Well of course. Just like the realtor who represents the interest of the commission, these law firms are representing the interest of the settlement. They both just want their “MONEY!” It’s Interesting how the “conspiracy” in this case was proven by presenting evidence that by aversion or omission the brokerages in the suit did overtly hide the fact that there is no standard commission by way of culture and practice. The plaintiffs counsel presented training material that blatantly instructed agents to avoid verbally talking about commissions with their clients. So yeah, no question, this is just a bunch of buyers who realized just how much 6% of the sale actually is and didn’t feel it was appropriate (which it isn’t) and they are post negotiating what “was always negotiable” but never verbalized by agents 🤷♂️. The best value of this case is that smart buyers who pay attention will negotiate a lower commission.
Realtors and attorneys represent the interests of their CLIENTS, not the commission or settlement. In both instances, people willingly enter into a written contract while of sound mind. If you don't read the contract, that's on you. You can't come back after the fact and decide that you don't like the terms. NAR and associated brokerages did a terrible job defending against the lawsuits and we the people, unfortunately, are left paying for it.
I guess this conversation is between you and I so I’ll just say this. I got a kick out of hearing a realtor complain about someone being concerned only about money 😂. Point well taken, it’s buyers beware right, or i should say “buyers” beware, cuz your agent ant gonna tell ya. It’s written right in the contract 👍
