The numbers are in favor of them not knowing their jobs they make money for the judges, lawyers, prison, etc. and when they’re caught they face no personal liability when they’re all involved in conspiracy deprive the individual of his rights for profit (inland piracy) and when the people rise up and create their own common law courts and hold them accountable they will keep doing it and rob from the taxpayers to pay for their crimes.

He is not a dirty cop, he is just not informed on every law. Too many people expect the cops to know all the laws and that is simply not possible, they are not lawyers and even lawyers don't know all the laws, they have to research the laws on a case by case basis. The legal system is so complex that you have to have lawyers who specialize. The sheer numbers of traffic laws on the books alone is so vast that it's impossible to drive to the grocery store without violating one. Don't blame the cops, blame the politicians for the mess that exists.

But, they will not because most citizens do not know the law. So, whatever Officer Donut says goes even if it is 100% incorrect. The only time they WILL actively learn is when not knowing leads to negative consequences (complaints, lawsuits, etc) for them. Otherwise, why would they bother?

I'm a lawyer in Texas. I called the Gladewater PD and left a message offering some free training on 1A issues around panhandling and also ID. I figure I've spent enough time complaining about incompetent policing and should try my hand at improving it!

As the Willis Court explains, the U.S. Supreme Court has held that the First Amendment covers “charitable appeals for funds.” Because of this, panhandling, solicitation, or begging are protected speech under the First Amendment.
There’s no Willis Court. Burger was the Chief Justice in 1980 when Schaumberg v. Citizens was struck down on first and fourteenth amendment grounds, and that case has zero to do with panhandling. SCOTUS has specifically refused cases on point, indicating they’re satisfied to leave it up to individual municipalities and states.

They know 38.02. They're TCOLE certified. They don't expect citizens to know 38.02 and utilize intimidation and careful wording to skirt by while demanding ID.

The cops are not exactly the brightest bulb in the string. They should be endeavoring to learn as much as they can about the law and what they can and cannot do. They’re not willing to do that beyond any requirements for the job. They do this for the money, the perceived power with the badge and gun and for the retirement and health benefits. Don’t kid yourself they’re not there to help you the citizen, they are there for their own benefit.

Those shop owners wouldn't say a word if the fire department was out on the street corners asking for donations. They would be bringing them donuts and coffee and not asking them to get out of town.

He does not possess the POSSIBILITY of being wrong or misinformed. And has little to no understanding of basic law (hearsay). That officer is a perfect example of who should NOT be wearing a badge. EXCELLENT job Jeff!! I relocated to Texas nearly 32 years ago. What I find to be so ironic is that "Texans" (and I know, not all) pontificate to be anong the most freedom loving, liberty loving, people among ALL the states in our union ..... well, that is until their neighbor exercises their inherent immutable inalienable freedom and liberty (that causes NOBODY any harm whatsoever at all.....and arguably is a BENEFIT to society). More shocking still is that Texas l.e. works overtime to trample those same inherent immutable inalienable freedoms and liberty. Just spoke with the Gladewater Police Dept. Apparently they are being inundated with calls. They have no official statement at this time but was told the Chief of Police is currently preparing a press release. Hopefully, he will correct the officer
Amazing how hardheaded a cop can be he doesn't want to learn a simple thing that could save the taxpayers alot of money. That is money that should go to help the city and could even make a difference in hiring more officers or a pay raise for cops at a later time. They won't spend 5 minutes to look something up and learn. If his commander ordered him to learn would he do it?

had a most lovely conversation with Michael just now (I am assuming that this is the guy across the street who was yelling at Jeff near the end of the video). According to Michael, he got out of his "nice truck" asked to used a bathroom from another shop, was told "no" then stood on the sidewalk asking for $$$. I tried to inform Michael that Jeff has his entire interaction recorded on video, and he was pushing false information.... But poor Michael then started yelling at me... told me to shutup a few times... raised his voice... called me a snowflake... and hung up. LOL
I've never lived in Texas and even I know Texas law 38.02 states one must ID ONLY when lawfully arrested. These cops are dishonest or incompetent....hard to tell which it is.

I hate, hate, hate with a passion how the caller always get the benefit of the doubt so when the cop shows up they're automatically biased against the person the call is about with absolutely no proof and based on hearsay. This is poor police work. Where's the investigation? This is how a "cop" conducts himself, however, a 'police officer' comes in and does what's needed to be done to handle the situation in a professional manner.

I have a feeling that this officer will have a better understanding of panhandling and failure to ID laws in Texas by the end of the day today. In Texas, you are not required to provide ID unless you have been lawfully arrested. It is a crime to provide false ID to an officer while you are being detained. That is the section of the law that confuses some of these simple minds.
That first cop is such an embarrassment. He is ignorant and not smart enough to know to do an investigation. He really is too low intelligence to have a badge.
First cop was very belligerent and clearly wanted to steamroll Jeff and seemed somewhat eager to go hands-on. I think this town and these officers didn’t learn a thing and need to revisit.
If a cop has to ask "what is your freedom of speech?" The cops would fail elementary school government, they would be confused with the bill on Capitol Hill.
Only thing Jeff is to specifically tell them the federal case law that made almost all panhandling laws unconstitutional. Reed v. Town of Gilbert(2015) is the supreme court case that ruled that asking for help is protected free speech. You made a great point to that Sgt. What kind of freedoms would we have if one person simply asking another for help is a crime?
