for a low amount. The same people would be upset if the guy in this video stayed in jail on a high bail bond them out, but would be upset if someone else got out of jail on a low amount. Our perception and 20/20 hindsight is an extreme bias. Since we don’t have A crystal ball we just have to have a system that works the best possible way for the most amount of people. But that won’t stop the majority of people sing any story on the news from emotionally being upset based on what they know after the fact or based on what they think at the time, regardless of whether the evidence is there or not.k

Ya talk about remembering things after a period of time. I was accidentally shot with a .22 target pistol when I was ten years old. The bullet hit me in the left cheek and exited out the right side of my neck below my ear. After several days in the hospital, I was interviewed by a cop while i was still recovering. I thought that I was hit from the right. My father corrected me and said the wound on my right was the exit wound. I remember the cop asking my father if he had seen exit wounds before. My father told him he had seen many. My father was still 12 when Hitler invaded the Netherlands on May 10th, 1940. But when I had time to think about it, I remember taking the binoculars from Danny O'Brien and spinning to look south, then spinning counterclockwise to look north. When I was saying WOW! Danny was on my left. I felt the bullet hit my left cheek, and I spun clockwise as I started falling to the ground. As I did, I remember seeing a dark stream of blood following the bullet out of my neck. I have never remembered hearing the gun go off.
