@@jaxcoss5790 I don't have to because this sequence doesn't make sense. Sure they may fix it outside of this, but having her give time instead of money doesn't actually help her (but they make it seem like a caring gesture in this sequence)
WTH is happening here? The alleged victim isn't the DA's boss. Why would she care if the alleged victim catches charges for her taking a thief off the street?
The DA doesn't care, but the victim (old guy) cares!!! Because the old guy was trying to defraud the insurance company by passing the fake jewelry as the real one, so he has no choice but to drop the charges!! Because if he continue the case against her then her lawyer will force him to testify that he was faking jewelry is real and in turn his insurance company will sue him for fraud which by itself is a felony!! 😜 Once he dropped the charges of theft the DA had no case to prosecute !!
It complicates matters, in the eyes of the D.A., unnecessarily so. 1st, she can’t prosecute her with a felony, just a misdemeanor, which, depending on the D.A., be considered a waste of time. 2nd, the “victim” would have to testify, and you can believe that the defense attorney would bring the previous incident up, which harms the credibility of the “victim” and, given the absence of other evidence, harder to win. 3rd, she’d have to raise charges of fraud against the guy, and proving intent in this circumstance would not be easy to do. No one likes to lose. Easier to dismiss and move onto the next 1000 cases that the D.A. is probably already having to tackle.
She over charged because of her lack of due diligence, which would be brought before the court if the prosecutor decided to refile with appropriate charges.
