Called, and the gentleman who answered the phone was very polite. Informed me that he had learned a lot in the last few hours; though, still states that the public can only record when and where they dictate the public can, not in all public areas of the building. I felt bad because he seemed defeated, so I informed him that this would be going on for a while. It will be going all the way to the Supreme Court because it's in violation of the U.S. Constitution and that we the people own the building.

Police unions should be held accountable for the actions of their members. If police unions had to make compensation payments from their coffers policing would change overnight, after all, cops operate the way their unions dictate, they don't follow laws as they are a law unto themselves.

I left Planet Fitness and drove over to the Schenectady Police department to see if Sean needed assistance. After going into inquire and then walking out of the police department. There was the famous Long Island Audit standing on the front sidewalk. A free man... Nice meeting you. 😁

I'm guessing you're right. The officer at the scanner said they process arrest fairly quickly and they have judge in the same building. This part of the state handles cases late into the evening's.

An "Executive Order" from a Mayor has zero authority over someone engaging in a Constitutionally protected activity (the Freedom of Press). Litigation is the next step! This is ridiculous.

Yes and no. The executive order officially declared the building, beyond the checkpoint, a limited public forum, despite the order TRYING to make it not a public forum. The very wording of it just set in stone what it already was, meaning it can have reasonable time, place and manner restrictions, so long as it is content neutral. Had Sean been loud, if he had used a bunch of vulgar language, the order could be used to remove him. But not for what Sean did. I mean, obviously it was used, but not legally.

This is the 10th time he's been arrested for the same thing. The other 9 times he was acquitted. Mayor's executive orders nor police department policies Trump the First Amendment. That is why he was acquitted in his other 9 cases.

I called this dept. Right after it aired, and you have to go through their dispatch to get through….i was transferred to their chief supposedly, and his mail box was full. I then got an attendant who said they had been overwhelmed with calls about this. KEEP CALLING THEM.

The officer displayed zero effort of good faith. Sean gave him case law and state law that contradicts that edict, and he chose to make the unlawful arrest instead. The public should not be held responsible for the legal proceedings that follow.

@@notozknows He's not going to be fired. He was following a currently legal executive order and gave him the warning first. The officer did his job whether we like it or not. Whether or not the executive order is actually Constitutional will be decided in the courts. I give Sean credit for taking the arrest and being willing to fight over it in court, but we don't know what the outcome will be yet. I'm sure City lawyers were consulted when drafting the executive order, and I'm sure it is backed up by case law they feel was pertinent. Up to the courts at this point to rule on it.

Hope that will be brought up in court. With the technology we have today, cops should be made to pull up the penal code they are enforcing at the scene of the incident. Usually it's always like 3 or 4 cops just standing around. So it's very possible for this to be a law enforcement policy.

There are countless laws and orders on the books that can be interpreted as violating the Constitution. The question is, are these laws and orders enforceable? And in the vast majority of situations, they simply are, regardless of how clearly they might go against the Constitution as written. Sean would have be extremely lucky to win a judgement going against a mayor's order, especially one argued from the position of a Constitutional rights violation.

Unconstitutional federal laws been elected in Senat and many states had unconstitutional laws elected by State's Senats. Some still have. It happened before and will happen in future also, because politicians (people which are in charge for electing the laws) aren't law experts, those are lawyers and judges. Also USA isn't the only country in the world where those things happens, it happens all over the world. In this case, Mayor needs to be educated, same as whole PD about Constitution and 1st Amendment. And they need to pay settlement to Sean.
