Jimmy Mulville Not So Funny Now - LJ11GJK Aston Martin Rapide

This one was in the papers. James Mulville was convicted at City of London Magistrates court on 25/05/2023, of an endorseable mobile phone driving offence, and was given 6 penalty points on his licence, bringing his current total to 9 points. Fine was £1,000, costs of £625, and surcharge of £400. Funnily enough, I caught this exact car/plate in January 2019, and the driver then took an FPN for 6 points and £200. I will never know who that driver was, but it turns out that Jimmy Mulville was disqualified in 2020. I can't help thinking it was him I caught in 2019 also, but it may well be a different driver. There was at least one V5C logbook change according to the DVLA record.

Well, James Mulville, now you're just 3 points from another disqualification. That's a single speeding or red light jump offence, or another mobile phone offence. There are thousands of people with cameras in London, so the chances of being caught again are more substantial than many drivers imagine. I don't want you punished, I only want behaviour change and better driving from you. It seems to me that in your case even punishment is not making the necessary difference in your driving. Nevertheless, I hold out hope that you might change and improve.

What i always find amazing is the fact that those people have expensive cars but never buy a cheap bluetooth receiver or car phone holder. I even think this car has a bluetooth radio. So what is the problem?

​@@coolguy1538you can technically - my old iphone will happily read out loud texts and emails and i can tell siri to reply and dictate what to say. So it is possible. Nobody should do it while driving though as it would be such a huge distraction. People should just put it on silent and sling it in the glove box then catch up when they arrive where they need to be. There is no need to communicate by phone while driving. None. Not voice, typed or dictated. Driving requires full attention.

If they made the penalty an immediate 12 month ban, the fine equal to the value of the car, and the car seized and crushed, you watch the phone use stop. The trouble, as with most crimes in the UK, is that the punishment is too lenient.

I'm with you on that. When a motorist has clocked up 12 points and is facing a ban, the courts look at the "hardship factor" as in will the person be able to get to work, elderly relatives, all the sob story stuff. Anyone with 9 points needs to take a serious look at their driving and immediate bans should be introduced. Actions have consequences.

@@geoffpoole483 The "hardship factor" isn't greeted so warmly these days. A lot of judges aren't persuaded in that regard and quite rightly take the posiion of (paraphrased) "You should have thought of all of that before you deliberately drove like a total pillock". Quite right too. I also think that totting up should be considered over a cumulative lifetime, rather than active points. Someone can get 3 points here, 6 points there, it all expires, another 6 points, those expire, 3 points somewhere else, those expire... and it goes on forever. They're allowed to continue driving because they never hit the threshold of currently active points to trigger a ban. I think that is something worth looking at also.

I agree it would reduce the usage of phones but it wouldn’t stamp it out. People just don’t give a fk. And what’s on peoples phones is far more important than the collateral damage they cause when they have an accident.

Just wondering why it would make a difference whether he was using messages or email? Use of a handheld phone behind the wheel is illegal, why even deliberate such a stupid point as a defence lawyer?

I think the defence wanted to angle it that way as a plea in mitigation in that he was apparently dealing with a family emergency, if I understood correctly. Doesn't look anything like that to me.

​@@CyclingMikey shocking that a barrister thought that they could argue a family emergency qualifies as the emergency use exception. Similar to the arguement the lad in his works van tried to pull a few videos back (he claimed to be responding to an emergency text from work, and was then shocked when he found out that he had admitted guilt and that was the end of his trial). My understanding is that the emergency use was well established as meaning use to contact the emergency services; and regardless, the wording was clear that even that would be an unacceptable excuse if it was reasonable to stop to make that contact. So IF that barrister was going to attempt to argue that there was a family emergency and it would have been unreasonable for the driver to stop in order to deal with it, he really should hang his head in shame.

@@CyclingMikey Am I correct in thinking that still isn't a valid 'get-out' for dangerous driving? Call 999 if there is an emergency. Otherwise you just add to the danger. I would suggest that, if it's something serious enough to warrant reading a text and replying while driving, it is worrying enough that it would distract you even more than the actual message. He'd be so worried about his family... And he wouldn't need to reply by text. He could call hands-free and say "message received, on my way, call 999" etc. But it doesn't add up. Why would you delay driving home for this emergency, sitting stationary on a road, messaging, while your family was in desperate need of you? I can't see any scenario where you'd be required to solve an emergency by text and it couldn't wait. Worst case scenario - say your toddler is calling because your wife has stopped breathing - engine off, hazard lights on, get out of the car and take the call. There is no scenario where it's ok to text, veer from side-to-side, and then zoom off at speed. I'm glad they didn't accept that nonsense. I'm also curious; if the court had entertained that defence "I was texting in an emergency", surely the defendant has to BE THERE to say that? They need to be available to be questioned about the emergency and all of the details. It just sounds like an exercise in time-wasting. Maybe they were hoping you'd be incoherent and flustered or angry. But even then your camera caught that behaviour and it was clearly not influenced by you. It's there for the court to see and there is no justification. Ramble over. Lol.

I’m delighted that the entitled stroppy fool got found guilty (I have no idea who he is anyway😀). To be fair, everyone should be entitled to defend themselves. I think this was a singularly pointless defence, but if you take away that right, it affects us all negatively. Shortest deliberation I've ever seen by magistrates.

The weird thing is, the guy wanted to take it to court. He could have just taken the initial points and fine. I suspect the fine is higher if it goes to court and you're found guilty. Going to court is not a punishment so justice was done in that he was fined and given points.

I pulled a driver up once before for talking on his mobile phone while driving and I got foul abuse of him what the hell has it got to do with you . I realised in my 40's that i couldnt do better. My concentration was bad. I was easily distracted. I had tired of driving and the rules of the road. I sold my car and havent driven since. I walk or use trains. Saved lotsa money and i'm saving the planet now too. 😊

His sense of entitlement when his barrister suggested that you targeted him because he was driving an Aston Martin! As a pedestrian in Hong Kong I agree that stationary drivers are not fully aware of their surroundings, even when a pedestrian is on a crossing. Mikey we need you in Hong Kong:)

He was for the most part, driving like a di€k. I was waiting to spot the flashy car as you rode along. As soon as the Aston came into shot, boom… it was obvious it would be that car. Since watching your videos I have also noticed the same thing, the flashy cars are defiantly more likely to be the ones on their phones

It's disgusting, really, that his barrister tried to discredit you and obviously felt this would hold sway with the magistrates. Even if you had recognised him, or even "targeted" him, so what? I'm a cyclist and a motorcyclist..........idiot drivers using their phones are a major problem.......the penalties are too soft.......1st offences need to include a 28 day impound of the vehicle in question.....irrespective of who owns or leases it........keep up the good work mate.

People don’t really have an argument in regards to stationary drivers using phones. A line needs to be drawn somewhere so that the law is 100% clear to everybody. If it was Ok to use a phone in stationary traffic, they would then say “well it’s ok to use it and edge forward….it’s ok to use it if moving slowly” and it would keep going like that etc.

Does seem dangerous having a powerful car accelerating like that, after not paying attention to the road. For someone that had been banned and then got more points, I wonder what it would take for them to get it? Maybe the press attention will make it sink in that doing this isn't a good idea?

Ive added his driving offenses to his Wikipedia page. The page mostly reads like its been written by his PR people. Hopefully all the bad publicity will make him think twice about his poor driving

Most of the drivers you catch are not displaying especially poor driving - other than illegally using the phone of course - but his driving was clearly noticeable, even at the low speeds of the traffic. Good catch.

Most drivers caught drunk-driving aren't a second away from ploughing into a pedestrian. But it's best to catch them doing the thing that causes the bad stuff *before* they do the bad stuff. People using phones aren't aware and are driving poorly by definition. Swerving all over the road is an extreme example but many of the people in these videos are completely oblivious that Mikey is even there. A lack of awareness, 100% distraction interspersed with small bursts of movement without checking their surroundings - that's dangerous, poor driving.

Clearly this first ban did nothing to change his behaviour so what the justice system thinks some extra points on his licence will do now is anyone's guess. Being caught for the same offence so soon after the first ban should be an instant second ban, but significantly longer. Also a disgrace he didn't turn up himself. Shouldn't be allowed to get away with that either. Thinks his time is more valuable than everyone else's. What a horrible person all round.

Isn't it amazing how when someone is caught breaking the law using a mobile phone they they show utter contempt. He should have been given another three points for the finger gesture. Something tells me that this won't stop him. He doesn't care about the law or people's safety.

Being stationary in traffic is not a good excuse to use your phone. Today, on a main road in traffic there was a guy on his phone in traffic. His concentration was such that he rolled about 2 metres before he realised. Luckily he didn’t make contact with the car behind.

Its clearly ingrained behaviour by the chap in question... the speeding is also a big issue with guy... borderling dangerous driving given the time of day...... he'll end up killing someone before he learns the lesson.

This case clearly shows the hazards of stationary phone use. Moreover, I think the pass at about 4:55 was a bit too close, what do you think? At least it looks like that on camera...

Yeah, it was a bit close, but I expected it and held left. It's a location I'm expecting such driving and it wasn't quite reportable. If the lane was a fraction narrower, I'd have held the lane through the junction and prevented it.

I have had people on phones in the middle lane of the motorway drift into me while on the motorway I being on my scooter or motorbike I have had a woman txting on her phone looking down also on the motorway she went across middle ,outer, inside before a wagon driver hit his horn while about two inches from her ,another woman ,this being my scariest momment so far joined the motorway M57 while on her phone doing about 70 ,I was in outside lane on my motorbike ,she was turned around in her seat and was shouting at her kids who were jumping about in the back ,she came across all three lanes ,I was on the rumble strip in the process of braking thank god the man in the BMW behind me slowed as well when like me he realised what she was doing he hit his horn she looked forward moved into the middle lane and acted like nothing was wrong I went up to he window and banged on it she would not look at me so I gave her merc the metal glove down her car , i realy thought she was going to kill me ,same in traffic as well it should be an instant ban using a phone

Frankly most motoring offensives should result in a permanent ban, or at least a three strike rule. I've been driving for decades and I've never crashed into anyone, never run a red light, never used a mobile phone, while driving, never gotten a speeding fine and never driven on the wrong side of the road to save 20 seconds. This is not difficult. It's not rocket science. Driving is a privilege, not a right, and a dangerous privilege at that. If you can't meet these basic standards, you simply have no business piloting a killing machine, end of.

The sad bit about this video is you saying "see you guys next time" The punshments for using a phone while driving are not severe enough meaning you will be doing this (thankfully) for a long time to come.

If he'd been disqualified recently it obviously shows an incredibly poor attitude to driving to get caught for the same thing again so soon after a disqualification had ended. Repeat offences like this really need to come with another longer disqualification before someone gets hurt.

Being a bad driver through low skill levels is one thing but messing around with a mobile phone whilst driving and diminishing already limited ability is another. I'm guessing these people are obsessed with social media platforms rather than just a phone conversation that could be conducted via 'Bluetooth' or whatever near field communication system they have. I would assume an Aston Martin has that sort of thing included in the price.
