These are some of the best pro se parties I've seen. They read the lease, knew the lease, and had pointed questions about the lease. They brought salient evidence. Bravo!

Seriously. Also, that landlord nearly made a huge mistake - he's basically trying to say that the lease premises include his entire farm property, not just the house. I guess he didn't think through the implications there.

The defendants did a great job with their questions. They did better than his attorney and he has been an attorney for 34 years. Doesn’t even know to ask for permission to approach the judge. 😂

The landlord took the stand with not one, but TWO manila folders full of paperwork and apparently nothing except the lease agreement was germane to the case. 😂

Absolutely. That was a not-so-subtle message to plaintiff's attorney that the lease agreement was garbage and he shouldn't have allowed his client to bring it to trial. I laughed out loud when the judge pointed out that the landlord didn't even get the leased premises correct in his lease. Bad lease, bad landlord, and bad lawyer make for a waste of everyone's time.

Bravo Judge Simpson! The defendants did an outstanding job in representing themselves. The plaintiff appeared to be trying to take the defendants to the cleaners and he did so by intentionally misleading the court especially with regard to the 'painters'. I think he was just mad that the renters challenged him on the four corners of the lease and the unresolved pest infestation in the house. This case had an excellent outcome!

Re. The paint job. The idea that the job is being done as a credit is belied by the fact he is asking for the tenants to pay. If he has applied it as credit to a debt owing, that other person has accepted responsibility for the cost. But if he is asking for it in court, he hasn't transferred the credit to said other person, meaning he hasn't paid anything for it currently. It seems to be either double dipping, or lieing.

Good landlords work to minimize misunderstanding and keep meticulous records. In the case of this plaintiff, it appears that the lack of records and unclear agreements was a feature, not a bug. Glad judge Simpson wasn't buying a bit of it....

I rented a home once that had a propane tank. My landlord filled it up before I moved in and I filled it up when I moved. Why is this so difficult for some? UNcommon sense???

The PLAINTIFF OWES THE DEFENDANT..talk about Sweet Justice… This couple played the game well, they crossed THIER T’s and Dotted THIER I’s and For once a tenant came out on top.Shame of that landlord and his ambulance chasing lawyer…🤯🤯

I think the plaintiff's lawyer is full of baloney. His claims at the end come very close to contempt. The plaintiff's atty should pay his lawyer, the defendants don't have to.

I am careful what I say about a litigator, but I wouldn’t be surprised if he gets everyone who rents from him with what seems like a scam! There are several honest ways to do it. Like, putting in the contract how much propane is in the tank at the beginning, and leaving that much at the end. It sure does seem like a grift. He can’t be that stupid not to know he’s trying to get his tank filled, when it didn’t begin full!

I have a neighbor like that, they charge every tenant for the same property damage every turnover. Even using the same old photos. When you rent anything, take photos and videos during move in, send a certified copy to the landlord and e mail to yourself and a third party. It’s a pain, but will save you thousands.

Wow that lawyer is pretty awful. The judge told him about as straight as he could without outright saying that he was going to side with the defendants. He gave the lawyer a chance to settle. Idk what happened out there of course, but I think if he would have just offered to drop everything in exchange for the security deposit, they probably would have gone with that. And he would have saved his client four hundred bucks.

What I hear is other people rented buildings and land on that property so they had a right to use the driveway most people that rent farm houses that are on Farmland don't get it So it sounds to me like he needs to rewrite his verbiage in the lease for the next renters on out buildings and driveway use, including if say 60 gallon propane when move in must be 60 gallon when you move out

You cannot amend a written contract verbally. It can only be done in the same form as the original-- in writing. Any ambiguities in a contract are *automatically* held against the party that drafted it. Legal Contracts 101. Edit to add: if the amendment is added, it has to be signed off by both parties. Disgusting how this attorney is trying to make a contract exist along the way through the argument of-- "well, I assumed they knew.."

If anybody sees this guy trying to rent a house, they need to run far far away do not rent from this underbelly of a landlord and just a piece of advice to anybody keep records keep check stubs keep receipts make copies. If not, you’ll be up against somebody like that.

All of the numbers aside (as they are clear as mud) the Judge is spot on that the discount makes no sense. Let's say you owe $1000 in rent and $500 for propane. You owe $1500 total. It makes no sense to say just pay me $1000 but do it in this contrived way... You're forgiving $500 so just forget the propane. If the propane was less then than half the rent then it's screwing the landlord. If it's more then it's screwing the tenant. When you add the fact that it was never clear how much the propane bill was, is or ever would be, it sounds like a scam to me. Then add the fact that it is just something the landlord claimed was agreed verbally, he still can't provide a clear paper-trail for what he claims is owed, and he's been caught running a scam with his friend for decorating services that haven't been completed. This guy is trying to scam people and should not be a landlord.

I love how thorough Judge Simpson is in picking stuff apart. Sneaky man and Attorney beat at their own game. Trying to get more money than entitled to. The man is eloquent in defending their point of view not owing everything claimed. If the painting was in repayment to the owner should not be allowed as the man is putting out nothing. 😢😢😢

Judge Simpson is always Fair what I don't like is when people rent other people's homes and don't pay the rent or utilities and leave the house they should always leave it the way they found it unless it was agreed upon to be able to paint or knock out walls anything like that people want to do that stuff they should take their money they pay in rent and put it into their own mortgage period 🤷‍♀️

They may have legit reasons, however, they didn’t pay. That’s the primary obligation of the tenant. They can bring everything else to court at a later date for damages.

Hope the owner did not pay this attorney for his representation. The owner is not well-educated in business dealings and does not understand a lot of the questions he is being asked. These are all things the attorney should have looked at discussed with him before he took the case. I don’t know which one knows less about what they’re doing. Is it the lawyer who is trying to be an attorney or the owner trying to rent a property? I think it’s a toss up. I kind of feel sorry for the good ‘ol’ farm boy who has probably always done things verbally and doesn’t even understand what he is trying to do when he does.

I love judge Simpson but he repeatedly lets horrible renters get over on landlords and lets them stay while not paying nothing. So basically he’s allowing them to continue to steal from the property owner. I watch a lot of court cases and he never gives landlords the same treatment as he gives renters.

This isn’t a squatter case. Judge Simpson gives tenants or squatters a longer time to move out during Michigan winters. It’s not just for humanitarian reasons. It’s also practical. Moving companies are seasonal, to an extent, in Michigan. It just makes sense to make the order to vacate reasonable rather than having another hearing where the defendant proves their move out was rescheduled by the mover due to inclement weather. Waste of time. Simpson follows the law and he pays careful attention to the lease. He orders evictions and large judgements to landlords every day. I do think Michigan should have better squatter laws. And I’m sure Judge Simpson would follow such laws.

I think it seems like he favors the squatters, but the landlords either have crappy lawyers or they don’t bring written or video evidence. Like he said, he can’t rule on hearsay.

Not really, if you watch the long form , he sides with the landlord most of the time, the cases you see like this are usually different, so there is more time he works with tenants since landlords didn't do something properly

Did you see the same case as everyone else? The landlord had a poorly written lease agreement which was the cause of all the confusion in this case. The tenants had paid the rent that was previously agreed upon and the majority of the propane. They said that the would have paid the rent but the landlord didn’t give them the bill or the amount that was owed. The tenants paid 1400 on the propane bill.

I think judge Simpson was wrong on this one. He repeatedly helped the tenants who hadn’t paid rent for months and helped them continue to screw over the landlord. Yeah the landlord may have been trying to hit them for more money but that man carried these lowlifes for months. So he is owed money.

He's not at all LL friendly, he allowed a tenant to stay in a place who was more than $15,000.00 in the hole and only pay $50 more than his regular rent every month. That will take over 25 YEARS to get caught up. He gave the tenant at LEAST 6 or 7 adjournments claiming he was hiring an Atty but never did.

Agree. The law itself is not landlord-friendly, either. It’s understandable that the law (and judges) want to protect renters from PREDATORY SLUMLORDS, however, those landlords tend to have several properties and can afford to hire lawyers to protect their interests. It’s the mom & pop landlords who only have one or two properties that they rent out and can’t afford an attorney, let alone to lose rental income, that get screwed over by the renter protection laws.

It's not a formal, jury trial. In small claims, regular rules of evidence doesn't apply, and a judge can ask as many questions before coming to a decision.

He is not an Atty there, he is the 1 to rule on the case and CAN NOT interject himself into it. That is being bias so go the hell.

I believe the young couple took advantage of the older man. The older man went with the idea that speaking agreements and payments (including a general and poor lease) was ok. The young couple of a generation that is used to paper and computers and thinks little of verbal agreements or disagreements. But in the end the older man learned a lesson. I bet he saves the receipts from everything now.

Ehhhhh...I mean i kind of see where you're coming from but the plaintiff trying to double dip on propane and then suggest they owe for a paint job off some sideways "painter owes me" tab is shady. The only way you can try and do what you're suggesting is only rent to friends or family.

Nonsense. The old man rented this young couple a vermin infested house with constant heavy equipment traffic up their driveway. Then he tried to charge them for a year’s worth of propane even though they were there only 4 months. And he tried to charge them $1700 to repaint after 4 months of tenancy with no evidence that there was anything more than normal wear and tear. The old man agreed to break the lease since living conditions were substandard but the landlord still thought he should be able to double the rent and charge for an entire year’s worth of propane.

It's not like written agreements and contracts are anything new. They were around long before that guy was born and as the older more experienced person should have known to put everything in writing. Besides that, his verbal agreement doesn't make any sense the way he puts it, as the judge pointed out.
