On April 24, Lawfare Editor-in-Chief Benjamin Wittes delivered a Watson Distinguished Lecture at the Watson Institute for International and Public Affairs at Brown University to discuss the Israel-Gaza war and the implications for U.S. foreign and domestic policy. He talked about Israel’s incompatible objectives of freeing hostages and eradicating Hamas, the moral context of the war, U.S.-Israeli relations in this context, what the U.S. and Israel still have in common-and what they no longer have in common-in this environment, and how the war could affect U.S. presidential elections. To receive ad-free podcasts, become a Lawfare Material Supporter at www.patreon.com/lawfare. What an incredibly interesting conversation.

According to Wittes, South Africa has filed the equivalent of a frivolous lawsuit. I’m not sure which opinion is more offensive, this one or the Stormy Daniels one.

Best thing I've heard on the subject.

This is an important discussion and Wittes does an excellent job navigating it - I admit I haven’t paid as close attention to it while walking my dog and will have to give it another listen!

If more people in power would engage like Ben is talking then perhaps some progress can be made. I seriously disagree with some of his particulars and his biases but im sure he'd say the same. But at least there'd be sincere dialog

The origin of conflict should matter, as well. It is not the entirety of the issie but is extremely important. Examine the manner in which Israel was established by Europeans on Arab lamd. The way the people of Palestine habe been ignored or downplayed in negotiations. The way the Palestinian people have been moved one way then another all subject to Israel's whims. They are like the Native Americans in this respect and they are fighting back in the ways avaliable when confronting a massively overwhelming force. Now, build the discussion from there and work honestly for a mutual solution. Israel is too established to be removed. Its crimes will be largely overlooked. But until confronted there will always be resistance to occupation and subjugation.

Your argument is ahistorical and based on the false (in this case) framework of settler colonialism. Europeans didn’t colonize Palestine. Jews from the diaspora in Europe that had been expelled for centuries from one country to another under threat of violence, Jews that were classified within their countries of residence as foreigners, these returned to their ancestral homeland after enduring too much European hospitality. The category of settler-colonialism does not survive the attempt to apply it to Zionism. There were already Jews in Palestine, although their numbers shrank dramatically during the period of the Mameluke Caliphate. Many Jews returned to Jerusalem and Palestine in 1492 when they were heartily encouraged by the Ottoman Empire. What happened in 1492 to trigger this movement of Jews back to Palestine? They were expelled by the Spanish. Zionism was well underway with the blessings of the Ottomans before WWI. Here’s my last point regarding the falsity of the European colonialism argument. Millions of Jews lived in communities throughout the Middle East. These were all expelled from their homes when the state of Israel was founded and sent flooding into Israel. Partly this was a strategic move to create chaos and a humanitarian disaster at the moment the Arab countries were attacking the newly formed Israel, but that’s not the main point. The point is that these newly arrived Jews were the farthest thing from being Europeanized Ashkenazi Jews. These were Jews that had been previously exiled from their homeland at various times in history. It is easier than ever to study Jewish history and the history of Israel. If you are going to go to the trouble of learning Marx-derived historical analysis frameworks, for God’s sake learn about the history you are trying to analyze. Look at the data and please don’t force the data to fit your ideology.

Also, your comparison of Palestinians to native Americans is pretty disgusting. I think you should avoid such facile and false comparisons.

@MarcosElMalo2 the persecution of a group does not excuse that same group persecuting others. You spent all that time going through how horribly the Jewish people have been treated while saying absolutely nothing about their treatment of the indigenous Palestinian people before the UN (lead by European nations & America) forced the modern state of Israel onto the local population. There is no divine right to land. But cruelty, oppression, and subjugation are clearly man-made conditions and choices. And I did not say the people of Israel are Europeans. I said the Europeans gave them the land. Land they did not own or occupy. And even that being said I pointed to the similarities of acquisition and subjugation. The suffering of the Palestinian people is as real as the suffering of the Jewish people. What's the exchange rate on life? It should be 1:1.

Whether Israel has a legal or moral right to proceed as it has against Gaza, according to Wittes, is orthogonal to the fact that no society will sit still when attacked. In this position, Wittes appears to follow the school of international relations called _offensive realism_. While one applauds Wittes application of an important theory, Wittes also seems to be an adherent to another theory-the Henry Ford theory of history. Ford is often cited as saying, “History is bunk.” For Wittes, history begins on October 7 with Hamas’ attack on Israeli territory. The historical record of imperialism and of Zionism’s colonial settler variant of empire, is conveniently left out of Wittes attempt to justify the barbarity of the Israeli attack on Gaza. Most glaring, however, is Wittes’ failure to apply offensive realism to Palestinians. The failure is typical of delicate liberal Zionists who cannot imagine Israel as anything other than a somewhat flawed, yet normal state, simply trying to get on with its life while assailed unjustly by Hamas. Wittes’ failure is not a failure shared by less delicate Zionists. They neither neglect to apply the realist school to Palestinian aspirations nor do they follow Ford’s approach to history. Zionist writings dating from the early years (expressed by writers such as Ze’ev Jabotinsky in his 1923 work, “The Iron Wall,”) are clear: no indigenous people, including Palestinians, will willingly accept the theft of their land and destruction of their society by colonial outsiders. Indigenous people will fight back, the real Zionists understood then and understand now. They understand, that for Zionism to succeed in its project, harsh, cruel, and barbaric measures against the Palestinian people are required. What we see in the current bloodletting, is an escalation and a perhaps an attempt at the final solution much desired and demanded by the Zionist project from its inception.

Exactly. Israel was airstriking Gaza in late September over PROTESTS at the treatment of Palestinians in the West Bank under Smotrich and Ben Gvir. I am not surprised that Mr. Wittes has disappointed me in his wilful blindness. It seems to be very, very common.
