If you are charged with a felony in Texas, it is important to understand the grand jury system. In Texas, every felony must be indicted by the grand jury.
The Grand Jury meet at the downtown Fort Worth courthouse on 90-day terms to determine if probable cause was present to justify the arrest for every felony case in Tarrant County, Texas. The grand jury listens to evidence and they have 3 choices:
1. Keep the current felony charges at the same level of felony,
2. Lower the charge to a lesser charge, like a misdemeanor offense
3. No Bill - the equivalent of a dismissal
The sad thing is that many people don’t realize their felony case is even being presented to the grand jury. Most criminal lawyers don’t take advantage of this process and get involved to try to affect the outcome of the case quickly. It’s a shame because this rarely used criminal defense tactic can get a case dismissed quickly:
The Grand Jury No Bill: for example, we had a client where we found some factual evidence that tended to show that our client was innocent of the charges. In the case of our client, we located information that tended to show the search was illegal and the police were unable to affirmatively link our to the illegal items found in the vehicle, he was a passenger in. A No Bill is the equivalent of a dismissal and allows the case to be resolved quickly. As a result, our client would be eligible for an expunction upon completion of the statute of limitations.

Hey Boss, I heard grand jury hearings are greatly Backlogged in Texas and other states. Any truth to that??

It depends on which county you are talking about. Dallas county is REALLY slow and behind on grand jury presentations right now. However, Tarrant County has been indicting cases quickly because they have nothing else to do and they have been continuing the grand jury process. It varies by county. Great question.
