Dear Sir Ashir your talks provoke our thoughts. I can relate to your views about judges since my Grandfather was justice at Peshawar High Court from 1985 to 1987. I have heard the stories about his honesty and truthfulness . He hanged a murderer even though he was his cousin. I often think that my grandfather could not make it to Supreme Court of Pakistan because he was too honest for the job.

Absolutely right. Ashir's analysis of the last case are the type of things he says that makes me think he is tunnel visioned. He only looks at things from operational perspective and loses the bigger picture. The case of analyzing Arshad Shareef's killing as a regular Naka mistakenly gone wrong was a big fat warning sign.

Nice, but timing of every case tells its intent. When Election comission was supposed to held election in 90 days as per constitution. Then what is your analysis? Election comission is executive body to do whatever is told by someone. Power is everything not the law.
Please try to tell the complete story, Election Commission has authority to form Election Tribunals under section 140 but they have to request the list of Judges from the High Court, not to pick the Judges with their own will. What an intellectual dishonesty.

Is Qazi right? Yeah. Technically yes. But what was his purported stance and principle on committee of practice and procedure? It was democracy in the SC bench formation. A simple question: Depriving PTI from symbol was fine but not considering it a party at all, was it not unconstitutional? Yes it was. Did Salman Akram went to court against it? Yes, was he entertained? No, why didnt detailed judgement explained the fact? As someone who understand constitution, yeah technically Faez Isa is right but only a naive would agree that his 12:00 am judgement on Jan 13 was mere a coincident, moreover then in his last two weeks when govt desperately needed floor crossing, he came to rescue him. And if text of constitution matters, why it didnt matter when Justice Naqvi was being removed, despite the text saying, only serving judge can be questioned by SJC. There are further complications to it which he of course tactfully ignored. He is acting like an innocent guy who doesn't know the whole story. There is an executive namely Chief of Army who wants to be legislative, executive and judiciary all by himself. Qazi who kept 63A pending till his last month in office did not start proceedings because he wanted justice to prevail. He wants to provide the said executive all the powers and in return wants to enjoy another 3 years in office. Ashir in his film Malik tried to potray such an all powerful executive who would control legislative, and judiciary as well. The innocent Ashir and the innocent Qazi..
You are wrong about the Constitution being absolute. Any article of the Constitution can be challenged on at least 2 basis. 1. Being un-Islamic and 2, Violation of fundamental human rights. Article 63A violates both these principles.

Sir, In 2022 decision article 63A was interpreted by the Supreme court under article 184(3). The interpretation seems correct because it stops horse trading, abuse of power by sitting govt to enforce any amendment by coercing MNAs from different parties just to ensure their majority etc. Text of the constitution also didn’t say that vote will be counted. It’s a grey area. If the vote is casted, it doesn’t mean it must be counted. It can be rejected as well. Thats what SUPREME COURT DID THEY INTERPRETED AS IT SHOULD BE REJECTED. my mamoo was also a civil servant and he has met this self proclaimed intellectual on numerous of occasions. he actually laughs when he talks about Ashir. Sir, till date i agreed to almost all your thoughts but allow me to show some concerns and i wish you respond. 1. What was the purpose of 63a? Discourage defection, so that people know the consequeneces and dont defect. Consider the situation, this consequence (disqualification) is peanuts compared to what they are offered to defect. You have the idea, i am sure, about the weight of bags i am talking abt and disqualification for a term is nothing compared to that. So, the objective of 63a is to be stop defection. 2. Once i take the argument that vote should be counted bacause unless it is counted, there is no defection. My argument is that if the vote is counted then it opens the 100 ft wide gate for horse trading. Every next govt is vulnerable as the opposition would need to ararnge just a few bags to make 2, 3 or 4 people defect and its over. Secondly, i respect your point that unless the vote is accepted there is no defection. In this regard the exercise of consent, pure williningness of voting against party policy and showing opinion or stamping a box whatever, communicates the vote of the memeber and the will and moment he stands or stays seater against the party policy is in itself execution of defection and then his/her vote should not be counted. A simple expression (for reasons mentioned in 63a) against the party is defection and thus there is no point of counting that votes. Horse trading would really consume major mental faculities (as little as they have) of next govt.s as they would be sitting on edge all the time to keep numbers intact. Reards
You are taking away the basic right of expression and forcing him to not go against party policy because your vote will not be counted and you will be disqualified. In every democracy member can vote against his party policy and vote is counted. If I accept your argument then in case government has clear majority, opposition is pointless because it cannot pass any resolution or law and is outnumbered for 5 years.
The issue with us is that we will only support your narrative until and unless you are talking about what we believe in and what we think is right. If you say something against what I think is right, I will start disrespecting you and show you how much of a low person I am.
