Justice Gavai is bold & fair in his judgements. Fair decision on national interest matters needs lot of guts to deliver which can't be seen in present times. In the eyes of public, Judiciary these days has become a questionable organisation. They behave like Superman when judgements are to be passed against weaklings & common individuals, bashing them left & right by imposing hefty penalties, fines & imprisonment but when judgements have to be passed against powerful accused/ system they take cover under all kind of interpretations of law & judgements to give relief & dismissals in the cases. Lot of hue & cry was raised against misuse of EVMs in haryana state elections results about a month ago. EVMs results were totally opposite to what leading newspapers "exit polls" had predicted giving clear 2/3 rd majority to congress & wipe out of BJP. Elon Musk internationally known expert on AI electronics matters says EVMs can be manipulated easily. On that people say elections commission of India & even CJI was not fair in his decision of blindly throwing away PILs on the misuse of EVMs matters.
Even Congress is not stepped back from the EVM allegations. Now they are set right own system. Everyone knows due to internal conflicts and excess onus on led to Congress debacle. Even opposition parties blamed Congress leadership but not EVM.
Excellent take by Kapil Sibal. Forget about whataboutaries, his concerns are forward looking and good for indian democracy and its citizens. Will the government and SC walk the talk. Well done.
Looking at Sibal's performance in a circus of political and Judiciary intertwined, I must admire his dexterity regardless of what the majority may think about his integrity as a politician, a lawyer, or even as an upright citizen of this nation, called Bharat! Iss duniya me teen tarah ke chor hote hai, sabse beheter woh hai joh chori karta hai, phir bhi pakda nahi jaata (PAKDA GAYA SO CHOR NAHI TOH SAHOO), dusara uske niche hai joh pakada jaata hai, aur sabse ghatiya woh hai joh mun se chori karta hai jisse chori karne ki himmat nahi hai. Some may view this as an explanation of my appreciation of Mr Sibal perhaps!
Mr kapil is unable to fix matches anymore and has been pushed to the very boundaries of relevancy, this is his last resort to justify his inadequacies and failures but i am sure mr kapil will be unhappier when something good will come out if this churning and judiciary will be made answerable. Perhaps then only we wont have orders that justify marriages of a 15 year old child or polygamy.
The dum Kapil Sibbal is so daring to criticism on the judiciary. Who is Kapil Sibbal, who makes money on politician cases and accuses ruling government. Kapil should be arrested for contempt of court
Kapil sibal only senior advocate oa apna ap ko cji man rahi hai congrass party ka kam kar rahi hai ya ham advocate ki tara kam kar rahi hai oa ak siner advocate hai judiciary ka ak party apna hi judiciary ko rajaniti ka liya badnam kar rahi hai oa advocate kahala ki layak nahi hai bahar ho jao hamara profession se
It is easy to look at others and cast judgments because we are intellectually dishonest? Perhaps, Law Chakra should sponsor a conference or two for eminent jurists to educate the masses without referencing existing cases. I am totally detached from the scene and have very little knowledge of processes - legal or politics. The RG Kar hearing got my attention, and I was stunned at the proceedings. Perhaps, we can get the "justices" to explain to us how the public's perception (except for the case backlog - it took 35+ for the court to issue an eviction order for a tenant who let alone had not paid his rent since then but also defaulted on municipality taxes) can be made more positive. Kolkata HC was always synonymous with a tourist landmark for visitors from a neighboring country (in my more youthful days!) but it has to play second fiddle these days. What legal principle invites that usurpation?
