One way they could look at it would be to apply the law in the state where the recording device was located. The other way would be to default to federal law and under federal law you only need the consent of one party involved in the conversation. Either way, no law was broken in this case.

Le Xuan Nguyen oh, i wasn’t aware. i looked it up and oregon is one-party consent, but because sam initiated the call, he does not have the right to record, as far as i’m aware. i think how it works between states like this is that if you initiate the call from a 2-party state to a 1-party state, the person receiving can record, but not vice versa, so if you call from oregon to california, you have to obtain their consent to call. it may also be that since the person started the call in oregon, oregon rules apply, so he did only need 1 party to consent. that blurs things a bit, i would have to look into it, but honestly i don’t know how it works edit: okay so researching tells me that the general rule of thumb is that wherever the recording device is, that is normally which laws take precedence, but also if you have a “reasonable right to privacy” (which i would assume james has) and are taking the call in a private space, then the other party must consent. it’s super blurry but if this went to court, i would say it was illegal to record it, seeing as it was sensitive information and they were both in their respective homes on facetime, as far as i remember the details. thanks for pointing this out
