Just three weeks after Donna Adelson’s murder trial unexpectedly unraveled when her lead lawyer withdrew, the judge presiding over the case ordered that her two new attorneys can’t represent her either.
Leon Circuit Judge Stephen Everett on Monday issued an order disqualifying Robert “Alex” Morris and Adam Komisar over actual and potential conflicts of interest.
The order marked another twist in the murder of Dan Markel, the 41-year-old Florida State law professor and father of two who was fatally shot at his home on July 18, 2014. The two hired killers, an accomplice and Adelson’s son, Charlie Adelson, have all been convicted on murder charges in the years since.

The state has the right to call anybody they want to be able to prosecute their case. In this case, Charlie was being called in relation to an old convo that recently came to their attention with the seizures of some of Donna’s stuff after her arrest. It takes time to search all those things.

@Lisa-hc3uq no she was not telling the truth. At The day of jury selection, when the Markels were in transit, Everett asked about independent counsel. Morris said they were getting one. That was the young guy they pulled out of a hat that day. He talked to Donna, got her to wave and then Charlie's lawyers claimed that he never waved anything! This is why I'm sooo upset, especially for the Markels.

The person who benefits from all this is Charlie, and by extension his appellate attorneys Because this means that Charlie's appeal will be able to go ahead without Donna's case mudding the waters of that appeal. Assuming Charlie's appeal will be done within a year from now, as that will be almost 2 years from his conviction. Indeed, leaving withdrawing his waiver till the last minute ENSURED that Donna's trial would be pushed back as far as possible. So it is not inconceivable that the appellate attorneys were the ones who came up with this strategy. Charlie isn't really smart enough to have done so on his own. And Ufferman is said to be far far too good an attorney to have failed to see the conflict months and months ago, but is certainly a good enough attorney to spot that leaving his waiver withdrawal till the eve of the trial, pushes the trial out past the end of his appeal. I think Ufferman came up with this whole strategy. Remember the smirk on Charlie's face, in his "I'm back in Tally" mug shot. The person for whom this is BAD new is: Wendi. Why? Because within a year, Charlie's appeal will be complete and either 1. he will be getting a retrial. But this time he'll know that losing is a very real possible outcome. And he might REALLY want to do a deal. After he was convicted, he said he might as well be dead. He wants to come back from the dead, and if that means giving them Wendi - who his new attorney will tell him the TRUTH about, unlike Rashbaum and Donna - then he might well. After all, he was willing to throw Donna under a car, if not a bus, already. A new attorney will likely see how much Wendi has used him and thrown him away. And a new attorney won't have Rashbaum's weird loyalties to Donna - who wanted to keep Wendi out of trouble. Charlie still believed that Wendi was calling Donna all the time with concern about Charlie. He didn't know Donna was lying about that. 2 he'll have lost the appeal, and then the ONLY card he'll have left, is hoping that if he gives them Wendi, they might be willing to reduce his sentence. Either way, it is not good for Wendi.

@@Asidebar Ho ho. Than why exactly did Charlie's appellate attorneys make sure that Rashbaum was not allowed to continue as Donna's attorney? They weren't doing that for shits and giggles. They were doing that because, with his privileged knowledge, Rashbaum could have asked Chuckles things that would screw up the idiot's chances of a successful appeal. A lawyer without Rashbaum's privileged knowledge might ALSO be able to do that, indeed it is their responsibility to do anything to get Donna off, and if that means throwing ALL the responsibility on Charlie, whether Donna wants them to or not, that is what they'll do. Of course Chuckles appellate lawyers want his appeal to be done free of any mess from Donna's trial.

It makes me so angry that she’s here in Texas free as a bird and maybe making plans to flee to Mexico while Florida is making a fool of their legal system with the mess with Cashbaum. In hindsight, it looks like the defence, the prosecution, and even the judge have made mistakes. Errare humanum est. But there are 2 kinds of errors, and kne is better than the other. Tholis is the nature of Judge Everett's ruling on Donna Adelson's counsel. He's avoiding an appellate issue and even a retrial by conflicting out all of Donna Adelson's defence team. Should she be convicted, she'll appeal in any case. Ineffective counsel had a better chance of winning. Hence, Everett constrained her 6th Amendment rights in the interests of the efficient administration of justice, whilst respecting Donna Adelson's right to a fair trial. I learnt this lesson in 2000, after Y2K. One journalist wrote that everybody overinflated in Y2K solutions by fixing other mainframe software bugs under the same umbrella. I did precisely that - mea culpa. As journalists are wont to do he claimed that he knew better. What he failed to consider is the risk of underinvestment in a Y2K solution ; nuclear power stations exploding, and planes falling out of the sky. These imply a very dear human cost. So, I welcome Judge Everett's ruling.

Well….a plea of “guilty” could reduce her sentence and at 73 years old now the prison system doesn’t want to be paying for very old age medical problems. Plea of 10-15 years puts her around 85 give or take in prison…including time served. She won’t be well after 5 years in prison. I hope she pleas out. They will get a GUILTY on conspiring and solicitation.

Attorneys protect their own. One need not be an attorney to file a complaint and Rashbaum was violating client confidentiality by blabbing in a public elevator. He will be admonished and deserves a punishment. Attorneys minimize a serious Constitutional matter that would not have occurred elsewhere. Attorneys should know the law. No one in this case did, everyone looks bad.

Donna sb angry at DR not Charlie. DR should've known better. DA isn't a lawyer. Even if she waived the conflict, she doesn't fully understand the pitfalls of using DR. Not that I want CA to win an appeal, but he and his appellate attorney are right. Also, Morris filed a motion for clarification of Judge Everitts Opinion. So now we wait for JE reply.

@@allieGirl146 a lot of the you tubers are talking about it. It’s actually the subject of this post. I think a Reddit poster had all three pages that I could read through without somebody scrolling up and down through it. Nobody’s posted the exhibits that contain the 9/17 transcript that I’ve seen and I’ve been looking.

I have this question since I’m not a lawyer. If Alex Morris was walled off enough, how was he going to do the Opening for the defense and also participate in parts of the trial? What information exactly was he walled off from? Are we talking about Charlie’s information or Donna’s information?

Charlie's information. I believe they're talking about him being walled off from privileged information between Charlie and his attorney.

It’s really difficult for me to believe that Dan did not see this conflict coming. Maybe , out of sympathy for Donna or just didn’t want Donna to start with a new lawyer altogether. I think that was just wrong. Maybe, he should refund Donna.
