You have been recommended by our teachers from global law at Tilburg University and I can only say that they chose a really good video for this topic. You explain very good and clear, I like your examples, comprehensive and resourceful video. I find property law a really hard subject but in this video everything was easy to understand, so thank you for that! Keep up the good work and the cool vibe! :D

honestly so helpful! My lecturer shoved all this under 'Acquisition of the Family Home and Ownership' and talked about trusts from the point of view of a person who wants to claim ownership of a home, but the way he did it really confused everyone as to what a trust actually is and what it means. I actually understand them now and am able to apply the basics to the more complicated questions

Thanks for clearing my doubts and make me understand the module. I owe it to you 😌😌 Plus the little Jane Austen allusion, especially Pride and Prejudice made me enjoy your videos more... I'm a massive fan of Austen as well and it occurred to me that the whole Mr Collins marrying a Bennet was on this basis. Thanks again, hoping you make more videos and receive more subs. I thought the settlor could not also be the trustee? Also didn't realize one person could be all three, could you provide any references you could provide in order to verify this information?

In a case where a fraudulent Trust was created through Undue Influence & Lack of Capacity: Let's say the document is determined to be VOID by the court and the valid pre-existing Trust is accepted as the correct one. How do the beneficiaries then collect their rightful inheritance? Does the probate judge order the stolen assets to be returned and distributed according to the valid Trust document terms? How does that work? It gets extremely complicated when there's a 'bad Trustee' who is adversarial towards the beneficiaries and steals all the Trust assets.

Hello Marcus, do you think it is important for there to still be a course on equity in universities or should they just focus on the law relating to trusts, property, tort etc...

I think so. At the very least it provides useful historical context and can help students understand the approach taken in property/trust cases etc. by the courts.

Great video, really learned a lot from it!! I was just wondering if there is a type of trust that has an undefined amount of beneficiaries? So for example, if I created a new musical instrument and put it in a trust where I am the trustee.. If I then used it in front of an audience, is there a way that all of the audience would become beneficiaries as they are benefiting from the instrument, while I remain the trustee as I am fulfilling my duty to the beneficiaries

Think triangle: Grantor (person granting the trust) vs Trustee (person running the trust) vs beneficiary (person benefiting from trust) Grantor owns the X being setup in trust eg land title owner Beneficiary has an interest agreed with grantor eg owner grants P rights to use land R1, owner has right that P agrees to use the land as agreed R2 Trust is the vehicle within which the Trustee works Trustee works to provide that Grantors interest to the beneficiary as part of his role Hence Trustee has obligations on them ie R1, and beneficiary be similar obligations R2 upto the Trustee (before the Owner removed himself). Looks like the legal title moved to trust And the obligation persists fro grantor to beneficiary as first promised

In Australia, tax avoidance is a criminal act, but "tax minimisation" is not. In fact, tax minimisation is encouraged. In the Australian context, it would be ill-advised to suggest that a trust be established for "tax avoidance" because anyone suggesting that would be inciting the listener to commit a criminal act. FYI and not meant to detract from a very good presentation.

I have bought land 25 years ago 3 plots of 28 which comprises about 4.1/2 acres in total. the whole site is freehold and used as gardening land.It is held in trust by 4 trustees (due to land registry laws) and run by a committee elected by the beneficiaries. The committee are trying to remove me from the land, and say I cant use it anymore, are they allowed to do this?. They say they own the land and i am only allowed to use it if they let me. They will not let me have details of the other beneficiaries, are they allowed to withhold this information?

They are right if I have a right basic understanding, you are only promise income from the land, the right to use it, unless you put it in writing stating different. Plus IRS will make you pay taxes on the years that it was consider a trust vs a partnership.

Hello We are a lobby group trying to create democracy in UK (we all would get the real vote which only MP's have currently as a referendum which MP's would represent in parliament (currently in law they don't have to represent the public even if a referendum did occur, the real vote is preceded by a debate and is on tax, spending and law changes) all we are doing now is electing MP's to make those decisions for us and banks lobby groups are more represented in parliment than the public (e.g. voice of friends of israel was stronger than 1 million protestors) how can we achieve this. Also we are trying to help a lobby group which opposes the "draconian sentence" called i.p.p (echr called it draconian, it is illegal but people are still sentenced to it and on life license for minor offences, is there anything we can do?)

It was introduced by friends of Israel lobbyists! i don't think the peoples opinion matter to them, they have tried and succeeded in convincing the people that this is democracy and freedom, when they want a war they lie, 1 million protest and they still get their war (the problem is hidden assets, LFI, CFI and other friends of israel lobby groups) actually parliament has no obligation to listen to the people's will even from referendums. It would be good if you could look into i.p.p. sentence because people have a tarrif (minimum term and a max of whole life) they sit before a parole board who make a decision based on the risk they pose, which is basically a prediction of potential for future harm. violence is 15 times likelier in prison however this is not considered. professor sarah jayne blakemore can confirm that parts of the brain that give us humanity and awareness that reduces impulsivity does not fully develop until 30's yet many adolescence have gone way beyond their tariff. when most of the i.p.p population have not had a violent offence in the last 4 years (if 15 times more likely in prison thats like 60 years) but they are mostly refused parole (their risk cannot be managed in the community is the claim or treatment is needed which actually would be better outside the latter has been used to put people on similar courses which have been renamed to make them appear separate) they face arbitary length of punishment and a threat of life license recall for even more minor offences like failure to disclose work venue (this is impossible when work requires travel so effectively limits availability to work which hampers recovery and reintegration into society actually leading to a greater chance of reoffending. the whole system is biased against them even though the sentence has been ruled draconian they remain sentenced and there is nothing we can do???
