Trump didn't have time to prove that the story about him fathering a child wasn't true before the election. It would probably have cost as much to hire private detectives to investigate and there was risk the story would break before they could disprove it. I remember hearing back before the 2016 election about Karen McDougall,the doorman, and Stormy Daniels. They were in the news cycle, then I wondered why it suddenly just stopped. By that time, I had figured out Trump was a pathological liar, and nothing he said was the truth, so I stopped listening to him flapping his lips. Mainly because you couldn't trust him. Yes! If I make a contract with you to do something illegal for me, but later you decide not to do it, that contract is not legally enforceable. So why is it legal to make a contract to cover up a crime, with someone who depends on you for their job etc., and can easily be coerced to sign? That does not seem right at all.

I don't know that the DA needs to prove that the stories are true, only that DJT and election team and company believed that the public would believe it and it would affect how they would vote. In my country, it’s common for company’s who don’t want their reputation damaged. To arrange a non disclosure agreement with whistleblowers and bury the story. The elephant in the room in your case is that it took place in an election year and concerned a presumptive presidential candidate.

An NDA cannot be used to cover for illegal activity; or to cause potential harm to the person subject to the NDA. In Daniels case there was also the legal loophole that the lawyers for Trump mentioned the NDA publicly first.
