But by pleading the 5th in a civil case, it does protect you from criminal charges. It doesn’t protect you from the judge considering it during his sentencing. Civil cases, the judge or jury can take your 5th into consideration with all the evidence to determine guilt or not. In a criminal trial, the jury has to complete disregard that line of questioning and can’t use it in their deliberations. So either way they are screwed.
