We speak with Kenneth Roth, international affairs scholar and former head of Human Rights Watch, about revelations that Israel waged a nearly decadelong campaign to intimidate the International Criminal Court in order to stop possible war crimes prosecutions of Israeli officials. A joint investigation by The Guardian and the Israeli +972 Magazine revealed that Israel surveilled, hacked, smeared and threatened top ICC officials, including chief prosecutor Karim Khan and his predecessor, Fatou Bensouda. The former head of the Mossad, Yossi Cohen, is said to have personally threatened Bensouda. The revelations come just a week after Khan announced he is seeking arrest warrants for Israeli Prime Minister Benjamin Netanyahu, Defense Minister Yoav Gallant and three top leaders of Hamas. "This is a crime," Roth says of the Israeli campaign against the ICC. He says the revelations also undermine U.S. claims that Israel can hold itself accountable. "There is no good-faith Israeli investigation. There is a concerted, high-level effort to undermine justice to protect Netanyahu, Gallant and others from war crime charges."

An arrest warrant issued by a organization with absolutely no means of enforcing that arrest. This whole thing is going to end with the US, Israel and most western nations backing out of these international courts. They were only created by them to prosecute nazis. Since then its been used as a political tool of the west to prosecute those THEY deem a threat. This was never meant to be used by the rest of the world, and it never will be. You really thought there was some international force that overrides the law of a sovereign nation? That was just the United States, without our blessing nothing will ever happen to Israel

I've left the ICC shortly after Bensuda went up and I've to admit that I underestimated her after her predecessor was quite powerful. My respect for her has risen tremendously, hopefully she'll proceed and will be successful. That's what I wish for her: Success.

ICC under Karim Khan should be commended for their courage in initiating legal action vs Hamas and also vs Israeli leaders who are obviously committing war crimes in addition to genocide. As pointed out by Ken action should be taken against Israel leaders for the illegal settlements in West Bank and East Jerusalem. The international community for far too long simply closed their eyes to the crimes and human rights abuses being committed by Israel in the west bank and Gaza. Such closing of eyes continues to date. As a British pensioner I find this to be utterly disgusting.

Don't forget that she was also the ICC prosecutor who launched an investigation on potential war crimes in Afghanistan, and got sanctioned by the US for the investigation. Khan a UK citizen, a country that was involved in Afghanistan quickly ended those investigations when he took over as ICC prosecutor.

I greatly applaud Fatou Bensouda for all her hard work, although living in a world were black women are constantly excepted to be "strong" and "tough" and take misgonoir with a smile on our face is POSITIVELY draining. Icc judges should be ashamed for taking so long on issuing the arrest warrant. Complicity or fear...either one of two, is not acceptable...what else should happen ?! Isn't enough proof ????!!!! Most would have this done in November 2023, but it's important that they be perfect in their process as they will be against the power of the USA, much of Europe and the western world. If they don't win the case it will do more harm than good and the Palestinians will continue to be abused. If done right lives will be lost, but the future generations will hopefully have peace and safety. It's important we support the court and apply pressure to our governments to do the same.
