They can appeal that decision, however, I doubt an appeal would succeed. Judges know the law. A trial isn't a place for the defense to present alternative theories of the law - they're supposed to present evidence relevant to the charges against the defendant. If Donald Trump is convicted, and the judge didn't follow the law, the appeals court will deal with that.

@@technowey While true the appeals court is designed to catch issues on law. The issue on nor letting a witness to testify on the underlying crime is a clearly biased move unless the crime isn't tied to campaign financial records anymore.

@@mike825611 - Donald Trump is being tried for falsifying business documents. A legal expert who has no direct facts about the *specific* documents listed in the indictment and/or direct evidence about the *specifics* of the charges in the case, as opposed to just the law, isn't a valid witness. So, I don't think the appeal would likely succeed.

@@mike825611 - Judge Merchan didn't stop a witness from testifying on the underlying crime. Allegedly he threatended that, however, it's hard to know if that's true, and ultimately it didn't happen. The witness he spoke to alone was making noises and faces questioning the judges decisions in front of the jury, and even said, "Jeez" one time, and then when told to stop, made a face and stared at the judge. That witness was *way* out of line. Judges don't allow that, and especially not in front of a jury. The right wing media that tried to claim Merchan was unfair there are ridiculous.

Instructions are vital to make sure the jury understands the law. It’s a bookkeeping issue. I don’t know what the other crime is. It’s vital that they prove another crime to make the false bookkeeping allegation a felony. The case has not been proven. There are no facts that support an underlying crime to convict him of any felony. I know of no judge who would let a jury go home over a week and then get back to work. Why are they not sequestered? This judge is conflicted and should have recused himself. I agree that there was a financial motive here. It’s politically motivated. It’s selective persecution not prosecution. I support him because it could happen to anyone. This judge violated his 6th Amendment right to a public trial by kicking everyone out of the courtroom. He’s lost his mind.

Here in Asia, the general consensus of people I speak with is that there is no longer such thing as a "Fair Trial" in the U.S. Most of the world used to look at the U.S. as a beacon of freedom, hope and integrity; a inspiration for other countries to emulate. You can not have a case without a preponderance of evidence pointing to a crime as determined unanimously by a grand jury. This is a trial that is the forum to either prove that it was indeed a crime beyond a reasonable doubt that is agreed upon unanimously by a jury or acquittal. Do you see that? Yes, closing arguments are critical, but the instructions that this judge gives the jurors will direct them as to what to focus on and how to interpret the witnesses statements. From what we have heard about this case, I can only assume that the judge will put a bias spin on what the jurors had heard and seen. Why wouldn't this corrupt judge do this?

@@zenobiaookpik Exactly that would convince me. I find it terrible odd that he always claims he'll testify but doesn't. So if I was a juror that means I would only be able to base my decision based upon the evidence presented by the witnesses presented. So that means if Trump still haven't admitted he slept with stormy daniels I can only take Stormy's grimy account of what happened. And that's not good because it sounded like a me too situation. If Trump says he didn't tell Cohen to pay anything but I can only go by the recording of him telling Cohen to pay in cash. That's not good because in my experience people only insist on being paid in cash if something wasn't on the up and up. Example ask the the people in my building could I rent one of the apartments for my family when they come into the town for a couple of weeks they said sure. They told me the price i said sure went to pay and they asked me if I could pay in cash. I said I always pay with my card no problems before. They all laughed nervously and said they'll check and see. Never got back to me.

This judge that is more than obviously politically motivated SHOULD NOT be on the in any position to make a decision on any case. There are too many personal and political attribute that make this judge unfit to be in charge of this case. It is more than obvious that he is unable to be unbiased in this case. He done things in this case that have never been legally done by a judge, ever. He needs to be removed from his seat as a judge and never again be allowed to practice law.

It is just another exaggerated fabrication and excuse. Just like Trump's. The gag order only prevents Trump from attacking or trying to intimidate witnesses, jurors, court staff (not counting the judge), or the families of these people. The same as any criminal defendant is not allowed to do. Only a true thug would do these things. But Trump had to be gagged to prevent it.

@@tscande You are incorrect, she is not a lawyer on the court record as the defense attorney, so the order does not apply to her she is merely a commentator and is sitting in the public gallery. The order applies to Todd Blanch, Susan Necheles and Emil Bove, that is the defense team. Hubba even describes herself as Trump's legal spokesperson.

Dream on. Trump's support continues to shrink, Much smaller than when he lost in 2020. Now, he is losing about 20% of register Republican voters to someone not even running anymore. Many of these are Republicans who say they will vote for Biden, instead of Trump. Also, as much as 30% of Republicans say they will not vote for Trump if he has even one felony conviction (which looks likely now). That includes 5% of MAGA rally goers. Dems have always outnumbered Republicans. How can Trump win when millions of Republican will also vote for Biden (my whole family included).
