As per Independence of India Act, princely states had a right to join either Pakistan or India. It was not to be decided by majority population whether Hindu or Muslim. Kashmir was a princely state and the Maharaja decided to join India. India has a legal and legitimate claim to Kashmir, including on Pak occupied Kashmir. As far as UN resolution is concerned, Pakistan has to first vacate POK (as per UN resolution) which it never did and will never do.
