But the constitutional trichotomy is the best and most fundamental method of allocating each organ of the state to perform its own exclusive function and put barrier on each organ to remain within its own orbit and not overstep its limits while discharging its own respective responsibilities that must be fulfilled in accordance with the dictates of the Constitution. Now If this principle is applied; then judiciary as one of the parts of the constitutional Trichotomy may not advise the political parties to take the lead on the negotiations and resolve their differences politically. But some of the stakeholders are united in the parliament in coalition. The parliament and the government are the other two other organs of the Trichotomy. The deduction is therefore necessary to be considered in this case. This is why the judges may perhaps not consider counselling to the parliament and the government to do this and do not do this. Actually, the judiciary has counselled the political leaders who are neither in Parliament nor in the government to negotiate with their political opponents and they are not the opposition parties but they are in the parliament and the government. What is confusing is that the principle of Trichotomy is saying something about non-interference by the respective three state organs in each other’s affairs. This is a naive interpretation of the concept of the Trichotomy by the commentator of defining the relationship among the three main organs of the state. This is what is called the Trichotomy but the principle is not so simple as it seems to be particularly paradoxical in the context of working in their respective fields and not jump elsewhere in violation of the Trichotomy itself.
