Honestly the case is so strong against him and I think that's the only card they could possibly play. I'm not saying it's a strong defense by any means, but they also have to do what their client wants.
They should have emphasized more on what the parents did to address his behaviors, and show more concrete examples of how behaviors made it unsafe for him to be with the rest of family. These attys were so under prepared, asking Judge for time to look up case law while in the middle of questing a witness, This defendant should get his $ back. They didn't even try. Jury had no choice but the convict.

They didn't even address what other attempts he made to get this child help with his behavior. Horrible parenting, horrible lawyering.
My son had the same issues. I also had a hard time finding the right treatments. But I can't imagine doing this to him. I finally was able to get the help he needed. He's doing great now.

I have a child that had issues also - and I will agree in America it should not be as difficult as it is to get the help you need...it's very frustrating...I get that....BUT, I fought for her and eventually it works out...NEVER would I think of doing anything close to this...(other than at times I would have liked a separate room to go to! LOL) NEVER my child! Love, hugs and patience work so much better!!
I applaud you 👏🏽 I have an adult son with autism and he displays behavior at times that I don't love but I still work with him to help him. I'm not making it easier for these parents but they adopted him and they didn't have to keep him if he was a problem and they were afraid their biological children.

In defense's opening statement she implied that a big reason son needed to be locked up was because they feared for their youngest child's safety. However when they stage the house after the detective found enclosure, they want to lead him to believe that he sleeps and shares a room with the youngest child.

@@gloperez8741 Do you mean if the wife will get offered the same deal? If so, I would be surprised. The prosecution now know that they have sufficient evidence to secure a conviction, so any plea deal offered will likely be nowhere near as good as the one he was offered....if they offer a deal at all. I wouldn't if I were them. Mind you, they'll be wanting to see what sentence the judge gives him, as that may well factor into their decision.
I'm wondering why the mother wasnt also charged....I mean, I assume she wasn't because they'd most likely be tried together if she was. Maybe she was an unwilling participant? Idk very much about the case.

The fact that they tried to hide the evidence, change his room, & move things out shows that they knew this was not acceptable. They tried to claim he was staying in the baby's room too. They knew what they were doing to this child was inhumane.

Look up the trial of Recardo and Therian Wimbush. They locked their son up for nearly 2 years in a small room in the basement. He didn’t get to come out.

You got to be kidding. Locking a child on the regular into a windowless room, in the dark for over 18 hours and with no enrichment is never the right way to handle behavioral issues. What mental gymnastics do you have to do to think that would better instead of worsen the situation...

@@InsideandOut7799 You're right let's go over the facts. So they just recently moved there but they had an 8×8 foot long room built for their son. The son didn't have another room in the house, he wasn't able to operate a light switch , the door or anything else in that enclosure. He was surveilled in that enclosure captured in what? 21.000 tapes? They also locked him in there during the day and switched the light off in a windowless enclosure.He had not the autonomy to get food like the other children. There was little to no enrichment in this room and he had to relieve himself in a bucket. But you're right let's not judge premature let us just give them the same treatment they gave that child. Shouldn't be a problem right? Oh and I do care about the other children in the home but they obviously didn't because the thing you do when issues occur is getting appropriate help not locking one kid away.

He made a big mistake not taking the plea. There is no excuse for what happened to the child. He and his wife are going to get a taste of their own medicine for decades! The defense attorneys aren’t helping. Whether he was at a sports event with one of the kids or in Ireland, I can’t wrap my head around why both of them weren’t frantically looking for their missing son. That says a lot too.
When I was 16 or 17, I went to an exhibition with a schoolfriend. There was a 💣💥. This was a huge incident that would have been on the TV News. After we were evacuated, my friend rang her mother to let her know we were ok. Then my friend told me to ring my own mother. I knew there was no point doing so, but I rang my mother anyway. She answered the phone and, as I had expected, she couldn’t have cared less.

The cost of that box could probably have paid for half a dozen counseling sessions. That would have been a better solution for challenging behaviours. The box was for the parents so they didn’t have to deal with him.
Im glad this is going to trial. Hopefully he gets more time than he would have gotten through a guilty plea. The way they're villianizing the child... as if it justifies cruel and unusual punishment of a child.

They swear an oath! We live in America were everyone is entitled to representation and due process. That is how the system is designed to work. All though I do not like it and feel they do not deserve it. I also feel they are obviously guilty. However, I also am glad I live in a country were if I am being convicted (would never do anything like this) I will be represented regardless of how people on social media feel. They also have an obligation to do their best under the laws.
Not that the judge will see this comment, but I have watched MANY trials and can’t express how irritating it is and how often it happens that attorneys won’t stay by mics 🎤 and judges won’t remind them how important it is for them to do so, as WE can’t hear ANYTHING!! 😤 This judge is amazing for many reasons, but especially because he doesn’t let the attorneys get away with speaking without a mic 🎤 So, thank you 🙏🏽 judge, I can’t express how much it’s appreciated! 🥰
The male defense attorney is ill prepared. He should have known exactly what case law he was citing, how many seconds and sections there were to the video he wanted to show and what note was entered into evidence by the state. The “i don’t know” is unacceptable when you’re arguing for someone’s freedom.

The defense attorney hit the right point that the defendant may not have the criminal intent, but ignorance is not a defense, he is still liable for the damages to his son caused by the imprisonment.
I agree, but she made it look bad when she hinted towards victim blaming. Struggling with knowing how to handle behavior issues, making a poor choice. Regardless of intent, false imprisonment is a crime.

Can't believe he refused the plea offer of 2 years. Even at this stage of hearing the evidence they've got (because it's not being shown to the public) and taking into account the defence admiitted in their opening statement the doctor stated the father's actions were not correct and could have been damaging to the child, does he really think he'll be found not guilty? The fact they basically dismantled the enclosure, removed the door and made the son a bed in another room kinda says it all IMO. They knew they were in the wrong.
He continues to do things to get in trouble and be removed from the " house". I know first hand because I was this child and finally removed from my mother. I am now 63 and she's so remorseful now. I forgive her but will never forget. 😢
The attitude of the (very brave!) daughter is very telling! She is loyal to her brother, not her parents. Poor girl. I admire her very much to stand up in court against your parents for justice for your brother. I am very impressed young lady! ❤
I think The Dad Tim Was actually Jealous of the composer that this boy has,the little boy seems to be very smart for his age,I think it was just cruel and also a fact that i got on tim was when he would tell the child I'll Home school You! I thought the same but i found videos on TikTok. It essentially is a windowless room that was built on one side of their garage. People keep calling the room a box. I guess it is if they mean no windows/a way to see outside. It was an 8x8 room. There are bedrooms in houses and apartments that same. So imagine a small jail cell except in jail they get better amenities than this kid got.
@@dandylion9998 no, 8x8 is far smaller than any room rental. it is functionally a closet. Everyone, think of your height, it's probably somewhere from 5 ft to 6'5" right? How long are your arms? Now if you laid down and stretched your arms and legs you would probably be as long as every wall in the room. That is NOT jail cell sized in the United States as far as I know. I live in a STORAGE CONTAINER and the SMALLEST ones on the market are 8x20.
I raised 3 kids. Two daughters and my son. They are all adults now and doing awesome. But adolescent times were hard for sure...plenty of frustration and fights. But I cannot imagine hurting any of them like this

What's worst is they adopted this young man. If he presented behaviors that they couldn't deal with then give him back to the state. Was it for the money? Did they ever take the boy to a therapist?
My kids took bjj with RF and my daughter went to middle school with him. This is such a sad case. I hope RF has a loving family situation now and is getting the best care
I find it interesting the parents state they were afraid of their child but they enrolled him in BJJ which is martial arts that is focused on submission holds and grappling. Why would they want him to become skilled in these tactics if they were physically afraid of him? It doesn’t make sense. I also pray for healing for everyone affected by this crime.
Was he as “bad” as the defense implies? Not that it matters because there is simply no excuse for what they did. No reason for the boy to not have access to normal things, like lights, a bathroom, a sink etc. They could have at least made it a pleasant environment for him if he was locked away…..sad!

I mean ...we talked about recipes we tried to get our kids to eat....juggling all the extracurricular activities .....messy houses....and she said she also worked at her kids school as a substitute or class helper...just normal mom stuff while our kids did BJJ. I remember Tai being excited and happy on the mat...full of energy but fun and the sisters would be doing himework.
@@lilnikki3233 I think she thought it would get his energy out ...but it's a lot of mat work except for the warm ups. She didn't have him in there very long because I think the sisters had conflicting extracurricular activities that she prioritized.

She is allowed because she isn’t a witness in this trial nor does she have to be in her own trial. Additionally, a defendant is allowed to know all of the evidence against them, so this is all she’ll encounter.
Something about being married. They are protected from testifying against each other. Only a witness that is called to testify can’t observe the trial until after their testimony.
@@loveforeignaccents I know a woman whose husband murdered someone. She was allowed to attend his trial because she was married and assumed her right to not testify against her husband. That’s all I know. Edit: she had a conflicting story of him coming back home the morning of the murder, him changing clothes, and her washing his clothes.

The child has problems but locking in a box does not make him a better person. He needs love and guidance...no hitting and pushing. The parents also need more guidance and patience.
The son currently seems to be intelligent and articulate for his age though. Some kids need therapy and medication. I've seen children with behavior problems be able to overcome them and be successful in life.
Based on what I heard, mg experience, RF had Reactive Attachment Disorder (RAD), which is very common with kids that come from Orphanages and in Adoptions. It is a neurological and psychiatric issue that takes a lot of time, patience, physical and occupational therapy and just plain love to learn about and recover from. Locking in a room is not the way to handle it..
It’s laughable how the defense attorneys act so indignant over their clients rights, with their arms crossed and their angry faces, over people that are so repugnant and indefensible. Guarantee the jury has already made up their minds about their guilt.
The bucket is like an admission of guilt. You knew it was wrong and tried to cover up evidences of mistreatment. Likely the sheets the same because they werent washed. Why was that important at that moment to remove as the cop was there? Yeah cause you knew it was wrong. This poor kid is a survivor.
