@@theAverageJoe25 Actually the USSC granted police Qualified Immunity to protect segregation in 1967, and further entrenched it in 1982. While the citizenry is certainly responsible for voting politicians in to office that want to reduce our rights to privacy, safety, autonomy etc... I'd argue there's a specific subset of citizenry that's uninformed (misinformed?) about actual policy and ends up voting against their best interest and with their feelings (often on a warped/inaccurate view of a single issue.)
She is F*cked and they are going to wisely throw her under the bus and use her as a scapegoat to try and curtail any further investigations into other possible instances of poor conduct by Police Officers and those in charge of them. The sad part of all of this is that it puts actual cases that involved REAL criminals and heinous crimes committed by them in doubt. That's the problem when a cop is actually "Bad or Dirty", it brings ALL their actions and those of other officers, mostly who are good, as well as their leadership into scrutiny and costs taxpayers a ton of money, and could end up getting bad people released back to the streets.

I would bet that it’s not the detective that is being so resistant to testifying, I bet it’s the prosecutor that doesn’t want her on the stand. Her testimony and credibility will be ripped to shreds thereby affecting every other case that her testimony had a significant impact on the verdict This leads to $millions$ in appeals, and it will just keep snowballing; civil rights violations, the costs in settlements, the costs in defending civil suits, and it goes on and on.
@@rebelchasershe doesn’t just get to decide, “I’m disabled, pay me.” If her doctor says she’s disabled, then she’s disabled. Getting access to her medical records would be nearly impossible, so to imply that criminal charges for fraud could be filed, highly doubtful.

This is horrible. She knows she messed up so they came up with a way to get her out of it at the expense of a bunch of people's freedom. I wonder how many cases like this are out there. Happens all the time for all kinds of bs reasons. I was falsely arrested and charged with accessory after the fact, judge signed off on a warrant for a complete lie (and it was flimsy even if true) and everything. Document said their "suspects social media disappeared" after speaking to me otp. Except when I searched it was right there plain to see, and our accnts weren't even associated. Detective actually even admitted to me in that phone call that they knew I wasn't involved thanks to surveillance footage, was right there in the transcript for the judge to see too. My sin you might ask? Requesting a lawyer be present while they question me. Apparently that made me an accessory and a dangerous criminal who needed to be arrested at their job and strip searched in the middle of a mall while families walk by. To make a long story shorter they also confiscated my phone during my arrest later saying they wouldn't give it back till my case was done, tho not before lying yet again and saying they would after getting the data and I gave them my passcode, and then took a lil over a yr to finally drop the charge and give me my stuff back. Paid $1000 for a lawyer that essentially did absolutely nothing too. I was too tired and broke to try and hold ppl accountable. My story is not uncommon. Our justice system is egregiously broken, I'm not one for doom and gloom but it is genuinely scary how corrupt it is.

Even if she were not well enough to work, she should still be able to answer questions in some way. Even someone in the hospital could be deposed and video recorded, in multiple short sessions if necessary. The excuse of not being well enough to testify is just absurd. I do not understand why any judge seriously tolerates that ridiculous argument.

@@Julianna1220I just talked about this in my criminal justice lecture, that media sources are cutting way back on reporter positions. This means in depth investigation of government activities will be less common. Media was one of the safeguards for police accountability.

If she is not in a coma, can speak, and can ride in a wheelchair she is able to go to the courthouse and testify. If she can't come to the courthouse Zoom can be used for her testimony. We all know what this is really about. She doesn't want to answer questions under oath.
I am a retired LEO of 30 years, was a Sgt. for 20 years. This former Det. is doing everything she can not to testify. If she can hold down a job and a second job, there is no reason she cannot testify in court. Her problem is, her testimony will show how inept she was, and my guess is her actions and lack of due diligence will cause all the other cases to be dismissed. What is worse, is how many people did she wrongfully arrest and charge. Who have been setting in jail/prison waiting to prove their innocence. When it all comes out, if she is found to have done all these neglectful things and jailed innocent people. She should be sued and sent to jail for what should be crimes of false imprisonment. She should have known what she was doing was wrong and be made to pay the price.
Right, and if any other defendant ( non LE) it a Judge would have ordered her in ASAP unless she was in the hospital. I'm not familiar with this judge and understand you need to go by the books especially if LE is involved...but what about 2 there justice system we keep hearing about??? Been proven many times dispite police and their illeagle actions citizens must be convicted guilty or not . The system is broken and corrupt . Reminds me of a case I heard of in the national company I worked for where the employee went out on a medical disability and then a month later they caught him re-roofing his house. too physically debilitated to come to work but well enough to roof. He was terminated.
Ms. DiPonzio does not appear “too unwell” to be deposed; appear before the court; answer questions regarding her failures as a detective. She certainly has not been too unwell to work at other jobs which include all the activities required to appear before the court and answer any and all questions related to her questionable actions as a detective. Meanwhile collecting disability and/or retirement benefits paid for by Arizona taxpayers. Please investigate this seeming fraud and hold her accountable to the fullest extent of the law.

Don't understand why physically working on a job is ok but answering questions is a nogo. If she can work a job, she can answer questions. I could understand if she was bed ridden, but she is going about her day as if nothing is wrong. She just doesn't want to get into trouble and I don't think that is right.
Her lawyer seems to be present in form and matter since she is required to do certain things at certain times. Otherwise, she seems to not care about this legal matter.

This is going to traumatize many survivors. This one person has possibly contaminated every case she ever touched. If she could not do her job properly not only she should have stepped down but her supervisors should be investigated to the dereliction of duties. What a wicked mess this shall be. Supervisors are more at fault. Should've taken action sooner to keep the damage minimal. Not to realize the weaknesses of the employee to do simple tasks is infuriating. Total lack of accountability.
So she can just declare herself disabled and retire, but I have presented medical evidence I am disabled for years, yet the Social Security Administration refuses to award me benefits. The corruption is deep in the system.
My father was diagnosed with early onset dementia. He was unable to work as a mechanic. And would get turned around in the neighborhood that we've lived in for over 30 years. If he cant find the front of the store, he starts to panic. Applied for disability SS, denied twice. Got a lawyer, which they did ABSOLUTELY NOTHING, Mom did all the foot work. After 3 years, MANY MANY Dr appointments (his and the governments), attendance to several hearings and lost family home of 30yrs, he received a retro check. But over the 5yrs it took to get it, they lost home, car and with their health declining, more bills. So now they are living paying nearly $1700 to rent a house, instead of owning their own home that they owed 60,000 left to pay off. Also don't get me started on the VA, as my Father is a retired Vietnam, Desert Shield and Desert Storm Airmen.

Yes, sadly that is the fact. Imagine if half the cops here in the PPD were sentenced for their coverups/crimes but about 98% of those corrupt cops just get a slap on the wrist. It's just frustrating and annoying to witness how they take advantage of the "qualified immunity" and the police union when they have to actually face the consequences of their bad policing.
This violates the Constitutional Rights for the alleged offender for due process. If the cop can’t (in this case won’t) testify, it’s time for the judge to dismiss the charges against the subject waiting for trial. With prejudice so the DA can not refile of and when that officer has the courage to show up for court.

What I got from the story is that the defendant has already been found guilty at an earlier trial. He is now attempting to appeal the case based on new evidence that the detective allegedly was sloppy with investigations and evidence, and there may have been several people working to cover it up. It seems there are others, who were convicted, who are also waiting to appeal their cases as well. I am sure some of them deserve to be in prison, but not if police did sloppy work and lied to get the conviction. Thank the free press in this country for exposing corruption on all levels. Without it all of us would be at risk of being sent away just because someone in power didn't like us.
The county attorneys office can issue a subpoena, but it wouldnt help their case. So they would rather stay quiet and protect her. She is now a civilian, issue the subpoena and if she doesnt appear for court then a warrant can be issued for her arrest. She isnt above the law!

This is insane, how can someone work as a therapist and simultaneously have such a servere health situation, that one can only assume is mental/emotional? I’m having trouble understanding the legal aspects of this. And all these Cases in question or constitution has the burden of proof to prove guilt is on the state. You also have a right to a speedy trial. Using these two concepts, all of these cases should be dismissed with prejudiced against the state. It’s quite clear. In general mentioned situation brings the judges in cases with Phoenix detective into difficult situation. Even lawsuits can start now on constitutional laws, laws for prosecution, court process laws and civil rights. She has to answer or the police department and city have to compensate all, who filed, because of that one detective, lawsuites.

It always shocks me when Police not only give excuses a 4 year olds try but are allowed to use. How in this crumbling Republic of ours could a citizen avoid legal responsibilty with any type of pathetic excuse like " I am too sick?"

Not really most cops hate going to these court cases irregardless who they are and no matter how good they are most of them to try to find ways to get out of them because they're complete board fast. Not to mention a complete waste of time I was a jury before and one of these cases they called the cops in and then never have him testify for anything wasting the cops time.
Unless she's comatose, adjudicated insane or has no ability to speak she's liable for contempt charges at the least. Then there's tampering, fraud, and probably a few others.

That's not fair to the defense that can't cross-examine her. Plus her husband being the Assistant Police Chief & helping push her paperwork through the system to allow her to retire & claim this feels corrupt too. Also that _very precise language_ her attorney used caught my attention to("this is just what I've been told & the information I've been provided") makes it seem like she knows this entire claim is BS & she doesn't want to get herself in trouble by lying to the court/judge. This whole thing seems extremely shady & corrupt

Oh! I am going to predict they are going to appeal, they will drag this on as long as a find a judge that will allow them to. Those 30 some odd defense attorney's need to pool their resources and get some PI's to watch every move that former lady detective makes.
They can't do that as it would be seen as witness tampering. The defense has its hands tied. The doctor saying she is disabled is a better target if investigation.

U can be disabled and still work. U can't be disabled for hip problems and out there playing basketball for a living. With that being said, she needs to get her arse in court and testify or go to prison
@dooluv5769 If you're receiving disability payments from the government, you can't work. If you get caught working while on disability, it gets revoked and you will probably be prosecuted for fraud.
Everybody is forgetting justice for the people in prison for their day in court. Guilty or innocent Justice should be done and if not should be released .
She probably screwed up real bad and they're trying to cover it all up by keeping her out of court and using this thing as an excuse. Otherwise, she would be responsible for having to overturn a bunch of cases and they don't want that the system has to look better than it functions
There would be no medical reasoning beyond being in a coma that I would accept as a judge to keep her from testifying. I would like to know what kind of medical issue she is claiming that is so bad she can't show up in court but still allows her to work two jobs.
