So your claim that the DOJ had already denied Trump's petition to remove the illegally appointed special council has no merit or standing and carries no legal implication for Trump. The DOJ denied Trump's challenge to the appointment of the special council. Trump's petition to the court is to have the case dismissed in totality due to the illegal nature of the Special Councils appointment. But by all means, put a spin on the story so that you can continue making fake news. At this point the only thing keeping your ratings up is by mentioning his name. You know it. I know it. Everyone knows it.

You do know Jack Smith is the first attorney to prosecute a POTUS who refused to give back classified documents, so, who would have more experience than Smith?

Whats going to happen next is Cannon will request written arguements be submitted in the next 30 days, after which she will take 6-8 weeks to review and rule on it another 2-4 weeks later. That should bring us to just before election day, at which point she will either entertain another motion based on dream logic or saybit's too close to an election to hear anything else until after the election is done. There should be a post-grad class on running out the clock, and this should be the main rubric.

There is no federal statute that establishes an Office of Special Counsel within the Department of Justice and there is no federal statute that authorizes the Attorney General to vest criminal law enforcement power in a private citizen (like Jack Smith) just because the Attorney General calls him a Special Counsel. Law enforcement power is vested in 94 US Attorneys who are nominated by the President and confirmed by the Senate. Each US Attorney has authority which is limited to the jurisdiction in which they were appointed. Jack Smith is not a US Attorney; he was not nominated by the President or confirmed by the Senate; and he is acting outside the jurisdictional boundaries that apply to US Attorneys. The basis for his appointment appears to be internal Department of Justice regulations established by Janet Reno but, without a statutory basis, these regulations are arguably illegal and perhaps unconstitutional. That would make Jack Smith’s appointment illegal. If Jack Smith’s appointment was illegal, then everything he did is invalid and that includes his prosecution of Trump. This argument is a big deal and Judge Cannon is required to address it even if you think she is a bigger dope than Judge Engoron (which is probably not humanly possible).
