Kaduppam Kurachu : ലിവിംഗ് ടുഗദർ ബന്ധം നിയമപരമായ വിവാഹമല്ലാത്തതിനാൽ ഗാർഹിക പീഡന നിരോധന നിയമത്തിലെ 498 (എ) അനുസരിച്ചുള്ള കുറ്റം പങ്കാളിക്ക് ബാധകമല്ലെന്ന് ഹൈക്കോടതി. ലിവിങ് ടുഗതർ പങ്കാളിയെ ഭർത്താവെന്ന് പറയാനാകില്ലെന്നും ഹൈക്കോടതി വ്യക്തമാക്കി. എറണാകുളം സ്വദേശിയായ യുവാവുമായി ലിവ് ഇൻ ബന്ധത്തിലായിരുന്ന സമയത്ത് ശാരീരികവും മാനസികവുമായ പീഡനത്തിന് ഇരയായി എന്നു കാട്ടി കോഴിക്കോട് സ്വദേശിനി നൽകിയ പരാതി റദ്ദാക്കിക്കൊണ്ടാണ് ഹൈക്കോടതി ഇക്കാര്യം വ്യക്തമാക്കിയത്.
The High Court held that the offense under Section 498(a) of the Prevention of Domestic Violence Act was not applicable to the spouse as the relationship of living together was not a legal marriage. The High Court also clarified that a living together partner cannot be called a husband.

ഇയാൾ എന്താണ് പറയുന്നത്? അവർ ഒരുമിച്ച് താമസിക്കാൻ തീരുമാനിക്കുമ്പോൾ അവർ എന്തൊക്കെ ആണ് സമ്മതിച്ചിരുന്നത് എന്ന് എങ്ങനെ മറ്റുള്ളവർ അറിയും. കാലം പിന്നോട്ട് പോകുമ്പോൾ ഇങ്ങനെ സംഭവിക്കും.

even in marital life men have been tortured by wife, by misusing the law ,by stating false mental cruelty and all..and through out the entire life men need to take bail from police station,court and need to pay for advocates and all burden to them…and wife can simply sit in their home and enjoy watching TV with their loved ones…government will work free for them…there is no provision fa men to file even petition against misusing the law by wife and wife house

ഒരേ തെറ്റിന് ആണിനും പെണ്ണിനും രണ്ടു നിയമവും നിയമവ്യവസ്ഥയും ആണ് ഇന്ത്യയിൽ. നിയമങ്ങളിൽ ജൻഡർ ഇക്വാലിറ്റി കൊണ്ടുവരണം. മാറിയ കാലത്ത് നിയമം മാറട്ടെ അതല്ലേ ശരി. ചർച്ചക്ക് തയാറാകുമോ മാപ്രകളെ? അതോ സ്ത്രീകൾക്ക് പ്രശനം വരുമ്പോൾ മാത്രമേ ഈ നിയമങ്ങളിൽ മാറ്റം വരുത്തേണ്ടതുള്ളോ?
