The appellant, Mr Flaherty, between 21st November 2017 and 12th December 2017, stood trial in the Central Criminal Court charged with offences of rape, s. 4 rape (oral rape), making threats to kill, and sexual assault. Following a three-week trial, he was convicted of the offence of sexual assault. Subsequently, on 9th March 2018, he was sentenced to a term of five years imprisonment, to date from 7th March 2018. He appealed to the Court of Appeal against his conviction on the grounds that: (i) the trial Judge should have acceded to an application under the jurisdiction identified in DPP v POC [2006] 3 IR 238; and (ii) the verdicts of the jury were inconsistent with each other.
