If what Sunset is saying is true, it doesn't sound like a case of stealing or copying. If Sunset is going viral and Indi didn't, then I think that's why she's upset. She didn't get same attention for hers. Maybe a few years ago people weren't as interested in color foundation. Sounds like Sunset is open to a proper discussion. All companies have similar products. Whether it is product or packaging.

100%. That company is going viral and she’s jealous. It sucks for her and I get that. To be fair if she launched the product 3 years ago it was probably the worst timing imaginable and of course it had no chance of going viral. No one was looking for make up let alone festival/stage style makeup during May/June of 2020. Good time to launch skincare or multi-use 5 minute face kinda stuff. But most of us were wearing just enough to avoid looking dead or hung over on zoom. We didn’t have the bandwidth for anything more and we certainly weren’t planning elaborate looks for any sort of special events.

The packaging looks like generic basic packaging that brands can add their label to. I feel like it would be a bigger deal with a truly custom component, but it looks like a generic container. But thats just my interpretation and I'm not for/against either company

What really gets me with the color foundation story is not starting communication with email to begin with and then refusing once seeing socials have been blocked. As a 28 year old, I don’t understand when it started for businesses to discuss issues over social media instead of email.

And the fact that she's publicizing the issue through Jen without ever having even attempted to reach out on her own deffo lends credence to the idea that there was social media bullying tactics being employed. Think of literally any news outlet story about bad brands and it ALWAYS starts with here's the list of things the wronged party tried... and in this case it was nothing. She tried nothing and is just campaigning to expand into Jen's audience for folks willing to fight on her behalf.

To be fair, the packaging is just typical generic cheap packaging. I don't think they're copying, they're just trying to save money. And for the shade rage, they used regularly known colors. Just like crayons and markers lol. You don't see them sueing one another. On the other hand, I still understand her feelings and how'd she be mad. It's normal feelings that most people would have, but she's letting emotions take over instead of thinking logically. Which is understand, but it doesn't mean it's right either

I don’t understand thinking that making multi-coloured foundation/paint for the face is original. I’m sorry. In my opinion, there’s no basis for claiming it was copied. When they were given the option to email and discuss privately, they chose not to. So, genuinely, how do they want to resolve this? They can be upset, but if they aren’t willing to make moves to better understand the situation, they should leave it alone.

I don't know if you can say someone stole your shade range when they're just... the colors of the rainbow. Sure, there aren't a lot of colored foundations, but if someone does make a colored foundation, that seems like a very intuitive place to start.

Genuinely curious and not disagreeing due to my lack of knowledge in the area of stage makeup. I had always been under the (possibly incorrect) assumption that stage makeup of non-skin tone colors had a heavier cream makeup texture to it? Not quite like a foundation meant to be closer to skin texture, which is what the Indi Beats and Sunset foundations are trying to do. Was my assumption of stage makeup wrong?

Copyright - when u have a new innovative idea, get it copywritten if at all possible. Or at least apply and date the application. Does seem like bad communication and generic packaging but a little conversation between these brands was definitely needed. Behind these brands are hard working real people with real emotions. Hi Jen, re the lawsuit against Kylie Cosmetics, there are state labor laws that typically allow a fine per day that an employees wages are late. So perhaps that is how the model determined the amount. Also, re the color foundation that packaging is available for anyone to purchase on Amazon. I purchased some to custom mix some of my own foundations or repackage my face products that didn't have a pump.

Sorry Indi Beats, but it's very plausible to independently create a rainbow foundation and put it in generic packaging. I'm sure both companies used that packaging because it wasn't custom. If your formula holds up, then it can also thrive. I'm sure the shades aren't identical. I've watched YMS's video about Kimba the White Lion enough times to know that copying isn't necessary.

Re: the colored foundation, when both brands independently came out with the same colors in the same packaging, my immediate reaction was "private label". Tbh at this point, if you can't/didn't trademark, copyright, or patent it, it's fair game to whoever marketed it better. I'll be over here still using my Danessa Myricks and Suva Beauty primary color silicone based paints and all the other pro brands, lol.

This lady getting upset, that someone “copied” her reformulated face paints - by also providing a basic rainbow set in generic packaging - is really irritating me. Painting your face in non skin colours is something that’s been done in theatre ever since there’s been theatre. She found a vaguely different way of putting it on the skin, though I could swear that I’ve done something fairly similar when getting ready for productions. I guess that makes it more accessible to people used to only applying foundation…? Just…honestly…I’m more irritated by this, then I should be.

It's called due diligence. Just like looking up patents the responsible businessperson looks to see if it has been done already then takes steps to differentiate theirs from others. It has been upheld in courts that the difference must be readily identifiable. Not hidden nor too subtle . Any main difference being subtle can be, and is, construed as being deliberate subterfuge. Thus evidence of malice.

If the original product is distinctive, which maybe it was, but we don't know that. It just sounds like nicer face paint, which always has been around. Did the person who complained use a particularly specific foundation base? At least the current company seems to have a specific foundation base they widened to include non-skin shades. Actually might be something i would want to try for halloween instead of the heavy, sticky stage makeup, if i ever want to be a blue faced druid or smurf.

I worked for a large corporation before I retired. We NEVER provided recommendations - only dates worked. If you gave recommendations to some people, the inference was bad if you didn’t for other people. Then you get sued. The solution? No recommendations EVER

I love IndiBeat and she really has tried to get her brand to be steady and successful and I can see what a gigantic bummer it is to see the exact product go crazy viral. As a side note and an older person's observation: you will have been consistently told work hard and you will succeed- but no one mentions how bad luck and good luck and serendipity will also strongly factor. Do I think Sunset SPECIFICALLY saw Indi and copied, not likely. They likely knew that some brands did color foundation and decided it was a good idea.

As someone who makes bath and body products using wholesale packaging anyone has access to, I fully understand that someone could make very similar looking product. Now if someone had copied my label, exact scents, formulas, product names, then I’d be suspicious. At that point too, I would give another small business the benefit of the doubt and reach out to them privately first to discuss and then decide the most appropriate course of action. There also only so many original ideas, and with something as basic as a rainbow face paint…eh, the circumstances would have to be just so to think someone is copying (like what I stated previously).

IndieBeat really doesn’t have a leg to stand on here no matter how you look at it. First off, they are far from the first brand to offer colored foundation (Kryolan comes to mind). Second, they claim they copied their shade range when both brands just went for the basic rainbow shade range. Third, they can’t exactly claim getting blocked was a shady move when they threw the first stone by putting their brand on blast to their entire audience and subjecting them to hate from their consumers. They should’ve been the ones to contact them with their concerns, not the other way around. Fourth, the packaging from either brand is just generic foundation packing that many brands have used a comperative version of. I understand that it’s frustrating when a product that is similar to your own ends up blowing up and yours doesn’t but sometimes that’s just how the cookie crumbles and as a business owner, you can’t start beef with the other brand unprompted if your claim is unsubstantiated.

I'm from Europe and seen those Essence products for months. I bought that pink brush set in March I think. And it wasn't new. Who in Essence is responsible for this all over the place products? The packaging looks private labelled tbh, and since Sunset's regular skin tone foundations use the same packaging I doubt it was an intentional ripoff. I also don't think colorful bases are THAT novel of an idea that nobody else could have come up with it. But we may never know for sure whether anything shady really happened

Y'all.... I just found out this because I was perusing the Ulta sale after it being mentioned on here. The Neutrogena gel moisturizer with hyaluronic acid costs $30 bucks on Ulta. It is $15 at Walmart! What is Ulta thinking?!?!?!?!?!?!? Holy cow.....

I definitely have those same foundation bottles for de-potting, I feel like something so generic can’t really be “copying”. I understand indi beat’s frustration but I guess when you don’t trademark or patent, the makeup community is SO HUGE that there’s probably no way sunset makeup intentionally knew about IB product and so many people make colored bases and products I truly don’t think it was intentional.

That poor girl did not give consent for her image nor did she receive any compensation for their indirect advertisement to buy their brow products. Hey! So I work really closely with the benefit counter at work, and the new vacay duo’s are the same size pan as the mini’s. The mini’s are £15.50 each and 3 for £30 and the duo’s are £22, so a decent savings really!

Lots of makeup drama this week - the Kylievlawsuit seems odd but doesn't surprise me. The face paint thing is also odd in that you really need to copywrite/patent products and never go for generic packaging because that's how to separate your products from a competitor. I might check out that green eyeshadow compact from Essence. Not interested in the Nyx Barbie stuff - cute but I'm not a fan of their products. The Sigma palette looks interesting. I will pass on the Rick & Morty collab.

Hasnt LA Girl had foundation mix ins in bright colors for forever... the only difference in the packaging too, is that its black and not white. It literally looks like a white label component that anyone could order from a factory. Surely Indi also got her packaging this way, so whats stopping literally anyone else? Most indie cosmetic brands have the exact same packaging outside of the label and any art outside of it, because its whats cheapest and most easily accessible. I dont know, sounds like Indi is just butthurt about it tbh. Sounds very unprofessional too?

I like the idea of a color change beauty blender for travel. I never want to put a partially wet beauty bender in my bag and increase the risk of mold. So it would be a good indicator maybe to help.

The ‘Beauty Blender’ one only changes colour when it’s warm, though- so would be the same colour cool/damp as cool/dry. But maybe there’s one that changes colour when it’s damp?

With the Kylie model thing wouldn't the check go to her agency to then pay her? Agencies are famous for not paying models in a timely fashion. The colored foundation thing is ridiculous, neither one of them invented it, and the brand whose video went viral was already using that packaging for years including for the white foundation , they didn't copy anyone. I don't blame them for blocking the other brand due to harassment from their followers. I probably would too.

I can understand why you would be put out if someone else's product got more attention than yours when you felt like you had a unique product. That doesn't mean she has any right to call out Sunset makeup because their product was more successful. Coloured foundations have been out forever in different formats, it's not a new concept. I also think the whole packaging argument is completely irrelevant when so many Indie brands use generic packaging for their products in order to save money when starting up. I have seen so many brands do the same products in the same packaging, especially multichromes shadows and pigments etc. Part of me thinks Indi is being so dramatic about this because it brings attention to her brand and it could bring more money her way. After this though, if I were to purchase a coloured foundation, it would be from Sunset Makeup because I feel like they handled the situation way better and I think the hate aimed towards them is so unnecessary.

I know that story about the model seems kinda sketch but at this point, I don't trust Kylie Cosmetics for anything. My guess is that she had to do more work than she was hired for, worked in a sublevel environment and with rude people. She probably remained professional and hoped for the recommendation for going beyond what she should have and not getting paid on time was just a all a part of it. What she's asking for seems like a lot but there's probably a lot more to the story we don't know about

Did everyone get a rules guidelines prompt when commenting today or just me? Hmm okay. Kylie model contractor.. it’s overkill for me. Having been an independent contractor myself I understand ensuring you are paid and I’ve been paid late. But I’m also curious about Kylie’s people saying she was paid on time. I think they are overreacting. Upset that they didn’t get the same level of attention to their brand. Yeah it would totally hurt to see someone with a nearly identical product (respectfully, very basic colors and basic packaging so that doesn’t help) doing better than I was but that’s just the nature of having a business. Hopefully they reach out via email and have a reasonable conversation with them. I would totally hate to be a brand owner or singer now. There’s only so many colors and notes folks.

Sounds like indie beats is upset and jealous. Sunset tapped into her target market market and knew it would be cosplayers and goths using her makeup the most and she made videos targeting their interests. Also Sunsets foundations are $12.99 and indie beats is $20-$45 so that also plays into it.

In my opinimn, the packaging is generic and probably lab provided. Rainbow face paint in general is not new, and neither is colorful foundation (remember pigment additives?). The owner of Sunset seems pretty sincere and also stated she will stop swarching the red face paint on her face since it can be seen as hurtful as well. I can't imagine they'd purposely copy. Rainbow is not easy to differentiate st this point. Edit: the other thing that irritates me is the owner India refusing to reach out professionally first.

Can we just stop talking about "skincare" in our makeup products!! ● IF you DON'T wear primer or sunscreen or moisturiser then, YES, you might benefit from the small percentage of skincare within a foundation. ● IF you DO wear one or all of the above mentioned then, NO, you will not benefit from any skincare claims. ● WHY? Well, the products mentioned are occlusives - meaning they create a seal. Nothing can penetrate from below or above this seal, so any skincare ingredients in any product applied after an occlusive cannot "get through". I love that there's a "revolution" at Revolution 😅 Imo, the coloured foundation is "fair game". No brand has a monopoly on what other brands do/do not create. Had the original creator advertised the heck out of the products, then they would've benefited financially. Unfortunately, they didn't. Much love 💚💜💚💜💚

Actually, you are wrong. Unless there is Petrolatum or mineral oil in the "occlusives" you mentioned active compounds can penetrate although the rate will vary. Why? Because Petrolatum is 99.99% occlusive. And mineral oil is highly occlusive as well. Oils from plants, which are organic fatty acids (organic as in organic chemistry) are not very occlusive neither are plant butters. So, something like retinoic acid or adapalene can penetrate and derms encourage patients who are sensitive to these active compounds to apply them after moisturizer. They can still penetrate and go into the stratum corneum but not at the rate they would without the moisturizing layer underneath.

Also, primers and sunscreens and moisturizers can have not just occlusives in them but also humectants such as glycerin, hyaluronic acid, lactic acid, glycolic acid, gluconolactone, beta-glucan---anything that has hydroxy moieties or that has moieties that can undergo hydrogen bonding with water molecules.

About the colored foundations. Three words....MAC Croma Cakes. It's been a thing for decades. Also some pro brands offer these in cream form for decades. The brand motives. Prescriptives even did something kinda like this. Neither of them invented anything. Primary colors are part of making foundation. When you buy stock packaging, it doesn't mean it no longer available for anyone else. Sorry, I dont agree with her claims. Business success in an over saturated market come down to marketing and luck of the draw. She got unlucky. That's it.

I can understand a company/person feeling backed into a corner when they’re getting so much hate even after explaining themselves. I personally wouldn’t block the other company tho. If i wanted to stop the hate i would go to the source and have a discussion with them and come to some sort of understanding. Sometimes the two sides just need to talk to each other. But, not being in that situation, maybe she has her reasons for not wanting to deal with the other company. Hope they can see eye to eye.

I think that the similarities between the colorful foundations are significant, although I understand that they both used the packaging because it is readily available. That being said, based on the response of the owner of Sunset Makeup, I feel that they’re not being 100% honest about blocking the other account because they decided to respond through comments and not reach out directly to the other brand owner. IMO Indi Beat Cosmetics should not have encouraged their followers to go and attack/accuse another brand of stealing a brand. Both parties could have handled themselves better. Unless you patent a formula/product, you can’t claim that someone copied or stole your idea because you don’t own it.

Regarding the foundation, i think its okay to be concerned about someone stealing your products. However, I would think the professional route to handling the situation would be to contact the company personally via email, phone, or whatever other method they have established first. Refusing to do so because they've already blocked her on social media doesnt make her any better than them. The other company probably didnt handle it well either but they are just trying to run their business. It was up to the plaintiff to initiate contact in a professional manner. If they chose to be petty after, then that would be a different story. At this point, i wouldnt even think a lawsuit would be taken seriously because of how it was initiallg habdled.

I'm also stocked that dominique cosmetics has made proper Ash Blonde pencils being as pale as I am with auburn hair on blonde lash/browns still I find even the palest shades in most brands WAY too harsh for an everyday look. Most days I'm not interested in Glam makeup which is what these pencil shades give me. I want something soft because I have low on the browbone brows. lol

I won’t get getting the Glamlite R&M collection. I still haven’t received my Scooby Doo 2 order and Justin Roiland (the R&M creator) had DV charges against him. They were dropped due to not enough evidence, but I’m still not buying it. I hope anyone who does buy it enjoys it.

in regards to that massive essence drop, we have most of those products already here in south africa and i have to warn you all about the colour-changing positive vibes blush. it’s pure grease on the skin. however, the essence baby got blush cream blush and bronzer sticks are incredible. cannot recommend those enough.

Feels like everything is a copy of what's been before. You get knew ticktok trends that are actually things people have already been doing for years. There's also only so much packaging and colours available that similarities would occur? Copying is bad but also super hard to prove and more unlikely in this case.

Honestly I think the colored foundation is just a misunderstanding but that type of product going viral is probably the best thing for both brands. Even the original brand that was doing it could start making more sales. If it was a big brand doing this to a smaller brand it would be a diff story.
