Sadly, I greatly greatly fear the real and immense consequences, for the entire world, IF leaders, military, diplomatic, political and economic upper echelons, be held accountable. I never thought the ICC concept, exempting smaller armed conflicts, or events where a maximum of up to 24 parties needed to be prosecuted. However, when it comes to large and internationally grave and extremely extensive crimes, that require 25< participants be tried, it is best to have an ad hoc tribunal, usually fusion courts, or if multinational plainly international ad hoc courts are best, as the Mechanism could be utilized to oversee Appeals judgements. The Ad Hoc tribunals utilize culture, registrars, reparations payments, trial chamber and pre-trial chamber proceedings, outreach programming and OTP.

I’ve always questioned, I’ve always believed that genocide is a hard crime to get convicted of or even charged with. However I’ve never understood the acquittal on count 1, and the refusal to basically read the Srebrenica Count into Count 1, being part of the same JCE, only conducted at varying times per the climate. Also the ethnic cleansing of Kosovo, calls into question as, no, ethnic cleansing is not genocide. That’s certain. However when a group is targeted for removal, either entirely or by the vast majority, and efforts to ensure its inability to return are made with acts within the convention (killing members of the groups 11-12,000 in Kosovo, Serious bodily or mental harm 1 million forced at gunpoint out and terrorized, and conditions made impossible to live (homes and property were looted, or destroyed, and documents proving their residency systematically destroyed. When adding the thousands of raped women and the scale and pace and organization, it’s clear that Milosevic intended to through killing the most critical members, and using serious methods of harming people, permanently eliminate the Kosovar Albanians, he intended to physically destroy their presence. If you wipe out those residing there, entirely....they can’t physically exist. Though A-typical it certainly may satisfy the genocide conventions requirements ultimately.
