Special counsel Jack Smith has asked an appeals court to bring back the classified documents case against former President Donald Trump that U.S. District Judge Aileen Cannon tossed out in July over the constitutionality of Smith's appointment. Only way to change this Appointment Clause in the Constitution, is by Constitutional amendment to that clause...otherwise, Cannon is out of order with the Law.

Jack smith can request a new judge and the 11th circuit of appeals can appoint a new judge on their own because this will make the 3rd reversal of her crazy decisions. But there’s no rule saying she has to go. She’s about as close to getting removed as you can get but there’s 11th circuit can give her another chance.

Because the point isn't to make a point that won't be overturned on appeal - it is to delay any substantive work on the case for as long as possible, in the hope that Trump will be re-elected and use the office of the president to cancel the case entirely. She probably expects that the ruling WILL be overturned on appeal - but that will take weeks, and then she no doubt expects that the re-opened case will just come back on her docket (so she can start over on the delay tactics with the clock reset)

Trump is not yet convicted of anything. Under NY law conviction does not attach until sentencing and that is delayed until after the election.

Read the Constitution, only the President with the advice of the Senates can appoint a Special Counsel..period. A Special Counsel appointee may hold this promotion up to 8-10years. The AG then can appoint any of these prosecutors to oversee any case. However Jack Smith was never appointed to a Special Counsel statue by the President or Senates, so Garland had no power or constitutional rights to appoint Smith to oversee Trumps Florida case. Judge Cannon got this Right.

You are crazy. Jack Smith is not a real Special Counsel so he has zero credibility. Special Counsels have to be approved by the Senate and he was not. And Garland knows that. Both are corrupt.
