Ideogram AI Clarifies: Users Own Their Prompts & Outputs, Not Us! (Commercial Use)

Ideogram AI recently clarified that users own the prompts they input and the AI-generated outputs. In this video, I discuss what this means for using Ideogram AI images commercially.
I explain that while their terms of service state non-commercial personal use only, their Twitter announcement makes it clear you own your prompts and outputs. However, this doesn't override needing permission for trademarks, copyrights, etc.

While Ideogram won't claim ownership of your prompt or the AI output, you still can't take their Indiana Jones image and sell it on shirts without permission. You must verify you have rights to use any content.
This is great news if you want to use AI outputs commercially, but remember:
Your prompt and the output are public, and Ideogram doesn't own them
Still, verify trademarks or copyrights that no infringing
Get permission/approval to use third-party content commercially
Check platform rules regarding AI use

What about commercially using the generated image from another Ideogram user? Or taking their output, then remixing it into a similar but different new output? Who owns the remixed version then...me?

Technically no one owns the AI image unless they make their own. :) So you should be good

Thanks for the update. I think due diligence is needed and also keep in mind that you can't sell any images that are derived from artwork by other artists (you specify certain artists in your prompt), unless it's really old (style of Leonardo da Vinci etc), and anything containing logo's, brands or well-known people, like Indiana Jones.

They say no one owns the rights to the images but if you want to own the rights you need to do some editing to the photo or image

Yes that is correct but I feel like you switch up a percentage of it. You may be able to get away but I'm not sure what that is.

Yes correct or any print on demand platform. You still have to follow those type of rules. Only way you can design for Disney is if you have the rights to do so. Or any other big brand

2:29 I would hope you would not just grab that image and put it on a T-shirt even if it WASN'T Indiana Jones, unless you're the person that prompted the image. In an ideal world, you would contact the original prompter and ask their permission, and respect their wishes if they say no. Ideogram REALLY needs to let people subscribe and make their generations private. I use a lot of original text creations in my prompts, and I cringe every time I generate, because I'm worried someone is going to steal it from me and put it onto spreadshirt or somewhere before I can do it myself. But ideogram is really the only AI that does text in images right, so there's no other choice but to use them. But if they're reading this, PLEASE start subscriptions to allow for privacy, like Midjourney does. I'm sure there are a lot of people like me ready to throw money at you right now. Stop leaving it on the table and ALLOW PAID SUBSCRIPTIONS!!!!

What about used fonts? There are some fonts that not allowed to use for commercial use unless you paid for them. Should I check the font in the generated design?

That's a great question. They made it very general about the outputs. So when it comes to any of that you would want to double check everything. That's where it came get tricky 🙂

Does anyone know if there is a way to get higher res or larger images from ideogram? Right now the resolution is garbage. Has anyone had any success with any upscalers out there that work on taking small images and upscaling without loss of quality or that improve quality?

Last I checked as long as you're paying for it. You would want to double check their rules. I know Dall-E-3 it's ok for commercial use. There is still trademark and copyright rules

We can use the images but you can't delete it from ideogram. So other can use our images and if they upload to a platform then we have a problem.
