विश्व आदिवासी दिवस के मौके पर झारखंड के नये राज्यपाल संतोष गंगवार ने पेसा कानून लागू करने की बात कह नई बहस छेड़ दी है. राज्यपाल ने सीएम हेमंत की मौजूदगी में कहा है कि बाकी अनुसूचित जिलों में पेसा कानून लागू है लेकिन झारखंड में नहीं. हालांकि, गर्वनर संतोष गंगवार अकेले व्यक्ति नहीं हैं जिन्होंने पेसा कानून लागू करने की मांग की है. इसे पहले झामुमो के वरीय विधायक लोबिन हेम्ब्रम भी कई बार पेसा कानून लागू करने की मांग कर चुके हैं. उन्होंने कई बार कहा है कि पेसा कानून लागू नहीं होने से झारखंड के आदिवासियों की जमीनें खतरे में है. जल और जंगल पर उनका अधिकार भी सुरक्षित नहीं है. मुझे लगता है कि इतना ब्रीफ करने के बाद अब आप समझ ही गये होंगे कि पेसा कानून क्या है. नहीं समझे तो हम बताते हैं.
पेसा कानून को आधिकारिक तौर पर पंचायत उपबंध (अनुसूचित क्षेत्रों तक विस्तार) अधिनियम-1996 के नाम से जाना जाता है. संविधान के भाग-9 में दिये गये प्रावधानों को अनुसूचित क्षेत्रों तक विस्तार देने या लागू करने के लिए दिसंबर 1996 में यह कानून लाया गया था. अनुसूचित क्षेत्रों को संविधान की 5वीं अनुसूचि में कई विशेष प्रावधान दिये गये हैं. ये प्रावधान अनुसूचित क्षेत्रों की कई मामलों में सुरक्षा और संरक्षण देते हैं. अनुसूचित क्षेत्र माने, ऐसा इलाका जहां जनजाति और आदिम जनजातीय समुदाय के लोग रहते हैं. आजादी के बाद सरकार के सामने ये सवाल आया था कि जनजाति और आदिम जनजाति समुदाय की सुरक्षा कैसे सुनिश्चित की जायेगी और इसलिए संविधान में कई प्रावधान किये गये हैं.

If you have not understood, then we will tell you.PESA law is officially known as Panchayat Provisions (Extension to Scheduled Areas) Act-1996. This law was brought in December 1996 to extend or implement the provisions given in Part-9 of the Constitution to the Scheduled Areas. Many special provisions have been made for scheduled areas in the 5th Schedule of the Constitution. These provisions provide security and protection to scheduled areas in many matters. Scheduled area means an area where people of tribal and primitive tribal communities live. After independence, the question came before the government that how will the security of tribal and primitive tribal communities be ensured and hence many provisions have been made in the Constitution.If we want to understand PESA law in very simple language, then it is a law through which the rights of tribals on water, forest and land can be secured. A law through which the tradition, culture, language and environment of the tribals can be protected. A law which protects the eco-system of tribals from external interference. And this will be possible only when tribals can make their own decisions legally and socially. Tribals can decide what is necessary, good and beneficial for them. Overall, PESA law is an attempt to revive their dying traditional self-governance system in tribal areas. We know that tribal means the community which is the oldest in the world. And if they are the oldest then they will have their own system. This is called the traditional self-governance system. Here the entire community is controlled by the Gram Sabha.
