In this series, we're going back to day 2 of the Johnny Depp v. Amber Heard trial to look at the cross-examination of one of Johnny's most powerful witnesses, his childhood friend Isaac Baruch. Amber's attorney Elaine Bredehoft put on a masterclass of what NOT to do in cross-examination. Join me as we break down in depth what Isaac does well during this cross-exam and what Elaine does so very, very wrong.

As a painter, I would assume that Isaac would remember visual details very well. Better than the average person.

Found these recaps. They are great. Isaac has a way of looking at Elaine like this fool can't be serious right now but in a polite way. As a viewer who watched the trial live, I was with Isaac the whole ride and start looking at Elaine like this fool can't be serious right now too. I liked that he was focused on Elaine too and not trying to sell his answers to the jury. He didn't need to sell anything, he was telling the simple truth. Terrible lawyering and an excellent witness. Love your commentary.

Surely she had gotten feedback about amica vs arnica from her opening, and yet she sticks with the amica. And, when Amber testified about 12/15/15 she said she iced her broken nose and black eyes all night. No mention of any miracle amica cream.

When Elaine repeats, “Let’s. Start. With. The. Makeup,” she is using a condescending tone to try to shame Isaac for not hearing or understanding. He is not ashamed. So now he has not only forced her to repeat her first question, but has made her look nasty and sarcastic. I love the ways in which legal strategy and psychology intertwine. Elaine was astonishingly bad both at recognizing and adapting to the personalities of her witnesses and at controlling her own behavior/reactions to present a desirable front to the jury. I was amazed to learn she is considered a top attorney in her state.

Did she not do civil litigation before this? I remember that coming up with Dr Shannon Curry, that this was her first civil trial. But she had testified in many many criminal trials.

Sometimes the bad performances can have that affect: that you realize “no I can be a lawyer because this woman didn’t do very well and if I can do better than her, I’m gonna be alright”. There’s no grades in life other than pass or fail & this was not her best day that’s for sure.

Extensive breakdowns of this sort, with multiple witnesses is a great idea. I'd be happy still watching new breakdowns 10 months from now if they're well done. People will be interested in this trial long after it ends, IMO. Subscribed!

Ms. Heart - that is GOLDEN. I think she was reading from a script, & literally read the printed word "Heard" as "heart". It did not take much for Issac to mess up her flow, which shows her stress level and/or cognitive load was too high to begin with. She was stressed before Isaac took the stand, probably from dealing with a narcissist.

Also...It's ARNICA creme, not AMICA creme. But in lower case letters, "arnica", the "r" and the "n", next to each other, at a glance can look like a "m". Hence AMICA. That was such an embarrassment and she said it at least 10 times. And so many of us knew this and laughed out asses off. It was absurd, as was Elaine Bredahoft.

Interesting that Isaac, from the first five seconds of this cross, already took total control. I heard Elaine is a well respected lawyer in VA, but seeing from her bad instinct on cross, do you think she lacks experience in this process? Still perplexed as to how a renowned lawyer could be this bad with witnesses😂

JD'S team is from a huge firm and they picked from across the country. He seemed to trust his team and left them to do their job. AH'S team seems to be from two law firms, have a lot of client input (too much in my opinion), and ego. AH was furiously writing the whole trial and leaving so many notes for them (which were probably contradictory). Someone said that it would be Amber who lost the case for her.

I don't think Elaine has cross-examined many witnesses like this man. I think she expected him to be like AH'S witnesses that are easily rattled.

My impression is that she is a good negotiator, who mainly ressolves cases by plea and/or settlement. She seems fairly good at research (though not spelling) but goes to pieces in a live setting. She certainly doesn't act like she's been in a courtroom for years: but maybe she hands off the cases she can't settle or have dismissed to staff beneath her. Or maybe it's just Amber is such a nightmare client it's impossible to prepare well for. I mean hell, she managed to get her OWN LAWYERS to admit the same photo as evidence for two seperate incidents. You could call them incompetent, but it's more likely Amber's version of events is just so batshit crazy no-one involved knows which way is up at any given moment...

Love this breakdown Andrea. Isaac has an artist's eye for detail, you'd have thought Heard's legal team would gave taken this into consideration. Glad you have started your own youtube. I've listened to your imputs on others channels. They are always clearly explained to us unfamiliar with the law especially US laws & always with a touch of sass. Hey Andrea. Big fan. What I find amazing in this whole Amica cream deal is, no one on Heard team attempts to correct the mispronunciation. Including Amber. I think it is an elaboration and I think she never used Arnica cream.

This just screams that they just took AH at her word about everything. I suspect not a lot of research went into arnica cream. I bet Elaine scribbled down Arnica and the "r&n" looked like an "m", she did zero research into what it is or how it's used and that's it's NOT a miracle cream that disguises bruises (that would be the correction palette) Had she researched it Elaine would not have put so much emphasis on it 🤦🏼‍♀️ In fact, where are her research team?

As she questioned him, and each time she said Amica, I was screaming at the screen. "It's A R N I C A cream!" Proving that AH only read the name online or in a magazine or some such. She hasn't asked a pharmacist for Amica. They would have said the name properly. The "r" and the "n" can look like an "m." Liar, liar pants on fire Amber. I even checked the word "Amica." It's a company that make kitchen equipment, I think. I've been an RN in Plaster Surger for years. So I know that there's no cream called Amica that reduces swelling and scatters bruising.

I may be able to shed some light on Mr. Baruchs good eye for details. He mentioned that he was taking art classes relatively recently, and got his art degree. I've taken a lot of art classes, and as I did not have a real natural talent for painting or drawing, I really struggled when it came to portraying live models. When your class hires a model, they can't hold a pose for more than 3-4 minutes, and since I didn't have that natural talent for drawing the human body, I really struggled with time. I would end up with half finished works, and I didn't have the raw talent to finish them afterwards when the model had moved on to a new pose. Over time however, I trained my eye to pick up shapes, so that I could draw the important parts faster and commit the rest to memory so that I could finish it later, despite my slowness. It's possible that Mr. Baruch struggled, like I did, with the human body, so he trained his eye to pick up details to finish his art later on. Ms Heard is objectively speaking, pretty as a model, so it would make sense that he would see her as such.

Thanks Andrea, well done! I know Elaine asked about foundation, etc. during some of the depos but it seems to have sorta disappeared from the defense. I wonder if they've finally figured out that the makeup they highlighted wasn't around when JD & AH were married and the fact that Amica cream doesn't exist LOL.

I love this format!!! About the infamous AMICA CREAM gate: I don't wanna say that since those are AH's lawyers they have to be dumb or unprofessional or ignorant, BUT I think they're not prepared and they let Amber do their job, without verify and dig deeper everything she said to them! And arnica IS the best evidence because that shows Elaine doesn't know what she's talking about,doesn't know what arnica is and she simply READ HER SCRIPT WRONG! "rn" may resemble an "m" in lower case letters or italics. She simply read it wrong, and not knowing what she's talking about keep going with the mistake! This literally left me with no words... I was shocked! How can you allow yourself to ask a question in a cross exam,about a topic so fundamental in this trial (make up related to how she supposedly covered her bruises!) without knowing what you're asking! If she had deepened about the arnica cream before the trial she would have completely avoid the question because she would have known arnica CAN'T help with bruises or swelling overnight! And the same error happened with the conceal palette that didn't exist at the time Amber supposedly used it! I mean, I know I'm repeating myself, but that is a focal point! They should have known EVERYTHING about this, they should have investigated everything about the makeup, especially because this never happened! They're not just telling the truth (I think this make it OBVIOUS at this point) they're manufacturing the whole context and set up a narrative so they should at least make themselves sure that it's believable and coherent! That they're mention products that where available at that time, and that are believable and relevant! ...this is absurd for me,it's just stupid!

And by the way, what's the point of asking THIS witness about what makeup she used, what concealer...this is not relevant, they can't sustain both that she was used to wear a very heavy makeup with tons of concealer and foundation (she said this too about the show she attend in Australia the day after she was heavily beated in the face) and that Isaac may have not noticed the bruises just because he doesn't know which kind or brand or tint of makeup she used....ridiculous.

Typography. Lower case “rn” and lower case “m” look pretty similar-almost identical in certain fonts. For someone not familiar with arnica cream, it’s a reasonable misreading (though, of course, if she didn’t know, it would have been better if she’d asked those questions beforehand).

I have watched every minute of this case. Yes, there have been moments where I laughed at some ridiculous comment or such. But always in my mind is the compassion that this isn't funny to Johnny or Amber and his kids. I watched Isaac the first time. This time, however, I laughed so hard. I'm still laughing. What a great guy!

This is AWESOME... I would like to note....he's an artist, right? So am I and you develop a memory for detail that can be astounding to other people. It comes with the territory. Elaine doesn't seem to believe that others possess abilities that she lacks (a lot of people don't believe that), so she CAN'T seem to adjust. I think her first mistake was getting caught up in her client's orbit. I'm sure others can relate.
